Posted on 12/05/2009 1:34:25 PM PST by StarCMC
Col. Van T. Barfoot, a local Medal of Honor recipient, is under the gun from his Henrico County community's homeowner association.
In a five-paragraph letter to Barfoot that he received yesterday, Barfoot is being ordered to remove a flagpole from his yard. The decorated veteran of three wars, now 90 years old, raises the American flag every morning on the pole, then lowers and folds the flag at dusk each day in a three-corner military fashion.
There is no provision in the community's rules expressly forbidding flagpoles, Barfoot's daughter said. But she said the board ruled against her father's fixture and ordered it removed in July, deciding that free-standing flag poles are not aesthetically appropriate. Short flag stands attached to porches dot the community.
"Dad sort of feels like this is the end," said Margaret Nicholls, Barfoot's daughter, who lives a few doors away. But she said this morning that she and her husband are attempting to generate support for her father's cause, a flag-raising rite that he has undertaken for most of his life.

BARFOOT, VAN T.
Rank and organization: Second Lieutenant, U.S. Army, 157th Infantry, 45th Infantry Division. Place and date: Near Carano, Italy, 23 May 1944. Entered service at: Carthage, Miss. Birth: Edinburg, Miss. G.O. No.: 79, 4 October 1944.
For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.
Canteen ping — will tick you off to no end.
Power can be a terrible thing. I hope that those who voted against this gentlemen get fleas....like several times in the next few years.
Tonight, the Sussex Square Homeowners Association issued a statement reiterating its position that Barfoot directly violated the association board's denial of his request to erect a flagpole.I can't believe their digging their heels in on this. What disgusting wretches.
The board is probably made up of socialist democrats who never served in a war or even personally know someone who has, let alone a Metal of Honor winner like Mr. Barfoot. Since when is a flag ever aesthetically inappropriate?
And yes, that's what they want to do.
The commies would probably have no problem with someone burning a flag or flying it upside down.
Does anyone know an email address for said Sussex Square Homeowners Association? Maybe a few gentle reminders are in order.
Can’t wait for the defenders of the associations,,,love these threads,,
I find this HOA aesthetically inappropriate.

A letter written to the board by Sen. Jim Webb is here: http://nbc12.wordpress.com/2009/12/03/webb-sends-letter-to-hoa-in-defense-of-barfoot/
It would be interesting to go person by person through this board and look at the background of each of these folks who are making up this decision. My guess is intitially zero veterans, but I may be wrong.
There’s a little info toward bottom of this thread - there have been multiple threads on this (good!), so I don’t know what the others contain:
I heard about this story the other day. These “associations” are nothing but greedy power trip filled commies if you ask me. I laugh in their face and tear up their letters when they try to tell me I painted my door the wrong color or didn’t get permission to trim my tree that short.
EAT S-HIT! I tell them. I make them spend a bunch of money on lawyers to send out letters and then wind up winning on votes in the quarterly meeting anyway :)

