WASHINGTON - Army Maj. Nidal Malik Hasan will be tried in a military court-martial, and prosecutors are expected to seek the death penalty, officials said yesterday.
FBI and Army investigators tried to interview Hasan, who is recovering from bullet wounds in a San Antonio, Tex., Army hospital, on Sunday, but he refused and demanded a lawyer.
Under the military system, Hasan's fellow Army officers - almost certainly combat veterans - will rule on whether he is guilty of the mass murder of 12 soldiers and one civilian at Fort Hood, and, if so, on his punishment. A death penalty would be carried out by lethal injection.
The last military execution was carried out in 1961, and the last execution in a federal court case was in 2003.
If Hasan receives the death penalty in a military court, his appeals could drag on for years. Nine soldiers are on military Death Row at Fort Leavenworth, Kan.; one has been there for more than 20 years.
In the first legal challenge in the Hasan case, lawyer John Galligan, who has been retained by Hasan's family, said a planned visit today by President Obama to Fort Hood for a memorial service could prejudice a potential jury.
"You've got his commander in chief showing up" at Fort Hood to meet with troops and comfort families, said Galligan, 60, of nearby Belton, Tex.
Obama's planned visit "creates an issue as to whether you find a fair and impartial forum, whether that's in the military or even if it were in a federal forum," the retired Army colonel added.

it will NEVER happen. PC rules say it would inflame muslims causing a severe backlash. he may be sentenced to death, but it will never, ever happen (unless and until PC rules change). IMHO

This is the perfect media opportunity for dividing our military for Zero. They will hurt the families of dead privates, telling them he was a poor “persecuted muslim” and to suck it. - Sending a .22 round to your president or state senator/representative via UPS as a warning to quit acting in illegal [contra-constitutional] manners.
- Sending a bullet to a government official/bureaucrat in the conventional manner... especially if it happens to be you defending yourself against actions under color of law/office. (See Waco.)

My guess is you all probably would do nothing.
Although my first instinct is definitely death, would that make him a martyr? If it put him in eternal disgrace to have failed (and taken down by a woman, at that), then let him rot in prison.

I have seriously thought about not paying federal taxes; in revolt and to not put me in the poor house not qualifying for welfare. Especially being that we will be paying for ObamaCare before the communism of it fully rules. But then, if you don’t pay your taxes... they garnish your savings, retirement, home, land and the pot you pee in. I am seriously considering a move to Tx. or La. (job wise this will work better as well but the jobs that pay for my move are not returning calls like they used to.) In hopes of theses states surely breaking away from the Obama communism.
