Posted on 08/28/2009 8:16:59 AM PDT by Servant of the Cross
This is an administration that is determined to conduct itself by the rule of law. And to the extent that we receive lawful requests from an appropriately created court, we would obviously respond to it.
It was springtime in Berlin and Eric Holder, a well-known rule of law devotee, was speaking to the German press. Hed been asked if his Justice Department would cooperate with efforts by foreign or international tribunals to prosecute U.S. government officials who carried out the Bush administrations post-9/11 counterterrorism policies. The attorney general assured listeners that he was certainly open to being helpful. Obviously, he said, we would look at any request that would come from a court in any country and see how and whether we should comply with it.
As the Associated Press reported at the time, Holder was pressed on whether that meant the United States would cooperate with a foreign court prosecuting Bush administration officials. He skirted the question in a way Americans ought to find alarming. The attorney general indicated that he was speaking only about evidentiary requests. Translation: The Obama administration will not make arrests and hand current or former American government officials over for foreign trials, but if the Europeans or U.N. functionaries (at the nudging of, say, the Organization of the Islamic Conference) want Justices help gathering evidence in order to build triable cases count us in. I don’t think everything is hidden; his hatred of white folk seems pretty apparent.
Hue and cry followed Holders decision this week to have a prosecutor investigate CIA interrogators and contractors. The probe is a nakedly political, banana republic-style criminalizing of policy differences and political rivalry. The abuse allegations said to have stunned the attorney general into acting are outlined in a stale CIA inspector generals report. Though only released this week a disclosure timed to divert attention from reports that showed the CIAs efforts yielded life-saving intelligence the IG report is actually five years old. Its allegations not only have been long known to the leaders of both parties in Congress, they were thoroughly investigated by professional prosecutors not political appointees. Those prosecutors decided not to file charges, except in one case that ended in an acquittal. As I outline here, the abuse in question falls woefully short of torture crimes under federal law.
I believe the explanation lies in the Obama administrations fondness for transnationalism, a doctrine of post-sovereign globalism in which America is seen as owing its principal allegiance to the international legal order rather than to our own Constitution and national interests.
As a result, there have always been serious concerns that the ICC could investigate and try to indict American political, military, and intelligence officials for actions taken in defense of our country. Here its crucial to bear in mind that the United States (or at least the pre-Obama United States) has not seen eye-to-eye with Europe on significant national-security matters. European nations, for example, have accepted the 1977 Protocol I to the Geneva Conventions, while the United States has rejected it. Protocol I extends protections to terrorists and imposes an exacting legal regime on combat operations, relying on such concepts as proportional use of force and rigorous distinction between military and civilian targets. That is, Protocol I potentially converts traditional combat operations into war crimes. Similarly, though the U.S. accepted the torture provisions of the U.N. Convention Against Torture (UNCAT), our nation rejected the UNCATs placing of cruel, inhuman, and degrading treatment on a par with torture. By contrast, Europe generally accepts the UNCAT in toto.
And the transnational Left has still another treat in store: its notion of universal jurisdiction. This theory holds that individual nations have the power to prosecute actions that occur in other countries, even when they have no impact on the prosecuting nation. The idea is that some offenses such as torture and war crimes so offend the purported consensus of humanity (i.e., so offend left-wing sensibilities) that they may be prosecuted by any country that cares to take the initiative. In fact, many countries (the United States included) open their justice systems to civil suits against government officials again, even if the country where the suit is filed has nothing to do with the alleged offenses.
Black liberation theology.
The Man (whitey) been keeping us down (yeah, like I/we owned a plantation in South carolina until last year, LOL)
Time to turn the tables. Time to git those blue-eyed white debils.
This administration IS transparent, though not in the way they said it would be.
Rush is RIGHT, as usual.
We really have terrorist running our country.
Will Pres. Bush and VP Cheney and others be extradited?
I believe if you see this administration going after and prosecuting the prior administration and people whose responsibility it was to protect and defend this country against enemies foreign and domestic, there will be such an outcry like you wouldn’t believe. The revolution has already started across the country and if this administration starts prosecuting them, come election time no democrat would even be elected dogcatcher except in hard core far left commie districts. They’d lose by a landslide.
One of the chief qualifications for 0bama's "key" advisors.
I believe Holder apprenticed under Janet Reno in the Clinton years.
I’m still waiting for a Waco or Elian Gonzales type event to show the citizens who’s in charge.
