Court Halts Ohio Execution After Flawed Attempt

A federal appeals court Monday halted the execution of an inmate three weeks after problems with a lethal-injection attempt.

A panel of the 6th U.S. Circuit Court of Appeals in Cincinnati ruled 2-1 to grant the request of 43-year-old Lawrence Reynolds Jr., who had been sentenced to die for strangling his 67-year-old neighbor during a 1994 robbery.

On Sept. 15, Gov. Ted Strickland stopped the lethal injection of Romell Broom after state executioners struggled for two hours to find a usable vein.

Mr. Broom's execution is on hold while his attorneys prepare for a Nov. 30 federal-court hearing. They argue that an unprecedented second execution attempt on Mr. Broom violates a constitutional ban on cruel and unusual punishment.

*** Judge Jeffrey Sutton dissented, arguing that the state's policy addresses a scenario where repeated attempts to find a vein are unusable.

"Why assume an execution protocol is unconstitutional when one of the humane features of the protocol -- that the State will not continue trying to access a usable vein beyond a sensible time limit -- is being followed?" Judge Sutton wrote.

Mr. Strickland's decision to stop Mr. Broom's execution appears to be unprecedented since capital punishment was declared constitutional and the nation resumed executions in the 1970s. Inmates in several states have experienced delays with the injection of lethal chemicals, but those executions always proceeded the same day.

Why is this so hard? States should just dispense with this injection nonsense and put a bullet in his head, which was certainly constitutional as far as the US constitutional framers were concerned.

In the event the executioners can’t find a vein, maybe the family members of the victim could step up and use a baseball bat. Three or four really good whacks on the head will do the trick.

COnsidering what methods of execution were common place when the Constitution was written and signed, all this nonsense over the unconstitutionality of this type or that type of execution is B$. Framers didn’t have lethal injections or electric chairs. They simply hung you from a tree or a gallows if you were lucky or they just shot you.

THANK you! I read the headline and said aloud, “Just SHOOT ‘im!” Or, if you prefer, a nice double-tap to the back of the head.

But, I guess that is messier to clean up than simply rolling the body out on a gurney.

It seems to me that by now we would
have some way to hang, electrocute,
and gas them all at the same time.

Also, the administration of pure LSD
to the accused should proceed the practice,
with all the execution personnel wearing
life like silicon masks of the victim.

I prefer the TNT igloo version of an execution. Since the shock wave from TNT travels faster than a nerve impulse there is no pain. Take the guy out to the desert, surround him with a spherical shell made from TNT, get a safe distance away and push the plunger. Since you implode the perp the dude is all but completely vaporized. If you don't want to clean up the bits of hamburger that might remain just put some Napalm under his chair.

To take that long is downright stupid and had to be on purpose....I could do better than that and I am only a retired nurse...they should get a vet to inject....they always get the vein of a cat or dog on the first try...

Sell it on Pay-per-View to recoup some of the costs. Can also be used to dispose of all that old ordinance that the military has laying around. Think of firing squad using one the 16” rifles from an Iowa class battleship. Just bulldoze in the crater after the smoke clears.

This lethal injection farce is just what the bleeding hearts want . . . something that they can delay executions of human scum with. The firing squads, electric chairs, and hang-man nooses killed the scum to easily. Gotta’ have these intricacies with these punks being unable to get a needle into their veins.

This monster has been on death row for 25 years. He either is guilty or not. If he’s guilty, shoot him. Disgusting that he can survive at our expense for 25 years on a qualified jury’s decision. Outrageous!

Does that work in reverse (drink lots of water 24 hrs before)? I ask because nurses always have a tough time finding a vein in my step-dads arm, not that he's gonna be executed.

I would think the often protracted time to set up a lethal injection procedure is in many ways cruel. Britain’s master hangman, Albert Pierrepoint, was said to be able to walk into the room, manacle the condemned, apply the hood and noose and spring the trap in less than a minute.

Yes, I’ve been told by nurses to be sure and be hydrated for vein poking. A test I’ve also been told: on the back of the hand in the “webbing” between thumb and forefinger, pinch some skin and pull up. The rate at which it flattens down upon letting go is a hydration indicator. You may want to try this with varying amounts of previous water intake to judge your own hydration reaction time.

Properly done, long drop hanging may be the quickest and least painful method of execution.

From what I’ve read they tried to find a vein for 2 hours. He flexed his arms, helped with the tubing, and was very cooperative. The Prison Director even gave him a thank you for how far he went in trying to help them out.

I’m against the death penalty in general, but this is embarrasing. This guy just wants to die with some dignity and we can’t even do that right.

Indeed, although a bullet in the head in, or should be, foolproof.

Unfortunately, or not, doing it,long-drop hanging, properly requires a competence that is often lacking. Probably because executions are too rare.
