Ted Kennedy has a date, with an income tax free state...(Established FL residency to avoid MA taxes)

I finally figured out why Ted Kennedy wants to have Governor Devoid Patrickakis appoint someone to replace him - Ted is staying in Florida. Ted has been in Florida since he collapsed at an Obama inauguration dinner many months ago. Like his dear mother Rose, Teddy wants to establish Florida as his primary residence in order to avoid those massive estate taxes and dreaded Massachusetts income taxes.

This is important because Teddy has a new book coming out and he wants the income from that book to be declared tax free in Florida - not Taxachusetts. The same way we all marveled at the fact that Rose was simultaneously declared the oldest resident of Barnstable even though she was living in Florida.

Ted Kennedy doesn't really want to save Massachusetts from under-representation in Washington. He wants to save himself millions on estate taxes and income taxes. Isn't that the truth?

Think about it. Ted Kennedy should be living in Massachusetts where he has the options of the finest medical care in the world. After all, he is the sitting senior Senator from this state so the very least he could do is be here. But no, Ted is in Florida! There is only one reason sick people leave Massachusetts and go to Florida - TAXES!

I can't believe it took me this long to figure out Uncle Teddy's little trick.

As despicable as Teddy Kennedy was, this author doesn’t know a whole lot about estate taxes.

How come no one in Massachusetts challenged Kennedy’s credentials to be senator from that state without being a resident thereof?

Article I, Section 3, Clause 3: No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen.

The day after your election you're free to depart the state and never return. Assuming you never plan to be elected from that state again, of course.

I hope Massachusetts nails his estate good. God d@#$ statist. Trying to screw Massachusetts out of its fair share.

Federal estate taxes are due in either state. Massachusetts will want its state estate tax however.

I hope he voted for Obama in Massachusetts. Where you vote is one of the residence factors. Drivers license would be another. The irony if the Kopechne Killer never got around to changing that to Florida would be so delicious.

I think you are overlooking the blatantly obvious point.

Logically, there is no possible way for you to be a sitting US Senator in one state and have your “official” residence in another.

And to try that indicates what kind of crook you are. In Kennedy’s case, it also makes him a hypocrite of the 1st order. He is one of the biggest proponents of higher taxes and more government.

Besides the FLA tax dodge, I was wondering how Teddy is eligible to be buried at Arlington? He was never wounded in combat and only served 2 years in the Paris embassy. Does being the brother of a combat vet entitle you to be buried in Arlington?

I just quoted the Constitution. The day after your election you can change your residence forever. And logic does not apply to tax law.

And the Kennedys are exemplars of moral probity. Except to anyone with higher morals than the most immoral Mexican drug lord.

“Logically” was probably the most important word in my post.

If I knew my Senator (Sessions or Shelby) had changed his official residence to another state, I would lead the charge for a recall election and removal from the senate.

If you are not willing to officially live in the state you are representing as United States Senator, then you have lost all moral standing to represent.

But, like I said, that is LOGICALLY. Since when does logic apply to politicians?

Kennedy is eligible for burial at Arlington by virtue of his service in Congress and his two years in the Army, 1951 to 1953. He was a private first class and served in the military police at Supreme Headquarters Allied Powers Europe, then located in Paris and now in Belgium.
