Committee Confirms: Comply With Pelosi-Care Or Go To Jail
Breitbart.com ^ | 11/06/09 | Publius

Posted on 11/06/2009 2:33:46 PM PST by MissesBush

From the House Ways and Means Republicans:

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

n response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

- – - – - – - – - –

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

- – - – - – - – - -

“Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

"According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016."

Apart from all the constitutional implications and the fundamental immorality of this legislation . . . this is a lot of money for a family to carve out of its budget.

I can assure you that I will no longer be filing my taxes in the USA if this Demographic Warfare Health Care Bill passes. It is slated to come into effect in January of 2013.

I will be paying my taxes in another country by then if this passes.

And there are millions of us who plan to do the same.

We won't be going to jail.

So, are all those illegals going to have to pay or be fined/thrown in jail?

NOT A CHANCE!!!

Only white Americans will be hit with this. And I do not like saying this. I mean since when have they done anything about identity theft? Or multiple DUI’s? The minority class gets away WITH MURDER. This is aimed at US. Period.

Basically correct, but conservative minorities will also be in the cross hairs.

The goal is to make us all criminals so they can pick and choose who to throw in jail based on political considerations. It’s marxism 101.

I am not disloyal to America. I will live elsewhere to preserve our family wealth and culture. If I have to, I will work to destroy the Obama Junta from abroad, and take back our nation.

The millions of us who will do this will then act from a position of financial strength, not looking over our shoulders here and waiting for a knock on the door from a bunch of jack booted thugs.

“They’ll have to spend billions building debtors’ prisons.”

Well, it would solve unemployment and give work to unemployed contractors and the staff who run the prisons. It would be the ultimate dream come true — total control of the people 24/7/365. Wait, let’s not give them any ideas.

Actually, you have a very good point.

“then they can jail us all, “ and then they can steal what little we do have to prop up the falling tax revenue that they are all ready experiencing, on a state and federal level.

Wipe out the middle class, pass out the freebies to their friends, and the country is destroyed. All win/win to those liars, the libs.

Ok, can anyone confirm whether this scenario is true: Let say there is a family of 4, with the father working and the wife and children not working. Since the wife and children have no income, the fine would be ZERO.

I say: In for a penny, in for a pound. They pass this, those that will be 'guilty' and imprisoned should make it worth their while (granted, the other felony has a longer jail term, but hey, if they're going to screw up your life by making you a criminal by statute.....).

If they pass this horse$hit unconstitutional law there will be millions that will not pay, hundreds of thousands that will refuse court orders or fines, and tens of thousands that shoot anyone trying to enforce illegal laws. It is unamerican and it will be a blood bath. Is this what our nation and congress have come to? Are we finally at that cross road of tyranny against freedom? This is what happens when the court system fails to uphold the constitution and lets the mob in congress run amok with no check and balance. Bring it on and let the tree of liberty be cleaned of dead branches.

YIKES!!!
$15,000 is the lowest cost meaning that there are higher costs. How could some/any family afford this? I can't. After taxes I may be able to have some left over for rent so I'll have a roof over my head... but what about FOOD?
So I'll be a walking skeleton but at least I'll have hellcare.

That all depends on what the new government would decide to honor.

I mean think about people working hard for 50 years , saving, raising kids. Do yoou think for a minute that they will let the IRS take it through this Helath Care Bill?

That won't happen.

The exodus has already begun a year ago, now it will be a mass exodus if this bill passes.
