In 2000, Scientific-Atlanta and Motorola agreed to sell cable boxes to Charter Communications, which was creative in booking these deals and had to restate its financial results. Scientific-Atlanta and Motorola had done nothing more than enter into contracts with its customer, Charter, on terms requested by that customer, and had accounted for the deals properly. Nonetheless, the Stoneridge investment firm sued the two suppliers, alleging a “scheme” against Charter investors. -WSJ

They lost only because Last year, the Supreme Court ruled that a company couldn't be held liable for damages just because it worked with a company that committed fraud. Now, the opportunistic Arlen Specter, whose son is a prominent personal injury/medical malpractice lawyer, and other senators want to pass a law to specifically allow that. The WSJ reported on that this week, and suggests that another bill may be worse:

Mr. Specter has also introduced a bill to let attorneys claim an up-front tax deduction on expenses they incur while building contingency fee cases. Amazing but true: Mr. Specter wants to give a tax cut to sustain the likes of Mel Weiss or Dickie Scruggs in the yachts to which they have become accustomed while they await jackpot jury verdicts. Even Democrats are too embarrassed by this giveaway (estimated cost: $1.6 billion) to pass it as a stand-alone bill, so tort lobbyist Linda Lipsen recently said “we have to tuck it into something” else, such as another “tax vehicle.”

I hope the media will notice. When I started consumer reporting, I believed the plaintiffs’ lawyers suits benefited consumers. After watching them work, I came to understand how destructive these suits are. They crush innovation. They kill free speech. They bully. I write about it in my myth book.

You are such an idiot. You know nothing and throw crap out as if it is truth. The article itself pointed to the inflated costs ( 25 to 30%)that occur because doctors feel they have to order every freakin test in the world to cover their asses. Moreover the ampunt of pro bono work that doctors used to do has gone done substantially for the same reason. Can’t afford to take care of someone for nothing who will turn around and sue you for millinos of bucks.

Since you know nothing about this keep your yap shut

A prime technique for bringing down an existing social order is to OVERLOAD and OVERWHELM the governmental systems, creating economic and social chaos. What’s going on today straight out of Saul Alinsky’s “Handbook for Radicals.” Because we have NOT sent home 20 million illegals, WE NOW HAVE THE FORMER AND ARE CLOSING IN ON THE LATTER. BOTH parties have been applying those methods but Obama, who studied those methods under Bill Ayers while a so-called “community organizer,” is using ALL the tools in the radical toolkit. If it continues much longer, YOUR kids are doomed to life as serfs in a nation that will more resemble Nazi Germany or the old USSR than the America the Founders ATTEMPTED to leave us.

My niece is an OB/GYN who took her pre-med at HAAAAVVAAAAADDD! Needless to say, she emerged from that experience a FLAMING, BLEEDING HEART LIBERAL. (She stopped catching babies and went into research when her malpractice premiums exceeded her annual earnings.)

Upon completing her medical training at yet another liberal university, she interned at a hospital near the border in San Diego.

It was there that a mystical transformation took place: She began to connect the heavy deductions from the slave wage GROSS EARNINGS for which she busted her butt for as many as 72 virtually sleepless hours in a row with the taxis and jalopies regularly sliding to the curb in front of the ER.

Many of them contained pregnant illegals who won the race to deliver their babies HERE. She caught many of those “anchor babies” who, under the current — and COMPLETELY ERRONEOUS —interpretation of the 14th Amendment were IMMEDIATELY NEW AMERICANS. The mother – who, obviously, could not care for the child if she were back in her native land — could not be deported now even if the INS and the political bosses WANTED her deported . And as the mother of a new US citizen, the woman could remain here for about as long as she cared to – and that was usually for life.

Most of those patients were welfare recipients and the deliveries were charity cases: The bill for the hospital’s – and HER services – were routinely spread over the bills of those who DO pay. And what the other users of those facilities don’t cover went back to the taxpayers.
And since my niece was now a taxpayer, they were costing HER.

And while she may not exactly be a libertarian, today she’s now a LOOONNNNG way from Haaaavaaaaaad.

And just so the bleeders who might see this don’t think me some sort of ethnocentric bigot, I submit this problem is MORE than just about illegals.

Before my oldest daughter was born at University Hospital in Cleveland in 1967, I sat in the main lobby as welfare mother-to-be after welfare mother-to-be shuffled through the door to the maternity ER for THEIR free deliveries.

Before WE could take OUR daughter home, I had to cough up over 3 grand. And that was a great deal of dough in 1967, especially for a guy just out of the USAF.

As I wrote the check, I remembered the magazine article I’d recently read by a hospital administrator from Massachusetts who admitted that all US hospitals practiced a form of medical Marxism, spreading the costs of care for indigents over the bills of those who DO pay for care. Given the move to socialism here, it probably will never be otherwise: Not counting Byzantine complexity and confusion, government produces – and has — NOTHING unless it first takes it from some PERSON. SOMEBODY ALWAYS PAYS.

The illegals have been using the emergency rooms of our hospitals for their health-care, almost always at no charge to them. That cost is either spread over other users or the taxpayers. We have seen a national epidemic of hospital closings due to their insolvency, much of it caused by the burden of trying to render care to PEOPLE WHO SHOULDN’T EVEN BE HERE, denying care to native-born citizens who normally pay their bills and their taxes.

Look, I have a big enough problem paying for the 3rd and 4th generation slackers and welfare bums who were BORN here.

It’s time we stopped paying for those who were not.

Does not address several issues ——first the ever escalating costs of malpractise insurance ( as high as 200,000 per annum in some specialties) second does not address the issue ( which is the one I meantioned and you don’t address) of doing too many tests in order to have protection from law suits filed by aholes like you and John Edwards.

You will not reeducation anyone but yourself. Be sure to bow to Obama the next time he is in town

you can complain all you want, there are waaaaaaaaaaaaaaaaaaaaaaaay too many law schools now.

Most lawyers are UNDER the age of 45.

when Republicans dominated the White House and Congress

TRUE conservative Republicans not dominated the WH and Congress.

There was a small Republican majority, but the RINO contingent (really Democrats) kept the Conservatives in the minority.

There has not been a Conservative majority in both houses of Congress and the WH at the same time in recent history.

Anybody can argue with them. Their mouths ain’t prayer books. But neither are the pro- tort reform folks.

Ask yourself this. Why do you think doctors, banks, insurance companies, and big business don’t want 12 ordinary American to decide whether they are right or wrong? Tort reform means that everyday Americans lose any power to seek redress for harms done them.

parsy, who says any conservative that approves taking power from the people needs to do a double take.

First, where is the 30% number coming from?

Second, how many dead people do you think we are talking about? I have heard numbers as high as 100,000 per year.

Third, do you think doctors and hospitals should be able to kill and hurt their patients without taking any responsibility for it? And if so why? And if not, then how does the amount of harm get figured out? And the guilt?

parsy, who thinks tort reform is one of these knee jerk things whether people speak before thinking
