Military prosecutor to charge major on 13 counts of premeditated killing

Military prosecutors say they will charge Fort Hood shooting suspect Maj. Nidal Malik Hasan with 13 counts of premeditated murder, a government official told NBC News.

An announcement will be made later Thursday at Fort Hood, officials said.

This is probably a good thing. The only online poll I’ve seen on the subject was running over 90% feeling that it was terrorism.

0bama’s image will take another hit. Coupled with his inaction on Afghanistan, this should be a really bad week for him.

Prosecutors are after the death sentence, if these are the charges that will best get him in front of a firing squad (or however they do it still) then they will use those.

Terrorism is probably harder to prove now that the idiot talking heads have tainted the jury pool with their multiculturalism BS anyway.

The terrorist' attorney was on tv today stating he hadn't seen any charge documents against his client yet. The Judge (Neopolitano) said the attorney had a great record of getting his defendents reduced sentences during his tenure as a military JAG. He also stated that the military doesn't really have any good capital murder prosecuters. He said no military member had been executed for crimes since 1961.

I think a life sentence in Leavenworth would be better than the death penalty. This is a no nonsense prison where all convicts are subject to strict military discipline day in and out. Denying NMH his 72 virgins and making him march and stand in formation for the rest of his life to him would be a fate worse than death.

This is such BS. Under the patriot act a regular US citizen can be charged and convicted of a “terrorist threat” if they verbally threaten someone and that person SAYS that they “feared for their life.”
How can killing 13 people NOT be a terrorist act?

Terrorist John Allen didn't get convicted of treason. Treason means that Obama would have the ability to commute his sentence ....and we are getting a pretty clear picture that Obama would not be able to execute an Islamic terrorist.

I simply cannot believe our govt is trying to uncover all the facts in this case when they leave his apartment open to the press with evidence of his misdeeds still intact.
This defense lawyer will have a field day with that.

I don’t think they have enough evidence to charge him with terrorism at this point. They do have the evidence to charge him with murder and they can keep him locked up on teh murder charges as they gather more evidence. I’m sure there will be many more charges before he is court martialed.

No ... he was convicted of premeditated murder, terrorism, conspiracy to commit murder, and illegal use of a firearm. The Commonwealth of Virginia did not have the authority to charge him with treason.

I am insufficiently familiar with the UCMJ to know the full range of charges which could be brought against Islamic Terrorist POS Hasan.

If, as the investigation unfolded, there was clear and convincing evidence that he was part of broader conspiracy, there would have been a decent chance that he be tried in civilian court, where civilian law offers the most law to deal with terrorist conspiracy and also allow the FBI/DOJ to assert jurisdiction.

Strangely enough, the UCMJ doesn't have any punitive articles that specifically address "terrorism" or "terrorist conspiracy". You do have Art. 104, Aiding the Enemy and perhaps Art. 106B Espionage on behalf of a faction or party or military force within a foreign country, but that's really as close as you get.

Now, I'm not foreclosing the possibility that he is indeed part of a larger conspiracy, but until such a time that strong evidence is developed to support such an allegation, military court is the best place for him, IMHO.

Too bad. If the civilians were to charge this guy he would be found guilty and be executed (it is Texas after all). It has been over 50 years since the military executed anyone. Even if found guilty this guy will spend time in Leavenworth. What a waste
