ACTION FOLLOWS MINUTE ORDER FINALIZING DATES, DISAGREEMENT WITH DEFENSE ON PROCEEDING IN DISCOVERY by John Charlton

(Oct. 7, 2007) — At approximately 2:30 PM this afternoon, Eastern Time, The Post & Email learned that Judge Carter had ordered the dates finalized in the case Captain Pamela Barnett et al. vs. Obama et al..

The finalizing of the dates for the trial is normal procedure when the Court has decided a trial will be held; thus, the order contained in the Minute Order is clear indication that either the Motion to Dismiss will be in part or wholly denied, or that Judge David O. Carter has decided to reserve judgment on the Motion to Dismiss until after the jury verdict in the trial — which is done in some cases.

In response to the exchange between Plaintiff’s counsel and Defense Counsel on the Minute Order and its significance, Dr. Orly Taitz, esq. has just filed, minutes ago, a Motion for Relief from the Stay for Discovery.

Forceful Exchange between Plaintiffs and Defense, earlier today The reason for filing is explained in the accompanying exhibits, which detail the conversation between parties moments after the Minute Order was published. First Mr. Charles E. Lincoln III, on behalf of Dr. Orly Taitz, communicated the following to the Defense’s counsels:

Yes. And Orly is trying to get the stay lifted so she can start discovery. What will probably result is a quicker Order of Dismissal by Judge Carter.

She is asking that the “stay of discovery” currently in place pending trial be “relieved”, ie lifted, now that it appears the judge has confirmed the scheduled dates.

In other words sounds like Taitz’ law clerk et al want to get a jump on discovery—but if you read the first item, you will see there were fireworks between Taitz and Obama’s attys on the point today ( a “forceful exchange”)...about the significance of this confirmation of dates.

Orly misinterpreted a normal routine, impartial, clerical entry as the judge decision. She fired off an email to the opposing lawyers asking them to start discovery per the judges decision. *There was no decision*. It was a routine entry.

The opposing lawyers, after picking themselves up off the floor from their fit of laughter, responded, "Nuts".

STILL not getting it, Orly fired back another email complaining about their response. To which they had to explain that Judge Carter's stay order was still in effect.

If the judge had decided the trial was officially on, why would they need to file a motion for discovery? Wouldn’t discovery automatically be back on if the trial was officially on?

With the elapsed time, the Court would probably set a new scheduling order. All Orly is going to do is light an even bigger fire under Carter to bump this stinkaroo out of his courtroom sooner rather than later.

This was likely the point when DOJ lawyers confirmed their suspicions that they are dealing with rank amateurs who have no understanding whatsoever of the judicial process.

I swear, with each passing day this is looking more and more like a Coen Brothers' film.

No, LucyT. I wish for once the bloggers had gotten it right the first time, but they were deceptive in what they posted early on.
They only posted the part I pinged you to that affirmed the order. They did NOT post that it was part of the General Minutes.
Judge Carter stated in the courtroom on Oct. 5 that the dates would be affirmed. All this is is the Clerk’s confirmation of what Carter had already declared.
The moment of truth will be on December 7 when the Court rules in the Summary Judgement filing.
IF he does not dismiss the case then, and rules the case can move forward, the NEXT date is to hear an appeal if one is filed.
IF he does NOT dismiss on Dec 7, break out the fireworks. THEN it will be time to celebrate. But not now.
And to tell you the truth, I resent what these bloggers, including Taitz and Keyes, are doing.
Every time they jump the gun like this with less than honest or factual analysis, here we are, crashing and burning. It is abuse, and I don’t like it one damn bit.

One of my secret sources has a copy of Orly’s latest Motion, one not even on pacer yet:

Motion for Overturnation of FRCPs

Cometh now, Dr. Orly Taitz, pro se, on behalf her clients, in the above stiled matter and Motions This Ex-Marine’s Court for an Overturnation Order related to the Federial Rools of Civil Procedure.

As noted in the common and Blacks Law Dictionary definition, the word “civil” means polite and nice and orderly. But the Defendants have not been polite and have, in fact, been “uncivil” to Plaintiff and its attorney, who is also a medical professional, and knows all about mouthiness.

If the Attorneys for the Defendants are not “civil”, then civil rools should not have to be followed by the Plaintiff either, pursuant to the U.S. Constitution, rights of due process, and fairness as set forth by other lawyers in history.

If the “civil” rools are not applicable, then this Court’s Order of Stay of Discovery, should be subject to Overturnation because Rool Number 26 is how come we even have scheduling orders because I looked it up and it is one of the “civil” rools, so therefore the Defendants have dirty hands and the Plaintiff should be able to dirty her hands, too.

What’s your take on this ? Is Orly jumping the gun ?

Seems like these date confirmations were from 10/5 (as BP2 confirmed), so isn’t the assumption that this means MTD will be denied a bit pre-mature ?

Actually, Orly may be setting legal precedent with this Motion. Usually, “un-clean hands” is an “equitable” claim or defense. Orly, is turning a shield into a sword, legally speaking, and this is the first time an attorney has thought of equity in this manner, i.e., implying the right to get down and dirty.

Not really. If you're the lawyer for the plaintiffs, or you are one of the plaintiffs, you would want to move the case forward and that means discovery. You may recall, Judge Carter has said to the parties that they should cooperate and both seek discovery. But we all know that Obama and his attorneys will fight it all the way and it was unrealistic to expect the defense to cooperate, hence the push for the hold on discovery to be removed.

Who are the good guys? I ask because I usually stay away from the birther threads and try and wait to see how it shakes out. This is a serious drama with many intervals.
