ORANGE COUNTY, Fla. -- An Orange County man caught two burglars breaking into his house, so he pulled out his gun and shot them both Tuesday night. One of the burglars was killed and the other is in critical condition.
The deceased burglar was identified as 17-year-old Brandon Martinez.
Deputies say the owner of the house on Rubens Court (see map) won't be arrested. They say he did nothing wrong.
The homeowner, along with his brother and son, had just gotten home from work when he confronted the burglars Tuesday night. They had already ransacked his house and even tried to get into a safe. Anthony Julien, 50, insists he had no choice but to take action.
The way I look at it is like they invade my privacy and I was scared when I come in, so I defended, you know, my property, he said.
Julien took Eyewitness News step-by-step on what happened when he confronted the two burglars in his house....

Good shoot!
You take your chances here in Florida if you do wrong!
What a heartwarming, happy ending to a great story!
man takes a bite out of crime!!!
>> The way I look at it is like they invade my privacy and I was scared when I come in, so I defended, you know, my property, he said.
Word to the wise: You cannot take someone’s life for messing with one’s toys.
YOU CAN, however, if in fear of loss of your life or limb, defend yourself using up to and including deadly force.
I'm shocked the reporter actually got this right
Depends what state you’re in. Some states recognize that people have a right to protect their property, as well as “life and limb”.
“I was scared because this one had a gun in his hand,” he said. “This other one had a gun and might do the same.”
Officials said 17-year-old Brandon Martinez died in the home. They said he has no criminal record. Investigators said Jonathan Rodriguez, 26, was found with a gunshot wound a few streets over and was rushed to the hospital where he is in critical condition.

Agreed it’s a great ending. However, in this world the parents of the 17 year old “honor student” will make the victim’s life miserable for years to come with lawsuits. I just hope this state is one where the loser in court has to pay all the legal fees.
There's probably some lawyer consulting with the dead guys family to put some civil suit together that will require the homeowner to spend a lot of money defending himself.
I'm quite sure that you can kill in defense of your toys if you are in Texas. Should be in all 57 states, but at least there is one sane state.
I love a happy ending.
And that's when we lost this country...used to be a time you could shoot someone who was trying to take your property.
I believe in FL the burglar’s family cannot sue civil if the shooting is ruled justified.
One of them is still alive......
Please take the time to read the Report, by following the link, Before Making snap judgements.
Reporters Don’t always get it right. In fact most of the time the initial report is Biased because they intentionally leave out pertinent facts.
This Shooting was Totally Justifiable.
I come in. I look to my left, one this way, one here. I had my gun like this and he was there, so I come in like that. When I come in, he run this way and he point his gun at me, then I go down and I ‘pow,’”
Any Questions?
I always wondered who is responsible for cleaning up the mess in these situations. Do the police send in a clean up crew, does the perp (if he survives) or the perp’s family / estate have to pay for it?
A happy ending, but would be even happier if both criminals were dead.
We simply have to do something about all the 18 yr. old burglars running around these days.
That’s 2 more who won’t bother me!
I believe that is one of the provisions in the “Stand Your Ground” law. The person protecting himself or others is, in turn, protected from any lawsuits against him, for his legal actions.
The NRA may help him with legal expenses in that regard, and if a fund is set up for him,he’ll do ok. I’d donate.
I believe there are specialized crime scene cleaning services for this job. The homeowner's insurance would cover the cost, I imagine. Who knows what sort of pathogens are in the blood, etc. so you would want a cleaning crew that knows how to deal with bio-hazard material.
Jack
Sounds clear-cut to me. Good going Mr.Homeowner!
Ah a story with a happy ending, careful, don’t try this in California..
” I thought I saw a gun and feared for my safety and my families safety”.
Just stick to that story.
his last login was today? The police logged in?
2005 - Thank you Jeb Bush!
Ft. Lauderdale here.
Buy that man a beer!
We're buying ammo as fast as it can be made. Whaddaya want?
Good point, you have to let the barrels cool too.
Ohhh, alright. I’ll buy another gun then too. ;^)
You leave the blood stained mess, put a sign on it with an arrow, showing the next burglar what happen to the last one.
I think the homeowner is the one who must clean up.
However, you better make sure they are IN your home and not outside, or if they are outside they had better be armed and either getting ready to shoot you or are shooting.
In most states the state's victim's compensation fund will pay for clean up.
>> This Shooting was Totally Justifiable. A: Of course it was - ref. Florida Statutes 776.012/.013/.032 et. al.
