Government Has Yet to Provide Evidence to Support Its Prosecution of Navy Seals for Alleged Punching of Terrorist

Norfolk, Va. (CNSNews.com) – Though trial dates have been set for mid-January, defense attorneys for three Navy SEALs charged with offenses arising from the alleged punching a terror suspect in the mid-section said at an arraignment on Monday in Norfolk, Va., that the government still had not provided any evidence in the case.

If defense attorneys do not get the evidence soon enough to review it, it might raise the need for a delay in the trial date, said Monica Lombardi, civilian attorney for Julio Antonio Huertas Jr., 28, who pleaded innocent in military court at the Norfolk Naval Station on Monday. His trial date is set for Jan. 11, 2010.

Lombardi told CNSNews.com that the government provided no time window as to when the evidence will be provided. She told reporters it is “highly unusual” to wait this long for evidence and predicted the trial might be delayed if the defense does not have adequate time to review the evidence.

Matthew Vernon McCabe, 24, deferred his plea at the arraignment on Monday. His civilian attorney Neal Puckett said it is routine for him not to offer a plea for his clients at the arraignment.

“The problem will be whether they provide the evidence soon enough to give us enough time to prepare for the trial,” Puckett told CNSNews.com after the hearing. Typically evidence is provided before the arraignment, he said. Nevertheless, he still expects to be able to go to trial on Jan. 19.

I dont know about anyione else , but I am embarrassed that our Government would treat it’s heroes in this manner.

we’re a Navy family, but on this one I want to hear all of the evidence before making a judgment call. The Seal that I saw talking to the press yesterday, should just keep his council. His career is over, but he isn’t helping his case by speaking out public ally.

Your post is good advice to any accused.

However, I’m frustrated about the dearth of facts available to the public (and, apparently, the defense) in this case. The last article I read suggested that one Seal punched one terrorist in the stomach. Bad form, maybe, but hardly worth the drama I’m seeing in the news.

For a punch in the stomache and a fat lip??? We're persecuting these heroes for something as minor as a punch in the stomach!!!???? Well if the government wants to kill off new enlistments this is the way to do it. I'm embarassed, ashamed and outraged!

After hearing the Navy Seal on the Glenn Beck show I am come to the conclusion that from here on out when ever one of these POS’s is transported it should be secretly videotaped.

Better yet to further prevent any future problems they should be killed opposed to captured.

The media will not report this. The only way to cut through is with an effective ad. One is running now. They are relying on contributions. It should be supported. I think if a million Americans saw that ad a mob would descend upon D.C.

Disturbingly, the mainstream GOP groups and leaders are also avoiding this. The grassroots will have to fight this battle.

Hell, we can have cameras on school buses and have the news show us a fight 900 times a day, why can’t we put one in a POS transport vehicle. Sure would be cheaper and faster than dragging our heroes through the mud.

Yep. The terrorists are all trained to make false complaints about abuse to foment this exact scenario.

Not entering a plea at arraignment is standard procedure. The govt. asks for an arraignment to stop the speedy trial clock and the accused enters a plea one way or the other on the day the trial is scheduled.

Now that the accused has been arraignmed, the defense can file a motion to compell discovery.

Bad form?? Here's page nine from the Monadnock PR-TM2 side-handle police baton training manual, describing jabbing techniques:

The Front Jab is one of the most effective and dynamic active defensive skills you have in the Basic Position to defend in close with an attacker (Zone 1).

And from page 15:

(10) LOWER ABDOMEN - GREEN AREA. Abdominal region just below the navel. A baton strike usually causes minimal, temporary incapacitation.

Green Target Areas are for confrontations where the subject is resisting an officer or another. Yellow Target Areas [Upper Abdomen] are for confrontations where the subject is assaulting an officer or another, or when force applied to a Green Target fails to overcome resistence or does not correspond with the threat level. Yellow Targets are areas of the body where force is directed at a joint or an area in close proximity to a priminent Red Target Area and therefore the risk of injury increases.

If true, that's a damn shame on our military.

My son is a Captain in the Navy and he worked with the Seals {he is not a Seal}, and he told me that he'd put them up against any special forces unit in the world.

The hard work that these guys go through to become a Seal, and then to be destroyed by their own government is too much to be believed.

I agree, but all things being equal, I'll lean toward the idea that the Seals are the target of a Obama-driven policy aimed to show the Muslim world that he won't "tolerate" Abu Ghraib-type abuse — even though that's not what the Seal did, and even though the terrorist probably injured himself to get the Navy Seal in trouble, as is recommended in the "terrorist handbook."

IF the local commander was lied to, that honestly deserves attention.

But in terms of any alleged abuse by the Seals, the terrorist deserved the same fate as the Americans he killed.

Prayers up for these SEALs.

Al-Qaeda tells all their people to yell “torture” or “abuse” if captured. Even they have figured out how to work the system. This is all bull. Clear these SEALs and let them get back to defending our nation. They caught one of the most wanted terrorist animals in Iraq, they are more then capable and have proved themselves to be a great asset to our Armed Services.

The way I see it...I don’t think their career is over. They avoided a captains mast, which in itself is a permanent MARK of punishment, a possible freeze on them making rank.

This court martial *should* clean their records back to spotless.
