I really don’t know. I remember reading early on that there are only certain circumstances where the military will execute. I don’t know if he qualifies. Maybe somebody else has the answer.

Nope after his conviction (and since a military jury is composed of sentient human beings - completely unlike a Massachusetts jury) he’ll be convicted.

It’s the firing squad. (Actually, I’d rather see him sent to prison with lots of showers where he can bend over and experience the full Mohammadism......)

Perhaps its different with military cases, but generally speaking the federal government uses the method of the state where the sentence is executed.

I read somewhere today that the military hasn’t executed anyone since 1961. Suddenly I am reminded of the soldier who killed an officer hours before invadin Iraq. Whatever happened to him (was also muslim)?

Can any lawyers say whether or not Hasan could have been charged with federal terrorism charges, or treason charges (its sounding like he’ll just get murder and consume oxygen at Leavenworth for years to come)

there are only certain circumstances where the military will execute.

You'd think that killing twelve military people would qualify a traitor for the death penalty.

I hope we're not not entering a time when the military would be a more political arena than the state. If that were true I'd want Texas to do the job.

I just don't know what to think either.

You know, I’m totally ok with diversity as long as those diverse service members actually support this country. Anyone, regardless of race, religion, and/or gender, who expresses anti-American sentiments or who has ties to known terrorists should NOT be eligible to serve. With all of the assessment tools used in the military, surely there is a tool available to assess for ACTUAL support of country, not just lip service so U.S. taxpayers will pay for medical school.

I am by no means expert in this, but just recall that on earlier threads there was some discussion that depending on the charges the penalty under Texas jurisdiction would be more severe than under military jurisdiction. Could be we won’t know until we hear the charges. But I can promise you there are a lot of po’d Texans who would have no problem with giving him entry into our court system.

My understanding is the death penalty applies in both cases. But that if terrorism is EXCLUDED then there would be no Federal charges.

But I am no expert.

That sounds pretty dopey. And every law or penalty seems like it's going to be arbitrarily applied in this day and age. We can't even count on that anymore.

Even IF the Army spent half a million to educate this guy...They were still stupid not to let him leave!

Either cancel his Iraq tour, and let him quietly leave the Army IF they don’t want to court martial the guy for treasonous comments. Then follow him after his discharge with the CIA ...Oh, wait, they WERE following him!

This was like a very very bad Mack Sennet comedy that turned tragic.

When W was gov there was a big flap in Canada about some dirtbag Canadian who had killed some (1?) Texan and got the death penalty. A Canadian reporter said to him something like ... what can you say to reassure Canadians who are worried about the Texas death penalty.

W said something like don't kill anyone if you come here and you'll be OK. (I quote from memory)

My understanding is that military infractions are covered by a military tribunal. If terrorism charges are added, then the Federal government takes the case over ... it supercedes the military.

I'd trust Texas. I'm trying to figure out (and I can't believe I'm saying this) whether we can trust the military bureaucracy to handle this traitor *as* a traitor who shed blood on our own soil.
