Sheriff's deputy shoots dog
Pueblo Chieftain ^

November 01, 2009 03:37 pm

Sheriff detectives searching for a wanted man shot and killed a dog early Friday that belonged to a department volunteer.

Bull, a 9-year-old black labrador mix, was shot in the eye by Detective Robbe Newsom, said the dog's owner, Rick Pendleton.

Also known as Bo, the dog was mild-tempered and well liked in the neighborhood, Pendleton said, who is a volunteer member of the sheriff department's search and rescue team.

Charlene Graham, chief of the department's law enforcement bureau, said Newsom and members of the civil fugitive unit went to Pendleton's home seeking information about family relative Patrick Dudley.

The 53-year-old is wanted on a warrant for attempted homicide, Graham said.

"(Dudley) doesn't live there. He supposedly receives a Social Security check at that house," Graham said.

Two of the detectives went to the front door and Newsom went to the backyard, where he encountered Bull.

"I was talking to the two detectives - I invited them in because it was cold and windy - when one of the detectives went outside and came back in and said 'We had to put your dog down.' I said 'What do you mean you had to put my dog down?' I thought they just had to put Bull in their car but as we started to talk it began to click," Pendleton said.

The dog was shot because it reportedly charged at Newsom and wouldn't back away from the officer, Graham said.

"The dog wouldn't stop coming. It's tragic but these things do happen," Graham said.

Pendleton questioned why Newsom was in his backyard and why he didn't use pepper spray or a Taser. Graham said Newsom left his pepper spray in the car.

"Even the other cop said (Newsom) didn't have to shoot him," Pendleton said.

Pendleton said detectives first told him Bull had charged Newsom but then said the dog had only showed his teeth at the officer.

Pendleton said Bull would growl at strangers on the property, like the cable man and water delivery man, but he never bit anyone.

"The neighbors are just crushed. I have a neighbor who's a cop and he's crushed, can't believe what happened. Now my 7-year-old is afraid of cops. She thinks they come to your yard and kill your dog," Pendleton said.

Bull was known for taking rides into town with neighbors. Pendleton said Bull even saved one neighbor from being attacked by Rottweilers once.

"They just showed up to inquire about somebody and my dog died because of it," said Pendleton, adding he's lost trust in the sheriff's department.

"I'm ready to turn in my fire and rescue gear. I don't know if I want to help those guys out anymore."

A cop who is a coward is dagerous and should be fired.

That is the same kind of guy that will shoot someone “because he thought he had a gun” when he is holding his cup of coffee.

Can his butt.

Another version:

A dog was shot and killed last week when it charged at a Pueblo County sheriff's deputy was known to be aggressive toward strangers and had been the target of at least two prior shootings because of its behavior, the dog's owner told deputies.Newsom, Borders and Russell had gone to Pendleton's home to issue the warrant to Patrick Dudley, 53, after learning from the FBI that Dudley's Social Security check was being delivered to Pendleton's address on Apollo Street. While attempting to contact Dudley, Newsom was standing at the back of the home in case Dudley tried to leave through the back door.Suddenly a large black dog came running directly toward him, out from under a raised addition to the home. Newsom said the dog was growling and showing his teeth and he tried to back away from the animal, but it kept coming at him. The dog continued to run toward me, still barking in an aggressive manner," Newsom stated.Newsom said he backed about 30 feet away from the dog but when the dog failed to retreat, he pulled out his department-issue 9mm gun.As the dog got within 2 feet of him, Newsom said he fired one shot, hitting the dog in the right eye.Newsom said he then radioed Russell, who was in the home speaking to Pendleton, that he had just shot and killed the dog.Russell told Pendleton, who is a volunteer for the sheriff's department, what had happened. In earlier reports, Pendleton questioned why Newsom didn't use pepper spray or a Taser.Charlene Graham, chief of the law enforcement bureau of the department, said Newsom had pepper spray but left it in the car because it was windy and the spray would have been ineffective

Interesting. I’ve never seen such a thing. Does it cry continuously or just when you insult it?

