Nadler: Cutting Off Federal Funds to ACORN ‘Flatly Unconstitutional’ (HUH????????????)
pubrecord.org ^ | 9/18/2009 | Staff

Posted on 09/18/2009 7:38:50 AM PDT by Red in Blue PA

Congressman Jerrold Nadler, D-NY, denounced a Republican amendment adopted by the House of Representatives Thursday to deny all federal funds to the advocacy group the Association of Community Organizations for Reform Now (ACORN) as blatantly unconstitutional and a threat to unpopular organizations everywhere.

Nadler said the Republican initiative, the Defund ACORN Act, introduced by Rep. Darrell Issa, R-CA, singles out a specific organization by name for exclusion from participating in any federal program, in direct violation of the Constitution’s prohibition against Bills of Attainder. The amendment was attached to a student loan bill.

I did not know ACORN funding was in the Constitution.

As a matter of fact I don’t think the Constitution makes it okay to take peoples’ tax dollars and give it to other people.

Cutting off a criminal enterprise is the intelligent thing to do.

A bill of attainder is an act of the legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial.

Congress is NOT declaring anyone a CRIMINAL, they are cutting off funds to a GROUP.

Damn...
Talk about REACHING.
You can expect more of the Dems who have NO HOPE of getting reelected without ACORn to start whining soon.

OK, Congressman Nadler, please show me where it says in the Constitution that even legitimate, honest, community organizations have constitutional right to funding (much less corrupt, criminal orginzations, which promote and enable prostitution, tax evasion, money laundering, illegal immigration and the trafficking of child sex slaves).

Bull Crap. Companies are banned from Federal contracts every day. No difference here.

Actually, there is a big difference in that the companies are entitled to administrative due process before they are banned from competing for government contracts.

Nadler claimed it was a Bill of Attainder.

A bill of attainder (also known as an act or writ of attainder) is an act of the legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial.

Deciding that someone you WERE giving money to is no longer going to get money is NOT declaring them guilty of a crime.

So while Nadler the Hutt DID cite a particular section of the Constitution, his opinion is worth what does come out of his ample rear.
