This all begins with the amendment that allowed Congress to tax income.

All your other questions might have relevance but for that particular piece of our legal history.

The problem with this argument is that the congress had taxing power before the 16th ammendment- it was just highly limit. All the 16th amendment did was to open up a huge income stream for the congress. The limits on the spending powers of congress where in no way eased by the 16th amendment.

I will apologize however for using the term old geezers. Not cool.
