A judge in Dallas ruled on Thursday that the state court on which she sits has the jurisdiction to hear a divorce suit by a gay couple who were married outside Texas where same-sex marriages are banned.
Dallas District Judge Tena Callahan said in the ruling that her court "has jurisdiction to hear a suit for divorce filed by persons legally married in another jurisdiction and who meet the residency and other prerequisites required to file for divorce in Dallas County, Texas."

I wonder if the loser will challenge the result based upon the gay marriage ban. This should be interesting.

It sounds to me as though Tena Callahan’s elevator might not go all the way to the top.
This is why defense of marriage needs to be a federal issue not a state rights issue. The states are only as strong as the weakest state on an issue like this.

The Judiciary of the United States is one of three equal constitutional legs of our federal government and is tasked directly with strictly interpreting law, not making it or enforcing it, either through activism or otherwise.
Each leg of our federal government is equal in power and in their duty to protect and defend the constitution. The Legislature makes laws, the Executive carries out and enforces law, and the Judiciary interprets the law strictly according to the intent of the constitution. Anything more than this, any attempt to use judicial activism to create laws, or to define the constitution as a "living" document outside of the amendment process, is unconstitutional and a usurpation of power that must not ever be tolerated or allowed. It is the fundamental duty of the other branches of government to stand against such usurpation, and not enforce it, and enact laws that will prevent it.
Liberal logic:
-They do not want the government “in the bedroom, in people’s private lives” on the issue of abortion, yet...
-They want the government to legitimize what happens in the bedroom with respect to sodomy.

Personally I think it’s hilarious these people demanding marriage rights...when it includes divorce...
Some poor schmuck marries some rich schmuck and he gets taken for his money. And these folks hop around relationships like crazy so I can’t wait to see the divorce rate in a few years and hear them crying about how they got taken in divorce court. Gonna be interesting.
I suppose the state can appeal it, it can end up with the Supremes, and the inanity of having same sex couples pretend to be married in some states but not the others will be addressed.
Isn’t she abusing the law or more to the point breaking it? Since when does she get to decide what the law is by personal agenda or opinion?
I think a good case could be made to get rid of this judge.

This “judge” is completely devoid of any concept of law. But, when you’re elected, I guess that doesn’t matter.
If that doesn't happen, I wouldn't care of a mob came and threw her out. It's PAST time judges were stopped from destroying the whole structure of representative republic.

Evidently this judge is of the opinion that 9 justices in DC know what's better for Texans than Texans do.
