2 new lawsuits to save S.F. Bay-delta smelt

Two environmental groups sued the federal government Friday seeking greater habitat protections for two San Francisco Bay-delta fish species, one of them the delta smelt, a small but important creature in California's water wars.

One lawsuit asks a federal judge in Sacramento to require the U.S. Fish and Wildlife Service to respond to the groups' March 2006 request to change the delta smelt's status from "threatened" to "endangered." That action would somewhat tighten federal standards for development or water-use permits.

A second suit, filed in San Francisco, challenges the federal agency's decision in April to deny protected status to the bay-delta population of the longfin smelt. The agency said the local population is not a distinct group entitled to protection because some of the fish migrate up the coast to breed with other longfin, a conclusion the environmental groups called a reversal of the government's longtime position.

"Formerly abundant fish at the base of the food chain in the San Francisco estuary are being driven to near extinction," said Jeff Miller of the Center for Biological Diversity, which filed the suits along with the Bay Institute.

Where do valley farmers fit in that food chain, Mr. Miller?

Many of them are as deserving of Endangered status as any fish.

The goal is to eliminate American farms.

The theory being that we will be more, um, compliant if our food can be cut off at international whim.

Environmentalists make zero sense to me. They claim to be the protectors and lovers of nature. But part of nature is that species go extinct.

Perhaps these lawyers should file suit on behalf of dinosaurs.

Yep. Further our courts are a circus. They have no authority in this matter. The federal law that says they do is unconstitutional and the states need to tell the fed to pound sand under the tenth amendment.

The lawsuits are overreaching. A local population is not the same as a species that is doing OK in other areas.

Furthermore, their primary habitat is estuaries, NOT deltas! Perhaps they were never supposed to thrive in deltas anyway.

{ (Wikipedia)The longfin smelt, Spirinchus thaleichthys, is a smelt that is found in several estuaries and lakes along the northern Pacific coast of North America.

Their primary habitat is the open water of estuaries, where they can be found in both the seawater and freshwater areas, typically in the middle or deeper parts of the water column. They have been found as far north as Prince William Sound in Alaska, also in Skagit Bay, Grays Harbor, Willapa Bay, lower Columbia River, Yaquina Bay, Coos Bay, Humboldt Bay, the Eel River estuary, Klamath River estuary, and San Francisco Bay.

They have been collected from the mouth of the Russian River occasionally, and a single fish was once caught in Monterey Bay. In addition, there are landlocked populations in British Columbia's Harrison Lake, and the Lake Washington.

In 1992 the Natural Heritage Institute petitioned to list longfin smelts as an endangered species, but the petition was denied the following year, among the reasons being given was that the decline was not observed elsewhere.}

My favorite method of getting rid of smelt is to flour & season them and then fry them to a crisp.

They go good with football and basketball.

I plan on doing my part of eliminating these little critters later today.

A couple of notes: A) The term estuary applies to all of the tidally influenced semi-contined area (which may include areas of the delta and adjacent wetlands); B) According to the ESA regulations, separate populations (or in the case of anadromous fish, runs) may be treated as separate species; C) A species must be protected throughout its life-cycle, not merely in its primary habitat.