>> Any Questions? Yes - Why do you (and too many others here) insist on encouraging Freepers (who live in every state in the Union, with widely varying laws) to be satisfied with the anecdotal "If those bastiges come in my house they're dead!" knowledge of the law?
Freepers, you MUST know the laws of your state, and the (usually differing) laws of every state in which you could ever use a gun. Go to handgunlaw.us for a start, then to your state's statutes.
One goblin DRT and one goblin maybe.
1.75 out of 2, pretty good shooting.
No matter how you feel about this unfortunate turn of events, Mr. Julien, you did the best thing in a bad situation.
In your Post you Allege that it was only an Issue of Property.
>> The way I look at it is like they invade my privacy and I was scared when I come in, so I defended, you know, my property, he said.
>>”Word to the wise: You cannot take someones life for messing with ones toys.
YOU CAN, however, if in fear of loss of your life or limb, defend yourself using up to and including deadly force.”
Because You only Quoted the line concerning Property.
That was Not the Case. So, Why Flog everyone about Property.
You did not go to the Link and use the appropriate Quote that reflected the facts.
So, It looks like you have some particular Axe to grind.
Why, do you own a Firearms Training School?
Yes, it is incumbent upon all who use weapons to know the Law in their State or Municipality.
Other than Chicago or New York, Where is it Not OK to defend yourself against an Armed Intruder?
Not too many places.
if ya dont like it, dont steal...
A casual FR reader seeing only “I defended ... my property. and not following the link might assume that “defense of property = OK to kill”, which is a very dangerous assumption.
“You did not go to the Link [sic] and use the appropriate Quote [sic] that reflected the facts.” So, you have a keystroke monitor on my computer?
“Axe to grind [?]” Yes. All too much concealed firearms “training” is nothing more than macho BS. The low end of what passes for “training” in Florida is a 40minute to two hour session of war stories followed by ONE .22 round fired (often into a sand barrel). Discussion of deadly force laws are slim; usually none. Caveat emptor. (And, no, I don’t train concealed carry in Florida).
“defend ... against an Armed [sic] Intruder [sic]? Depends on what you say afterwards - and it better include something along the line of “I was in fear of loosing my life. I thought I’d be killed.”
Where I live there is a whole range of training levels that meet the requirement for a CCW permit.
You feel that the Training required in Florida is inadequate. Have you signed up for advanced training?
Or are you uncomfortable with the people around you having CCW permits with the minimal requirement?
Some people feel that No level of training is adequate and want to disarm all Citizens.
A study has shown that CCW holders actually have a better Hit ratio than Police officers.
A few years ago in Portland Oregon Officers Fired 27 rounds at a fleeing Felon near a MAX light rail station and only hit him three times.
All those Projectiles had to go somewhere, certainly putting citizens at risk.
It can be inferred that either you followed the link and chose to use the “Property” quote instead of the “Threat” quote or you did not follow the link because the “Property” quote matched your world view and you were not interested in the actual facts.
More complete Facts of the Story can only be found by following the link.
Casual consumers of “News” may never know the Truth.
If they wait around long enough it may eventually come to light.
But, perhaps not.
Do we want to perpetuate this kind of Laziness?
If we want to make good decisions it is our responsibility to search out the facts.
Otherwise no one needs to read Blogs and the MSM is enough.
...as it should be
not in Florida!
The law deies such lawsuits in a justifiable self-defence use of deadly force.
The perp’s family doesn’t even get a “lovely parting gift” like DEAD DUMBA$$; THE BOARD GAME
Burglary is merely the act of unauthorized entry, normally with the intent to commit theft or another crime. The fact that the house had been ransacked indicates they had been succesful in the “burglary” aspect of the crime. They got a big “no go” and epic fail in the exfiltration phase of the exercise, however.
in FL, deadly force is considered justifiable if one feels they in “imminent danger of severe bodily injury or death”
...even if one is out side of one’s home.
...one has no duty to attempt to retreat (stand your ground law)
...if the perp is armed with just a baseball bat, or a tire iron, or a knife, or a can of gasoline and lighter, that would be grounds enought to be in such imminent danger
Excellent post.
Know the laws!
Oh yes you can: God Bless Texas!
And Florida too, I guess, by default.
epic fail was the reason for my “would-be” mod.
...ok...next time i’ll dict.com the terms....sheeesh...tought crowd
LOL...I just wanted to make sure the perps weren’t portrayed as complete failures...in fact for the one that assumed room temperature, the “burglary” was the last thing he ever succeeded at.
