The White House strategy of turning supporters into snitches when they see "fishy" information about the health care debate may run afoul of the law, legal experts say. "The White House is in bit of a conundrum because of this privacy statute that prohibits the White House from collecting data and storing it on people who disagree with it," Judge Andrew Napolitano, a FOX News analyst, said Friday. "There's also a statute that requires the White House to retain all communications that it receives. It can't try to rewrite history by pretending it didn't receive anything," he said. "If the White House deletes anything, it violates one statute. If the White House collects data on the free speech, it violates another statute."

I think a good first step would be for the White House to release the names collected so far (Freedom of Information Act, perhaps?). Then, if someone appears on that list who never corresponded with the White House, I would think that they’d have cause to file a lawsuit. JMO.
That's the best idea I've heard yet. Only problem is, the top class action attorneys in the country are democrat lobbiests. We need conservative lawyers.

The law is meaningless if nobody is willing to enforce it.
I wonder if one could do a FOIA request to see if they have any information on you?
What about the health care survey on Brad Ellsworth’s website? Are his staff submitting that info to flag?
And who are the other congressmen that have a similar survey on their websites?
Bill (the Gasbag) O’Reilly jumped on Judge Andrew Napolitano, claiming that Obama just wanted what was said reported to him, not who said it.
You know...from websites where all you have to do is insert an email address and the WH will end up on their mailing list. There are lots of them...fill the WH email box with spam from stores, kids sites, joke sites, (whatever your "evil protestor" mind wants to send, LOL). Easy enough to do...just insert the flag@whitehouse.gov email addy into the sites area requesting an email addy for future mailings.
Well then the Natl archives will be full of newsletters from every vile/funny/off beat site on the internet. I know lots of folks have been signing the WH up to receive them.
Well, I don’t see what the fuss is all about...the ACLU said it was no big deal.