I’d say burn down the Homeowners association President’s house ... but that wouldn’t be right either.
One wonders what the real issue is here.
(It sure isn’t about a flagpole.)
Yeah, Levin was all over this story a coupla days ago. Said he planned on getting involved..I sure hope he can do something.
It would be a great privilege just to shake the hand of a Medal of Honor Man!
Better never to have been born than to be the sort of loathsome ass that would demand this old soldier remove his flag.
God Bless You 2nd Lt. Van T. Barefoot... Thank you for your selfless efforts guaranteeing Liberty and freedom for me, my children and my grandchildren.
I’d like to help this man. Does anyone have names and addresses for the members of this disgraceful homeowners association? Do we have the email for this association? Local people could put American flags on their lawns. Calls and letters inviting them to show this man his due respect and reconsider their position. Can we get any pro bono help for him. These people aren’t worthy to shine this mans boots let alone tell him he can’t raise the American flag on his own property.
Well, I hope these two men (with voting records nearly identical to Barbara Boxer) are not outflanking their Republican counterparts.
control freaks with a little power
IMO you are absolutely correct. They are locally elected representatives who conduct community business including levying taxes.
So why would anyone buy an apartment and call it a house and follow someone else rules? I don’t get it?
You know, we could learn a few things from the left when it comes to things like this. Such as...
Everyone in the neighborhood who supports this guy puts up their own flagpoles.
Have a march through the neighborhood, with lots of flags and chanting and so forth.
File nuisance lawsuits based on vague civil rights complaints... hey, the guy is 90 years old. There’s got to be age-related discrimination somewhere in there.
Stand quietly on the street in front of the board president (or whoever is in charge of the group making the decision) holding up American flags.
Have a sit down strike. Since we’re talking seniors here, maybe lawn chairs would be in order. Some nice brownies. A cooler with iced tea.
Do it anyway.
Use the media. Play the media. Put up a website.
Create and sing humorous songs about the group banning the flag, then broadcast it on YouTube - and include the media, too.
Start letterwriting campaigns.
Hang little American flags everywhere.
Take out ads on television or the local paper. Be dramatic and floral, a la global warming and the deaths of the polar bears.
Make him a national hero. Speak highly of his record, always.
And never, ever, ever give up until that guy can get his flag put up every day as he wants to.
You know, the Alinsky rules for radicals can be used on behalf of this guy the same way that Obama and his minions uses them for themselves. When the left has gained power, those of us who are proudly American are the radicals. Carpe diem.
“I’m glad the law firm of Marchant, Honey & Baldwin, is representing Barfoot at no cost.” (found on this site)

Good on them, I pray they are successful
Where are the Virginia Patriots???
Do you stand by this man??? Will anyone help this Hero repel anyone who steps upon his property to remove a symbol that he honors every single day???
Is this enough, or does he have to accept this???
Or will this just be another example that will be thrown upon the trash-heap of those who oppose those of us who value, protect and personify what America (used to be) is???
Where are the Tea Partiers??? Where is the Governor-Elect???
Lessee who is able and ready to step up???
I need to stop thinking what I'm thinking.
Post #18 had some contact info that I found. HTH
Stifle, shunt and/or kill anyone that has a memory of America.
that makes two of us.
I'd rather live in a tipi in the woods than live in under the thumb of a HOA...I'd be in trouble daily as I'd go against the grain just to assert my Independence
I DO live in the woods - my house hidden from road. I can get a tan without lines (not that anyone would take a chance on seeing that twice - I'm a great granny) ;o)
Mark Levin exposed this travesty on his program on Wednesday, and said he wanted the names of the bottom feeder lawyers who are involved in threatening Col. Barefoot with litigation...he wants to get one of these lawyers on his program, and he said that he wants to read out loud the names of the lawyers involved. Mark said he will take these slip and fall lawyers on.
We are being attacked at every turn, and we must fight back...soldiers in war cannot let up, and neither can we.
I think that the neighborhood association may be backing down.
i bet it’s the flapping in the breeze of the flag that’s bothering those people in that community. SHAME ON THEM and the HOMEOWNER’S ASSOC.
Thanks. I sent them a little note. I also included his Medal citation to remind them what he has given for his country.
I'd like to know their physical address...I'd like to send them a bucket of spit.
This is disgusting!! Discounting all the logic, this hero is 90 years old. Makes one think the HOA is just beating its chest and making sure everyone understands that they are the boss and must be obeyed. I hope to heck that the locals, a senator or two, and others are able to make a big enough issue that the HOA will back off this dumb edict.
And the ruling that “free-standing flag poles are not aesthetically appropriate” is a sorry excuse for this action.
Disgusting and disrespectful of the flag, this hero AND
our country! What a sad time we live in!
I lived in an HOA once and only once
Makes me want to cry at the slap in the face to this hero.
