In perusing a number of web sites and commentary on the Rhodes case and the latest results, I find that the comments generally fall into two groups —
*** 1 - the judge is terrible and the ruling is an injustice.
*** 2 - the judge is correct in properly smacking down Orly.
I suggest that there is a third possibility that exists that no one seems to have publicly mentioned — that Judge Land is brilliant by handing down a deliberately inflammatory ruling bordering on judicial misconduct thereby inviting Rule 11 discovery.
Just think about it for a minute.
If Judge Land had granted the TRO, the case might have dragged on for months before getting to the discovery phase. On the other hand, the judge could have dispassionately denied the TRO by narrowly interpreting the law in favor of the defendants and Cpt Rhodes would have deployed to Iraq, making further motions moot.
By ruling as he did, as though he was having a judicial melt-down, it seems he has practically handed you an engraved invitation to submit a motion for Rule 11 discovery. Did he do this deliberately in the hope that you would take this route? We’ll never know. Even if this case blows up in Obama’s face, Judge Land’s thought processes may remain forever hidden (unless he has his memoirs published after he retires or dies). The point is that you now have, in this case, the best possibility to go for discovery - perhaps even better than in the case pending before Judge Carter. Craft your arguments carefully - Obama’s defense team may come to really hate Judge Land for his seeming melt-down.
Another thought - there was an earlier case in which the judge dismissed plaintiff’s motion and referred to blogs, the internet, twittering, etc. in his ruling. Made quite a splash when the ruling was handed down. I believe the case is still out on appeal - may have tried for rule 11 discovery based on judge’s conduct. Something else you may want to look into after you’ve responded to defendant’s motion before Judge Carter.
Everything seems to be coming together. The next few weeks may just turn out to be the most important in our Republic’s history. Our prayers are with you.

Didn’t the plaintiff before Land personally write to Land that he was bugging out of the case? That leaves Orly with nothing w/r/t Land.
Brilliant or stupid. Either way, by moving Orly from plaintiff to defendant, he just might be blowing this whole thing wide open. Now, as the one in jeopardy, she gets a whole new set of rights and privileges.

I said this Sat night. The judge may actuall be a good guy. Someone mentioned Land backed off on the penalty and sanctions against Orly. Does anyone know if i is true?
If she can go down that path she need the help of a competent attorney. She may be given two huge gifts in Land’s sanctions and getting a caese in front of Judge Carter.
I hope Judge Carter understands Marines are dyding because of the Islamist’s rules of engagement in Afghnaistan.
It’s my sincere hope that she hires a good attorney. She needs one. They say “only an idiot serves as their own attorney”. I am suspecting she will decide to be her own attorney, thus confirming both the wisdom of the old chestnut and my opinion of her.

There is some debate about the veracity of that rumor ( that Orly acted w/out client approval)
There appears to be some evidence the so-called ‘fax’ sent by Captain Rhodes (that Orly acted w/out her consent) was faked.
Russians and/or Chechens or people of the region are stubborn, usually know-it-alls who think they are smarter than anyone else because they usually are.
If she does not start working with competent attroneys in this case and the Judge Carter case then she is a plant by you know who. She has a gift with both of these cases.
If he backs off, then she wouldn’t have cause for Rule 11 discovery, or whatever, would she?

I’m not sure that anyone would take his career and reputation in his hands and do something like this, but who knows?
Whether deliberate or not, it does seem to me to open the way for Orly to appeal or to demand discovery, as I’ve also been saying. Attacking her is dangerous for them. But not fighting back is also dangerous, since she just keeps going and going.
It’s a pretty interesting world we live in these days. Absolutely every thing going on has to be viewed with a very high level of suspicion. Plant someone in the role of attorney who will blow the case on purpose, all the while looking like they’re working very hard to win. What was that great movie set in Florida where an attorney was chosen because he had flubbed a case and was hired by a lady, Sharon Stone?, who wanted him to help her kill her husband. All I can think of is “In the Heat of the Night” but that’s not it. An aging brain can be a real pain sometimes!
Anyway, it’s interesting how the you could have an attorney intent on doing the a bad job and a judge intent on giving that attorney a true gift!

It was a great movie. I loved the ending. I might even watch it again. Even though I know how it ends.
There's another movie I saw years ago and would love to see again but can't remember the name or the stars, just sort of the plot. This guy is in love with a very gorgeous young lady in college. He's a music major. They separate after graduation and he goes on to become a talented write of jingles and then advertising scores. He is contacted by Hollywood and offered a chance to write the music for a new movie. In the process he realizes he still pines for the girl from college and she lives in Hollywood. He contacts her to see if he can get her back. Great movie. She was really fine in the college scenes. Maybe someone here will remember the movie. In one part he writes a score for an airline commercial and then ends up using it for a variety of things.
Thanks a million for the Body Heat info! Yes, it did have some very steamy scenes of Florida. I was raised down in that area in the mid-50’s.

Would be nice, but I believe the corrupt judge is simply “following orders” to get rid of the case. I wished I agreed that he did this intentionally. On Orly’s site, her reply is quite crude (I think she implied that the judge is taking an order to dismiss the case from the Commander in Chief himself, if I read it correctly). Either way, I hope her reply isn’t TOO disrespectful, although her denial was quite insulting !
As far as I know, she hasn’t even invoked Rule 11 for discovery which is by far, the BEST rebuttal !
