The Associated Press has essentially claimed there is no such thing as fair use when it comes to quoting its articles or reprinting its headlines, but when the news organization scans an entire book, then fair use does indeed exist.
Bloggers and news aggregation sites such as Google News have felt the wrath of the Associated Press (AP) for some time now for quoting headlines from the news agency or any portion of its articles. The AP has gone so far as to suggest it would start billing bloggers per quoted word for anything pulled from its articles. While both headlines and small quotes from articles are well protected under the fair use doctrine in copyright law, the AP has essentially ignored the concept with its actions.
Well, it would seem that the AP is all for fair use when it applies to them.
Talking Points Memo got a look at a weekly internal AP newsletter that details how two AP reporters managed to buy a copy of Sarah Palins book Going Rogue five days before its release date. The AP staff then ripped the book from its spine and set about scanning the book so that twelve reporters could share the copy and begin fact checking it.
The problem is not with the fact that the AP did this, the problem is with the fact that it is being so hypocritical. No matter how you slice it, the AP copied a book (without permission), distributed it (without permission) and now stands up to say it was all done under fair use. Unfortunatly the AP is technically correct on everything that is being said in regards to its use of the book, but, in the meantime, enemies have been made all across the blogosphere because we are not allowed to quote AP stories without possibly being charged for doing so.
Quoting has always been, and always will be, an essential part of journalism. So long as credit is given, it clearly falls under the fair use clause, and the AP would be well served to remember this. If it can claim fair use, why cant the rest of us? The problem is that the AP would lose if a blogger was ever taken to court over not paying for using a quote, but does anyone really want to be the test case for that?
The AP needs to remember what is good for the goose is also good for the gander. Copy all the books you want in the name of journalism, but stop threatening bloggers for using quotes if it is also in the name of journalism.

Dreams From My Father : A Story of Race and Inheritance is Obama s memoir of growing up in Hawaii the son of a black man and white woman. He discusses trying to come to grips with his racial identity, a period of rebellion that included drug use, traveling to Africa and becoming a community activist in Chicago.
It was published in 1995 to strong reviews but only modest sales. Obama said 15,000 copies were printed, and he still has several boxes of them.
Crown Publishing Group, a division of Random House, decided to reissue the book after Obama won the Illinois Democratic Senate primary in March. Then he delivered a keynote address that thrilled Democrats, and interest in the book took off.

What do you make of the Barbara Walters, Sarah Palin interview that was to be on 20/20 last evening? Did you watch? It did not happen! ... instead they made a comment about the upcoming interview; and then showed a murder crime for about 46 minutes ... then they had a short segment of Sarah and Trig ... maybe 6 to 7 minutes, then they went to Janet Jackson and the up coming new record being released and then the scheduled interview with Janet regarding Michael's death to be broadcast in the next weeks on 20/20.
I was very amazed by the censoring (by not showing it) of most all of Sarah's interview. Obama has called her dangerous ... which might be the reason for the decision.

And about to become more so. They just recently laid off a lot of people and there’s been a change of leadership over there which has brought in individuals of less than sterling character who are happy to surrender any vestige of objectivity in favor of the politicians they like.
They savored every minute. Of that I have no doubt. If they could round up every single copy and incinerate them, they'd do it in a heartbeat.
I noticed that too. They had her interview in what was supposed to be 3 parts, Good Morning America, World News Tonight, Nightline, and then the FULL interview on 20/20 in case people missed the interviews throughout the week. Instead they showed some murder for FORTY SIX MINUTES..I was like “OH COME ON ARE U KIDDING ME” then they finally devote 9 minutes to Sarah’s interview and Babs said “You can watch the full interview on abc.com/palin” YES Obama and his cronies got to them, because the World News Tonight portion of the interview was about policy and Obama did not want people to hear Sarah bash his administration. Instead they showed some awesome clips of Trig and then got into Levi(WHO THE HELL CARES ABOUT HIM, HIS 15 MINUTES OF FAME ARE OVER)
Also, my book NEVER came. I ordered it through amazon.com, it was supposed to come yesterday via usps(Didnt Obama say he will make health care like the post office) and it never came. Either someone stole it or it got lost. It never moved out of Las Vegas, just froze there. So yeah, USPS can’t even deliver a book on time. So now amazon will send me another book but this time from UPS with no charge.
Actually, this would be a copyright violation. You can’t copy whole books in this way. If they wanted 12 copies of the books you have to buy 12 copies. Otherwise schools could buy one copy of a textbook and copy it for every student.

When it comes to Palin, anything goes, lies, smears, hacking her email, photoshopping pictures. The AP (Anti-Palin) was at the forefront of the 0bama smear operation during the campaign, and has continued since. Matter of fact, the AP “reporter”, Rachel D’Oro, in Alaska had a very close working relationship with the anti-Palin bloggers up there, and got a lot of her stories directly from them.
Copying an entire book and distributing the copies of a whole book is “fair use”??
All the medias are strongly influenced to be pro liberal on all issues. The ownership and the major stockholders have bought themselves into having this position of power. SHAME!

I read a story yesterday about how he went to the GQ Magazine party, NOT ONE person talked to him, no one looked at him, no one talked to him..he left after an hour with that Obama drone Tank Jones..I just started laughing. And he was on an American Airlines flight acting all stuck up and Jason Alexander was on the same flight and pretty much said that he was sick of his stupid ass

I also ordered a copy of Rogue from Amazon about a month ago. Paid for it a month ago and have received nothing.
I won’t be surprised if we both get flamed, but I agree. I like Sarah Palin, and was impressed with her in many respects. I also think she has a tremendous amount of gravitas(sp) and can do wonders for conservatives. I’m just not sure of the best way for her to influence the future elections. Somehow presidential candidate does not, at least to me, seem to be a good fit. Maybe more of a Rovian role.. with lipstick!

The average person that hears long run-on sentences that annoy them turns the speaker off and doesn’t hear the message. So how would you explain the many folks that say she speaks in a homey, forthright manner? Or the hundreds of thousands that turned out at her rallies because they felt she was speaking to them? Drill baby drill ~ hmmm, long? run-on?
You obviously don’t like her and that’s fine, we’re all entitled to our opinions, but if she truly was that pathetic a speaker she would NOT attract the crowds she does nor would thousands of people line up and sleep out over night to get a book signed. I didn’t see people doing that for Hildebeast’s book nor Pelosi’s.

Well, mine was supposed to come yesterday, it still says “in transit” from Las Vegas, hasn’t moved so something is not right. Either way I am getting another copy, already got things sorted out through amazon.com. I bet someone jacked it, saw it was a book(considering her book was all shipped on the same day) and someone figured they could get some cash out of it. I will never have anything delivered usps again. They are unreliable
I’m sorry, but any dark horse candidate from a very liberal state needs to be building their own resume NOW, not trying to get pulled along in the shadow of a candidate that already electrifies crowds. Whether or not Sarah Palin is deemed to be the best candidate in 2012, she is already showing that she at least has the ability to ignite the crowd - including both the base and independents (when they actually listen to her).
And in terms of her speech patterns, I would prefer a plain spoken person who fully believes what they say over an ultra-polished anyone.
It is time to replace the press.
