Open Carry Issue Heats Up in Racine(WI)

RACINE - Normally inside Mechanix Auto Shop, repair is done on cars.

Saturday, it was done on a man's reputation.

Hubert Hoffman, a member of www.opencarry.org, organized a gathering to support Frank Hannan-Rock.

Most everyone there was openly carrying a firearm, which is legal in Wisconsin.

"You stand by your friends," Hoffman said. "Frank was, in my opinion harassed and detained unlawfully."

It all started Wednesday night when Racine Police were investigating a raccoon shooting in Hannan-Rock's neighborhood.

They noticed he was wearing a gun on his hip and asked him questions.

"I did nothing to provoke them," said Hannan-Rock.

His friends agree.

"They fixated on the fact that Frank had a gun and after that it was who was the biggest dog on the block," said Hoffman.

But police claim Hannan-Rock refused to give officers any information when they asked about the shooting, not his name or where he lived. So they arrested him for obstructing an officer.

"It kind of makes us wonder if this gentleman was trying to set us up as a police agency to see how we were going to react to the open carry situation," said Sergeant Bernie Kupper.

That's because police traced the 911 phone call back to Hannan-Rock's home. But his wife denies a set up.

"People upstairs called about the raccoon. It may have stemmed from our house but we have two separate phone lines," said Lee Hannan-Rock.

Hannon-Rock wouldn't talk to TODAY'S TMJ4-HD on camera at the gathering Saturday but his wife claims it's been tough for him since the arrest.

"He's not as calm as what he used to be," she said.

And that has his friends fired up, coming together for a guy who now is looking for an attorney. So far he hasn't found one but he says he'll fight the obstruction ticket.

Hannon-Rock's first court appearance on the obstruction charge is in October.

A very biased article. There is no mention that Lee was sitting on his porch when the police approached him. There is no law in Wisconsin requiring that you identify yourself. Not talking to an officer is in no way obstructng an officer.

The fifth amendment provides a measure to avoid self-incrimination in the courts. Furthermore, Miranda-rights state you have the right to remain silent (in regard to your arrest).

Using a Firearm during the Commission of a Felony

The local Grand Jury is looking into this Criminal Activity perpetrated by this Government Agent right??

Absolutely right. The link below is a law professor discussing the 5th amendment and he says not to talk to police investigators, ever.

It is an entertaining and informative video. Later an experienced policeman confirms what the lawyer says.

Absolutely right. The link below is a law professor discussing the 5th amendment and he says not to talk to police investigators, ever.

It is an entertaining and informative video. Later an experienced policeman confirms what the lawyer says.

Hopefully an honest lawyer will step up and take this on the condition when he sues for false arrest he gets a good share.
And maybe this RACINE police dept will be taught their states laws.
But I wouldn’t count on it.

Open carriers normally don't conceal, even in states where CCW licenses are freely available. Concealing a firearm is viewed as a dishonest and cowardly act, and not what an honest law abiding citizen should do. We are exercising our rights and don't having them moderated to appease hoplophobes and other irrational people.

Open carry serves to desensitize the sheep to the presence of firearms and it is working. States like PA have come a long way to where open carry is normal in many areas and no longer causes you to be surrounded by police and held at gunpoint. When such abuses do happen lawsuits are expected and usually victorious.

It’s early Canada Goose season by me. I’ve been ‘openly carrying’ my shotgun around my farm morning and evening for the past ten days, LOL! Jay Dubya got one tonight; I haven’t been quick enough on the draw. Yet. ;)
