This is an administration that is determined to conduct itself by the rule of law. And to the extent that we receive lawful requests from an appropriately created court, we would obviously respond to it.
It was springtime in Berlin and Eric Holder, a well-known rule of law devotee, was speaking to the German press. Hed been asked if his Justice Department would cooperate with efforts by foreign or international tribunals to prosecute U.S. government officials who carried out the Bush administrations post-9/11 counterterrorism policies. The attorney general assured listeners that he was certainly open to being helpful. Obviously, he said, we would look at any request that would come from a court in any country and see how and whether we should comply with it.
As the Associated Press reported at the time, Holder was pressed on whether that meant the United States would cooperate with a foreign court prosecuting Bush administration officials. He skirted the question in a way Americans ought to find alarming. The attorney general indicated that he was speaking only about evidentiary requests. Translation: The Obama administration will not make arrests and hand current or former American government officials over for foreign trials, but if the Europeans or U.N. functionaries (at the nudging of, say, the Organization of the Islamic Conference) want Justices help gathering evidence in order to build triable cases count us in. I believe the explanation lies in the Obama administrations fondness for transnationalism, a doctrine of post-sovereign globalism in which America is seen as owing its principal allegiance to the international legal order rather than to our own Constitution and national interests.
As a result, there have always been serious concerns that the ICC could investigate and try to indict American political, military, and intelligence officials for actions taken in defense of our country. Here its crucial to bear in mind that the United States (or at least the pre-Obama United States) has not seen eye-to-eye with Europe on significant national-security matters. European nations, for example, have accepted the 1977 Protocol I to the Geneva Conventions, while the United States has rejected it. Protocol I extends protections to terrorists and imposes an exacting legal regime on combat operations, relying on such concepts as proportional use of force and rigorous distinction between military and civilian targets. That is, Protocol I potentially converts traditional combat operations into war crimes. Similarly, though the U.S. accepted the torture provisions of the U.N. Convention Against Torture (UNCAT), our nation rejected the UNCATs placing of cruel, inhuman, and degrading treatment on a par with torture. By contrast, Europe generally accepts the UNCAT in toto.
And the transnational Left has still another treat in store: its notion of universal jurisdiction. This theory holds that individual nations have the power to prosecute actions that occur in other countries, even when they have no impact on the prosecuting nation. The idea is that some offenses such as torture and war crimes so offend the purported consensus of humanity (i.e., so offend left-wing sensibilities) that they may be prosecuted by any country that cares to take the initiative. In fact, many countries (the United States included) open their justice systems to civil suits against government officials again, even if the country where the suit is filed has nothing to do with the alleged offenses.

I have been incorporating Alinsky’s Tactics into my personal arsenal and I find it can be quite effective.
I recently asked someone who was railing about the “U.S. history of racism and slavery” about the history of their lives in the past ten years- did that include any evidence of slavery or institutionalized oppression? They had no answer. I laughed in their face and walked away.
I am done being PC, and as I move around the blue city/state in which I live, I look at angry minorities with a look on my face that asks “so you hate whitey too? Yes, cant you tell I’m a plantation owner?” Believe me, the mocking smile is effective. They arent sure how to deal with it.
Several months ago while engaged in conversation with an ambulance chaser who claimed he was an independent but was still railing about Bush, I looked him right in the eye and with a mocking smile, said “You have Bush derangement syndrome”. I swear he looked like I had killed his puppy.

ICE and DOJ Sign Agreements to Share Information on Drug Trafficking and Organized Crime
U.S. Immigration and Customs Enforcement (ICE) and the U.S. Department of Justice (DOJ) signed two Memoranda of Understanding (MOUs) on Thursday, Aug. 6, 2009, to foster increased communication between participating agencies at the Organized Crime Drug Enforcement Task Force (OCDETF) Fusion Center and the International Organized Crime Intelligence and Operations Center (IOC-2).
The OCDETF Fusion Center and IOC-2 are founded on the principle that we can accomplish more together than we can separately, said Deputy Attorney General David W. Ogden. By bringing together the agencies and personnel with existing resources and expertise we can work more effectively as partners to shut down organized crime networks, seize assets and save taxpayer dollars in the process. This agreement, coupled with recent agreements between ICE, DEA and ATF will allow new levels of cooperation and intelligence sharing.
These additional agreements weve signed with our Department of Justice law enforcement partners help us all better combat the worst criminal offenders, said Homeland Security Assistant Secretary for ICE John Morton. By combining our resources, we expect to stop more drug smugglers and organized crime across the country.
By becoming an active participate in the OCDETF Fusion Center as outlined in one MOU, ICE will be adding more than 25 million records, including reports of investigation, wiretap intercept information and financial investigative material, from its drug-related investigations and drug-related financial investigations to the Fusion Center. ICE will also gain access to the additional agency information available through the Fusion Center. This increased partnership will further help in the joint fight against drug trafficking organizations by all of the other Fusion Center agencies, including the FBI, the U.S. Drug Enforcement Administration (DEA) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
The ability of all participating Fusion Center agencies to develop target profiles and actionable investigative leads to disrupt and dismantle significant drug traffickers is enhanced by the increase of information collected at the Fusion Center. In addition to sharing in one collection of information, coordinating with the Fusion Center allows participating law enforcement agencies to de-conflict their investigations. De-confliction ensures that two or more agencies are not duplicating resources or that one agencys investigation will not have a negative impact on another agencys investigation.
DOJ and ICE also signed an MOU regarding ICE participation in the newly-created IOC-2, which marshals the resources and information of nine U.S. law enforcement agencies, as well as federal prosecutors, to collectively combat the threats posed by international criminal organizations to domestic safety and security. It allows partner agencies to join together in a task force setting, combine data and produce actionable leads for investigators and prosecutors working nationwide to combat international organized crime, and to coordinate the resulting multi-jurisdictional investigations and prosecutions. ICEs new membership in IOC-2 will allow all the partner agencies to draw on data that now ICE will provide, while allowing ICE to work investigations with other agencies that may be targeting the same syndicates.
These latest MOUs follow closely on the heels of two additional agreements DEA and ATF, respectively, signed recently with ICE. Together, these agreements show a significant level of partnership and cooperation within the federal law enforcement agencies to target major criminal organizations.
