Schroeppel, NY -- The man who was shot and killed during an apparent burglary Saturday at a Schroeppel home has been tentatively identified.
Oswego County Sheriff's officials said Timothy Hartigan, 39, was killed after Deanna Candee, 48, and her son, Adam Candee, 25, came home to their residence at 211 Hilltop Drive to find an intruder.
A violent struggle ensued during which Deanna Candee got her pistol and shot Hartigan once, sheriff's officials said.
Hartigan, who has no known permanent address, was pronounced dead at the scene, sheriff's officials said.

NY has a “duty to retreat” law. Meaning if you can get away, you must. Lethal force is almost never justified to the Sullivan Law.

Considering that she went to Crouse for her injuries, they're probably safe in that regards.
I doubt any jury of her peers in that area would convict them.

I guy I grew up with went to Thomas Alva Edison Vocational High School in Jamaica, New York, part of Queens, which is part of NYC. NYC had vocational schools for every profession, from baker to mechanic. (Like Brooklyn Tech (engineering), Bronx HS of Science, Performing Arts (movie Fame) to Styventant (smart kids), Printing Arts, Automotive ...) Anyway, Edison was for aspiring electricians and at that time (1964-68) was all male.
When a pretty little substitute teacher showed up some guy would always sign the attendance sheet Dick Hertz. And when the inevitable question arose, “Who’s Dick Hertz?” the inevitable reply would echo, “Mine does!”
I like the adjective “abject”, conveys the correct sense.

This does not apply to invasions of your home. Deadly force is permitted in that case.

I left for Syracuse as soon as I could, then left Syracuse as soon as I could. The whole area is so depressed now that it is like a war zone after the battles have ended.
Empty buildings and businesses are on every corner. the streets are full of potholes, and the number of foreclosed homes is unimaginable. POS cars outnumber late model 10 to 1.
Long in the rear view mirror and getting smaller by the day.
I live in NY (Not NYC) and burglers are shot not infrequently. Nobody gets prosecuted in these cases.

Living in Fulton is like living and episode of COPS. When I hear people say that they think that show is made up, I tell them otherwise.
My kids and I watch it when we can, and LAUGH, and are so grateful to be out of that hellhole.
In this case, the police could prosecute her if they chose to. By law, she has a duty to retreat. Deanna elected to retrieve her pistol and shot the intruder. She could have left the house, called 911 and waited for the police to arrive.
Don't get me wrong....I think "duty to retreat" is BS and I would have shot him too. I grew up in Oswego County not far from where this incident occurred. The house in question is just off NY-481 as it crosses the Oneida River. Two houses almost a mile from the cross street next to the expressway.

Again, I think that the LEOs in Oswego County would rather give this lady a medal, and are likely glad to have one less deadbeat to monitor.

I see this differntly.

I see her “duty” here is to defend the life of her son who, it sounds as if, was the one in the struggle.
By what was published in the report Deanna Candee “retrieved her pistol”...which indicated that it was not on her person at the time the “violent struggle”. A conscious act. Under NYS law she has has a “duty to retreat” and she actively sought out her pistol and engaged the perp. To your point that it may have been the son who was in the struggle...the article doesn’t say that. It could easily be inferred that he was.
I don’t like the “duty to retreat” law in NY. I have to live under it. I’m a firm believer in the castle doctrine. If you’re inside my house without my permission, I reserve the right to shoot you as many times as I deem appropriate.
I was pointing out that I was surprised that she wasn’t charged based on the “duty to retreat”. Which it looks as though she and her son could have done prior to physically expurgating this individual from their residence.