Those who maintained that Obama is not some wacko leftist are finding it harder and harder to explain The Great Spreader’s latest moves. Everything he’s been doing has been to the far left. Look at his appointees. Solid grade-A Marxists all of them. I hope Obama goes forward with his phony prosecutions. This will bring him down faster.
Holder was and is and will always be the Clintons butt boy!!
His strategy is not to prosecute here but give the European ‘World Court’ evidence that they can use to prosecute and request extradition. He’ll hide behind the laughable smokescreen that he’s not the one prosecuting.
Holder's lynching mobs
Temember the movie “The Black Gestapo”? Well now we have it leading our country.
I always had a negative view of the KKK, but after seeing 0bama and Holder’s tactics with the Black Panthers, I can fully understand at least one reason why it was formed.
He has been warned that there will be no more “Free” Wacos this time around.
Maybe we should all send bananas to Eric Holder.
I hate his more than he hates me, that he can be sure of. They are all disgusting.
The people have the perfect right to liberate themselves from Marxist oppression when it is violating individual natural rights
“We really have terrorist running our country.”
However disguised in ‘sheep’s clothing’ he tries to appear to be.
I don't think they are going to like what happens.
He is an Internationalist Communist. Intent on subrogating the Constitution to International Law. Hopefully in the end they can be stopped and tried by an American court.
KKK was absolute scum, and you should be ashamed of having any empathy with it.
You must be more accurate in your descriptions.
If bugs like that come anywhere near me, I will introduce them to God.
We are witnessing the emergence of a new government dictatorship...on American soil. History tells us that the rampant corruption, fed by cronyism, are the nuts and bolts of dictatorships.
Dictatorships are almost always governed by groups of friends and associates who appoint each other to government positions and use governmental power and authority to protect each other from accountability.
Obama is building his personal Civilian Security Force------ACORN and illegals blindly loyal to Obama----ready to silence the populace and march us to reeducation camps.
The Third World (organized by illegals inside the US) can easily be mobilized.........b/c of their blind loyalty to Obama for all hes giving them. Including:
a USSC justice, top federal jobs, amnesty,
free healthcare, free houses, free mortgages,
endless identities, unlimited SS nos, sanctuary cities,
billions of tax dollars to latino-centric organzations to fight Americans,
neutralizing L/E to allow illegals to engage in law-breaking with impunity, etc, etc, etc.
Glenn Beck is issuing dire warnings about Obamas Civilian Security Force ...stronger and better-funded than the US military" (in Obama's own words). Beck keeps baiting Obama to tell who is the "civilian enemy" the Civilian National Security Force will be fighting..
Looks like the intellectuals over at NR are starting to wake up to the fascism growing before our eyes.
Which is why they are willing to let a foreign court do the prosecution and Holder would be willing to hand over evidence. That's what this story is about. Sort of a Pontius Pilate move.
“Black liberation theology.
The Man (whitey) been keeping us down (yeah, like I/we owned a plantation in South carolina until last year, LOL)”
You find it funny
I find it funny
But Obama is a true believer. We should call him Barack Ogabe.
We must stop this brownshirt force just like ObotomyCare.
I have been incorporating Alinsky’s Tactics into my personal arsenal and I find it can be quite effective.
I recently asked someone who was railing about the “U.S. history of racism and slavery” about the history of their lives in the past ten years- did that include any evidence of slavery or institutionalized oppression? They had no answer. I laughed in their face and walked away.
I am done being PC, and as I move around the blue city/state in which I live, I look at angry minorities with a look on my face that asks “so you hate whitey too? Yes, cant you tell I’m a plantation owner?” Believe me, the mocking smile is effective. They arent sure how to deal with it.
Several months ago while engaged in conversation with an ambulance chaser who claimed he was an independent but was still railing about Bush, I looked him right in the eye and with a mocking smile, said “You have Bush derangement syndrome”. I swear he looked like I had killed his puppy.
These tactics work, and must be turned on them- the communists are here and the marxist revoltion is upon us. It is up to us to resist and retake our country IN EVERY WAY WE CAN, including mocking the radicals.
I have taken an oath to uphold the Constitution, and I have affirmed that I do not seek to overthrow the government. However, I am actively seeking to overthrow the communists who are IN our government.
I think Republicans should start compiling a list of War crimes By the ONE in Afghanistan now.
He is an individual with deep-rooted grievances...... and is in a position to unburden himself.
Obama/Rahm/Holder are purposefully antagonizing large conservative groups in middle America in an effort to cause civil unrest. This would give them an excuse to declare Martial Law.
