'Going Rogue' spoof: 'Nightmare'stories may have Sarah Palin seeing 'Rouge'

In the case of Sarah Palin's new book, imitation may not be the sincerest form of flattery.

When the failed vice presidential candidate's memoir hits shelves Nov. 17, it will have some competition from a lookalike tome that spoofs the title of her book.

"Going Rouge: An American Nightmare" bears a striking resemblance to Palin's book, "Going Rogue: An American Life." Both feature the photogenic politician in red, but the spoof has her against a backdrop of black thunder clouds and lightning, instead of the image of a blue sky scattered with clouds on the ex-governor’s book.

“Going Rouge” isn't a spoof at all but a collection of essays about Palin put together by Richard Kim and Betsy Reed, editors at liberal-leaning weekly The Nation, Entertainment Weekly reported. It includes work by regular Nation contributors, including Katha Pollitt, Katrina vanden Heuvel and Naomi Klein.

The book's publisher, OR Books, which was started by industry veterans John Oakes and Colin Robinson, said it "embraces progressive change in politics, culture and the way we do business."

these people are pure evil and Sarah knows it. What a challenge she has been given with these hand maidens of the evil one. It always cements how close to God Sarah is when it sets off the machinations such as these amongst these people. Talk about terrified of her. They are absolutely consumed with fear. God bless her.

Oh I see it's Rouge not Rogue. Still I think they may be able to sue as everything about the book is parallel except the name and sky.

Reduse, reuse, recycle. Then again, that's not very green of them to reprint this collection that few bothered to read in the first place!

I look forward to the followup article where they count the book sales of these two books. Didn’t Susan Estrich do this same thing with an Ann Coulter book? How did that work out?

The smart way to deal with this:

Have Sarah’s book publisher bring a lawsuit against the other company, for deliberately copying the basic elements and layout and introducing the book at the same time as theirs to confuse and take advantage of people looking for Sarah’s real book, not their spoof book.

It’s too close to the original. Plenty of case law out there. It’s a cheap chinese knock-off.

I can see somebody in a bookstore thinking they were getting Palin’s book and buying this garbage by mistake because they look so similar.

Titles of books and similar materials are not subject to copyright. What the leftists are doing is low-life, but perfectly legal.

Frankly, I’m not too worried. Let them compete head to head with Sarah Palin, who will kick their asses in sales. A book full of crap by “The Nation” authors has got to be mind-numbingly boring.

What we have here is essentially Rush Limbaugh vs. Rachel Madcow. Rush wins, Madcow loses. Sarah wins, “the Nation” loses.

Intellectual Property law can be wildly complicated. There's quite a bit of case law on the subject. It get's well into principles such as satire and parody and the fair use doctrine. They don't "copy" any of Palin's words, or pictures, but there is a striking similarity.

Even if they did, there's a special rule for Artistic Works, to include literary titles. Courts have given people great latitude in such cases where people are either satirizing, parodying or making a political commentary on other literary works, and I assume the same would apply here. The long and short of it is copyright law isn't nearly as protective of Titles and covers as it is of the book's content. In my estimation, an infringement suit would not prevail.
