Obama Administration Calls Marriage Law Unfair (DOMA)

The Obama administration filed court papers Monday arguing that a federal marriage law discriminates against gays, even as government lawyers continue to defend the law.

Justice Department lawyers are seeking to dismiss a suit brought by a gay California couple challenging the 1996 Defense of Marriage Act. The administration's response to the case has angered gay activists who see it as backtracking on campaign promises made by President Obama.

In the court papers, the administration urges law's repeal but says that in the meantime, government lawyers will continue to defend it as a law on the books.

The government's previous filing in the case angered gay rights activists who supported Obama's candidacy in part because of his pledge to move forward on repealing the law and the "don't ask, don't tell" policy that prevents gays from serving openly in the military.

With plummeting approval rating, Obama has apparently decided to "go all in".

I'd have to look more closely, but I believe that Obama stated that he supported DOMA during the general election campaign - could be wrong.

the obamanation is one of them, in my view...

all this does for me is remind me of Donald Young, the black guy who was murdered after it surfaced that he and obamanation had a homosexual affair. BTW, Young was the choirmaster at REV. WRIGHT’s church while obamanation attended.

It appears that the obamanation did not want that story to surface during the campaign. Instead of HIDING Young, (as obamanation did to his life records) Young was “ahem” permanently dispatched.

This is really funny, if you keep up on things. Obama has issued an executive order to have fed agencies investigate extending domestic partner benefits to persons of the same sex. Only if you are the same sex. If you are of one sex, you can't have a “domestic partner” of the opposite sex. A blatant discrimination! If you are heterosexual you must legally marry to receive those benefits - and pay the increased taxes that come with marriage.

Where was that equal protection clause again?

The marriage law does NOT discriminate against gays! Gays must just marry a spouse of the OPPOSITE sex, just like straights MUST also. The same laws apply to BOTH gays and straights, so there is NO discrimination.

Thanks for the info. It looks like, at least on his website, that he backed the repeal of DOMA. But, I don't remember this issue ever coming up in any of the debates - again, I could be wrong. But, along with 2nd Amendment rights, I don't remember a single question from any of the debate moderators that went anywhere near the so-called "Guns, God and Gays" issues. How convenient for Obama.

Had this actually been an issue during the campaign, I'm sure it would have cost him more than a view votes, especially in the heartland.

You're welcome. I had posted a story on this last August (not sure if it was that particular article), but I can't find the FR thread in my search now.

It was all ignored at the time or swept under the rug to protect the 0 until election time. I believe CNS was one of the only news outlets that even mentioned it.

Based on where his polling numbers are now compared to where they were in April, I'm not sure if anyone will believe him in just two months

His decline is even more remarkable considering the extraordinarily favorable coverage he always receives and the fact that he hasn't really yet stepped into a foreign policy mess - yet.

As an African-American man, a child of an interracial marriage, a committed scholar, attorney and activist who works to protect the Bill of Rights, I am sensitive to the struggle for civil rights. As a state Senator, I have taken on the issue of civil rights for the LGBT [lesbian, gay, bisexual, and transgender] community as if they were my own struggle because I believe strongly that the infringement of rights for any one group eventually endangers the rights enjoyed under law by the entire population. I will also oppose any proposal to amend the U.S. Constitution to ban gays and lesbians from marrying. This is an effort to demonize people for political advantage, and should be resisted.

When Members of Congress passed DOMA, they were not interested in strengthening family values or protecting civil liberties. They were only interested in perpetuating division and affirming a wedge issue.

Despite my own feelings about an abhorrent law, the realities of modern politics persist. While the repeal of DOMA is essential, the unfortunate truth is that it is unlikely with Mr. Bush in the White House and Republicans in control of both chambers of Congress.

We must be careful to keep our eyes on the prize—equal rights for every American. We must continue to fight for the Employment Non-Discrimination Act. We must vigorously expand hate-crime legislation and be vigilant about how these laws are enforced. We must continue to expand adoption rights to make them consistent and seamless throughout all 50 states, and we must repeal the “Don’t Ask, Don’t Tell” military policy.

I know how important the issue of equal rights is to the LGBT community. I share your sense of urgency. If I am elected U.S. Senator, you can be confident that my colleagues in the Senate and the President will know my position.

I have said time and time again that those who are together and not married yet should sue the state for their civil union.

surely if homos have this but normal straight folks cannot then it is discrimination.
There is no way for a normal couple to lose

Now if they think they have a right to marry that of the same sex then surely the LDS should go to MA and sue for their kind of marriage.

there is also (first name) Lieutenant Q. Harris who was shot in his car just before testifying that he knew who was behind the passport thefts last summer. Look up Lieutenant Q. Harris on Google... that case is still, strangely enough, unsolved.