Americans need to be very vigilant: Obama and his loathsome admin are very calculated in their use of power. As dissent among the populace grows, they are capable of plotting staged events to boost their advantage.
If these arch-manipulators perceive there isnt measurable fear in the hearts of the people, they will create that fear to solidify their power. They know people will succumb to fear and will relinquish their God-given liberties when they are fearful.
“Holder laid his cards on the table early-on——when he told a shocked America that we are all cowards (WRT race). “
Holder and Obama are racists who think they can run over the white middle class with their shadow government and infiltration tactics. I guess they figured that if whitey was stupid enough to fall for his “hope & change(Alinsky) bukk$hit, we would just line up for the slaughter. He was wrong! We ran a RINO that most conservatives would either not vote for, or would do so with great reluctance. The war has started, the clock is ticking, and we must be ever vigilant!
If one is to fight the Marxists, one has to familiarize
oneself with their bible. I just ordered “Rules for Radicals”
and I will commit it to memory. All my life I have studied the”bully/coward” syndrome. Obama is a spoiled rotten bully/coward, who will fold like a house of cards if we stand up to him. Obama intends to push the envelope as far as he can while in office. He intends to take over as much of the “means of production” as he can get away with, and hand it over to his people. Will we stop him? I believe we will. It will get ugly.
While you are waiting for your book, here is an online summary of it. The infamous tactics part is in section seven, but there is more to his paradigm than that, as you will see from reading through the page.
Thanks very much.
It is how it works... Thanks for the ping.
Speaking of Eric Holder, what do you make of this...DOJ and DHS joining forces? Seems Holder is getting his claws into everything.

ICE and DOJ Sign Agreements to Share Information on Drug Trafficking and Organized Crime
U.S. Immigration and Customs Enforcement (ICE) and the U.S. Department of Justice (DOJ) signed two Memoranda of Understanding (MOUs) on Thursday, Aug. 6, 2009, to foster increased communication between participating agencies at the Organized Crime Drug Enforcement Task Force (OCDETF) Fusion Center and the International Organized Crime Intelligence and Operations Center (IOC-2).
The OCDETF Fusion Center and IOC-2 are founded on the principle that we can accomplish more together than we can separately, said Deputy Attorney General David W. Ogden. By bringing together the agencies and personnel with existing resources and expertise we can work more effectively as partners to shut down organized crime networks, seize assets and save taxpayer dollars in the process. This agreement, coupled with recent agreements between ICE, DEA and ATF will allow new levels of cooperation and intelligence sharing.
These additional agreements weve signed with our Department of Justice law enforcement partners help us all better combat the worst criminal offenders, said Homeland Security Assistant Secretary for ICE John Morton. By combining our resources, we expect to stop more drug smugglers and organized crime across the country.
By becoming an active participate in the OCDETF Fusion Center as outlined in one MOU, ICE will be adding more than 25 million records, including reports of investigation, wiretap intercept information and financial investigative material, from its drug-related investigations and drug-related financial investigations to the Fusion Center. ICE will also gain access to the additional agency information available through the Fusion Center. This increased partnership will further help in the joint fight against drug trafficking organizations by all of the other Fusion Center agencies, including the FBI, the U.S. Drug Enforcement Administration (DEA) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The ability of all participating Fusion Center agencies to develop target profiles and actionable investigative leads to disrupt and dismantle significant drug traffickers is enhanced by the increase of information collected at the Fusion Center. In addition to sharing in one collection of information, coordinating with the Fusion Center allows participating law enforcement agencies to de-conflict their investigations. De-confliction ensures that two or more agencies are not duplicating resources or that one agencys investigation will not have a negative impact on another agencys investigation.
DOJ and ICE also signed an MOU regarding ICE participation in the newly-created IOC-2, which marshals the resources and information of nine U.S. law enforcement agencies, as well as federal prosecutors, to collectively combat the threats posed by international criminal organizations to domestic safety and security. It allows partner agencies to join together in a task force setting, combine data and produce actionable leads for investigators and prosecutors working nationwide to combat international organized crime, and to coordinate the resulting multi-jurisdictional investigations and prosecutions. ICEs new membership in IOC-2 will allow all the partner agencies to draw on data that now ICE will provide, while allowing ICE to work investigations with other agencies that may be targeting the same syndicates.
These latest MOUs follow closely on the heels of two additional agreements DEA and ATF, respectively, signed recently with ICE. Together, these agreements show a significant level of partnership and cooperation within the federal law enforcement agencies to target major criminal organizations.
