Failure to buy health insurance in the just-passed health care bill could get you five years in jail with a $250,000 fine. How can violating a law that's unconstitutional be a felony, asks Investor's Business Daily (IBD)?

The passage last Saturday night of the House health care measure by a fragile 220-215 margin may well prove to be a Pyrrhic victory. In polls, townhall meetings and tea parties, Americans have shown they don't want a "reform" that costs a staggering $1.2 trillion yet fails to meet the left's desire of insuring all the uninsured. And they certainly don't want a bill that threatens them with incarceration if they don't comply, says IBD.

Sections 7201 and 7203 are actually in in the U.S. tax code, not the bill, but they are the penalties for failing to comply with with the individual mandate and pay the fine/tax.

What's "unconstitutional" mean? I'm not familiar with that word.

We MUST all say NO to this stupidness!!!! If we all sign a pledge to say no to them, this bill stops dead. They can’t jail a whole nation.........”live free or die”. It is our choice.

I understand what you are saying however, what if Obamalosi just garnishes your paycheck until the $250,000 is paid off?

What bill ever passed by Congress makes the U.S. tax code a law? The 16th Amendment reads: "The Congress shall have the power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration." That just gives the Congress the power to tax but doesn't make it law until a bill gets passed making it a law. No bill = No law = No crime = No jail. To my knowledge Congress has passed no law authorizing the tax code.

I have listened and read all that us on FR have said about this travesty of a bill. It is time for us to put up or shut up. I am ready to pledge to say NO to the take-over mobs who are ruining this country. If that means jail, so be it. If it means going broke, so be that too. It is either talk or action....

I can’t wait to see the reaction when people start getting hauled into court or have wages garnished when they refuse to go along. I wonder how many Demo voters will be the ones prosecuted. Would the “news” media even report on this or would they remain silent? Just maybe when people start to see family members, friends, neighbors, then themselves targeted, they will see what a mistake they made. Like we didn’t try to warn them.

If you take this one step back, there is no constitutional authority that mandates that I even seek medical care. I might have cancer, or diabetes, but it is my decision as to whether I seek medical help or not. The government cannot mandate that I go to the doctor.

If they cannot mandate that I go to the doctor, how can they mandate that I pay for something I will never use? How will the bill deal with Christian Scientists, or other religious sects that do not believe in seeking medical treatment. Will they be forced to pay for something they will never use because of their religious beliefs?

More importantly, what provision will they rely on to say they have the Constitutional authority to enforce the law? I have heard the General Welfare clause, but I don’t think that will pass Constitutional muster. General Welfare provides for the federal government to do those things for the citizenry they cannot do for themselves, such as highways, airports, etc. Health insurance is something everyone can do for themselves, and can decide whether you even want to get it or not.

It certainly won’t be an empirical decision it will be a political decision.

Not a pledge. All signing a pledge does is give them more paper to throw away.

Instead, what if 5 million of us decided to "visit" Congress on the same day . . . . at the same time . . . . and wanting to see the same (lack of) action in the Congress at the same time we all pushed our way in and forced our way into the chambers.

And, while we're there, what if we all started chanting "You're Fired!!" and we just sort of converged on their desks in chambers and offices and helped them find the exits . . . . just in case of an attack of something???

I think they might get the message. The problem is that as soon as we all went home and let them go back, they would just add fortifications to prevent a repetition. So, we would have to stay for a few . . . months!! Or, even years - just to be certain that nothing "bad" happens to them, doncha know!!!

I am sure you are right, but these slime bags haven't paid attention to the Constitution for decades. They will simply enforce it the same way communists have always enforced things, by the barrel of a gun. I could say more, but I think I will keep it to myself.

I am wondering if any of the Feds who are in Law Enforcement will turn in their badges rather than arrest grandma who cant afford their health insurance.

Guess it won’t matter if any FBI agents turn in their badges anyway. They’ll just find some other goons to arrest us all.