I have owned several labs. I currently have a rather large black lab. He might bark at someone he hasn't seen before but after that he is their buddy. Labs as a breed are not aggressive. They are safe around children and adults as well.

I love animals, especially dogs and cats.

But if I am LE and an unrestrained dog is behaving in an extremely threatening manner and I cannot otherwise safely and effectively avoid its attack, I am sending that animal to doggie heaven. LE is dangerous enough, and LE should not be made to guess which dog will try to kill or mame them in a heartbeat and which is just behaving badly but not really dangerous.

I have seen some dog owners take some degree of pride or joy in seeing others cowered by their dog behaving badly. This cannot be tolerated. It's no different than someone pointing a loaded gun at you. It requires effective, defensive action.

My lab is aggressive and does bite...but only the tips of peoples’ fingers...one nip then she keeps a safe distance while doing a very impressive impersonation of a wild rabid crazed wolf. She holds nothing back in her performance. Sometimes, to make her point, she will knock over a garbage can and proceed to “kill and maim” every piece of trash that comes out while you’re watching her. So you better watch out if you know what’s good for you.

Dogs and cats are a different matter. She will tear a dog to shreds, and actually eat a cat.

I wasn't there so I can't comment on what the officer claims. What I can say is this. I have owned many labs and none of them ever displayed aggressive behavior. I won't own a dog that does. On top of that my job sometimes requires I go to private residences. I have never gone to a house who's owners had a lab and ever felt threatened.

Police officers get to shoot their guns and kill living souls from time to time. It’s in the contract. All householders should keep dogs so that when an officer comes to the door to ask about suspicious people seen in the neighborhood or to serve a subpoena he has a dog to shoot so he won’t have to shoot the householder or one of his kids./sarc off

You are right about this one.

I looked up the local paper and read a follow up story and the dog was a problem dog and he did back the cop into a corner, so to speak.

Kind of looks like an older version of our dog. Except ours is a female.

I can imagine how an overly familiar lab mix like that might be confused as aggressive. If he had put his hand out, the dog would have probably sniffed it.

Typical response from a dirtbag that has been arrested and would rather blame it on society than admit his responsiblity for breaking the law.

Of course a dog in a fenced backyard will be “unrestrained” your reasoning would allow any officer at any time to shoot and kill an innocent dog...

I keep saying it. Cops are the second most dangerous group of people in this country.
They love using their little bang bangs to kill.

By killing a dog they’re able to kill something they should not, yet suffer no consequences.

Drawing from my vast and storied career of dealing with people’s pets, I can assure you that pet owners rank right up there with the most insane. A dog attack, without a bite, is an automatic $250 fine in most urban areas, should the victim choose to bring to court. “My dog doesn’t bite,” always leads to the logical response: “Your dog has teeth, does he not?” People love their pets, I can understand that. But at the expense of the safety of a human being. That’s just an illness.

Then don’t go into fenced backyards uninvitied. My dogs don’t run loose and have free run of my backyard. No one, who is not invitied should be going into my backyard.

PERIOD! And this especially includes cops.

Then don’t go into backyards uninvitied. Besides being rude and probably illegal (trespassing), you might get attacked by a dog defending its home. This especially includes cops.

I’ve had friends in the past with black labs and they were never in a mean mood around me, but they MAY have been only because I was with the owners each time. I one of those was running at me with teeth bared, I’d do the self defense thing, too.

An aside from the article.... Why is a man only 53 years old receiving Social Security checks? That crap is just another reason why the SS System is going broke. It was not set up to give tax dollars to prior to the specified retirement ages. .....I’m NOT referring to the SS disability payments.

Why is this blog story so at odds with the one in the newspaper?

Because the animal lovers, have an agenda. Since the guy who owned the dog was also the volunteer, I would accept his statement to the police and news paper. The blog clown changed the facts and started his own story line. That is why there is a news section here and a blog section. Except we have a lot of dunderheads that don't know the difference.
