Shock: McCain voting no on Sotomayor
Hot Air ^ | August 3, 2009 | ALLAHPUNDIT

So much for my prediction of 75 votes to confirm; with Sessions, Kyl, and now even Maverick against her, she’ll be lucky to break 70. I’m honestly stunned, for the same reason Hotline is:

McCain voted against Sotomayor’s nomination to the 2nd Circuit Court of Appeals in ‘98, so his decision is not entirely surprising. But like his friend and GOP colleague, Sen. Lindsey Graham (SC), McCain has decried the politicization of judicial nominations that led to a failed Dem filibuster of Justice Samuel Alito. Graham, citing a desire to “start over” on the Senate’s advise and consent role, was the only GOP member of the Senate Judiciary Cmte to support Sotomayor’s nomination last week.

Maverick was part of the Gang of 14 too, which makes it doubly surprising. His supposed reason for voting no is her “long record of judicial activism” but I’m not sure what he means by that. The only decision of hers that the GOP spent any serious amount of time attacking was Ricci and that was handed down just 18 months ago. Likewise, as I’ve said in a few other posts, she’s never had a reputation for being a lefty ideologue on the bench; we’re talking about a former prosecutor, after all.

It’s her speeches that raise the prospect of judicial activism, but why should they be taken as more predictive of how she’ll rule than her actual opinions? She’s closer to the center than any Obama nominee is likely to be, so if she’s “not qualified,” none of them will be — which I think is the deeper message McCain’s trying to send here.

>>Even a broken clock is right twice a day.<<

It reminds me of when Ted Baxter tried, for a moment, to stand with the rest of the crew when they were fired en masse.

Like Murray said: “When a donkey flies, you don’t blame him for not staying up that long.”

McCain is our flying donkey.

Hell no. He knows she’ll win confirmation without him. He’s still the same jerkwater ass he’s always been. Notice how he waited until she was assured confirmation before making a peep about not voting for her confirmation.

Where was he before Lindsey Graham voted her out of committee, the only Republican to do so, and the only way she could have gotten out of committee?

What does he have to lose? The Dems have enough votes to confirm without him. Meaningless. I’m not impressed.

Agree. Same goes for Nelson in Nebraska. I have no idea where he stands but I suspect that he will not vote for her because she has the votes. W/o doubt he would vote for her if it was the necessary one. That's why a Dem is a Dem no matter if they play a conservative game.

“Is John finally starting to listen?”

No. He wants to win his senate seat again.

Vote the bum out anyway.

I guessed wrong. See now that he will vote for the racists.

Don’t blame me - I voted for Palin!

But seriously, folks. I was not happy at all with McCain, but I can’t think of any policies of Obama’s that I would prefer to his.

The battle was lost in the primaries, somehow.

The RINO geezer has a CONSERVATIVE running against him in the AZ primary, so he’s ACTING like he’s a conservative.

Don’t be fooled. It’s just an ACT.

There is not, nor will ever be, a credible challenge to McCain in AZ. The job is his for life, like Ted Kennedy. There is no heat on him.

This helps some. If there were more Republicans in the Senate and Lindsey Graham hadn’t supported her, it could have made a difference.

I applaud McCain’s decision, but still support his primary opponent. A loud protest vote in the primary will get his attention.

His base is Democrat.

He has to get through the Primary first (prior to the Fall). Its that base that he's worried about, I would guess.

He should call off his apprentice, Lindsey Graham then.

Could McShame be scared of his primary challenger or something?

“By contrast, GOP Senate Conference Chair Lamar Alexander (R-TN) said he will vote to confirm Sotomayor.”
