Upon examination of Senator Harry Reids amendment to the health care legislation, Senators discovered section 3403. That section changes the rules of the United States Senate.
To change the rules of the United States Senate, there must be sixty-seven votes.
Section 3403 of Senator Harry Reids amendment requires that it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection. The good news is that this only applies to one section of the Obamacare legislation. The bad news is that it applies to regulations imposed on doctors and patients by the Independent Medical Advisory Boards a/k/a the Death Panels.
Section 3403 of Senator Reids legislation also states, Notwithstanding rule XV of the Standing Rules of the Senate, a committee amendment described in subparagraph (A) may include matter not within the jurisdiction of the Committee on Finance if that matter is relevant to a proposal contained in the bill submitted under subsection (c)(3). In short, it sets up a rule to ignore another Senate rule.
Senator Jim DeMint confronted the Democrats over Reids language.

The current Congress cannot dictate to a future Congress what it can and can not do.

There is no way the Republicans will get the Senate back in 2010. The open races are 50/50 Democrat/Republican, with many of the Incumbent Rats in very Liberal States.
It will be a miracle if we maintain 40 seats. The Electorate is as clueless as my Chow Chow.

This is about as legal as the rest of the bill.
Reid has already pulled some despicable crap. This may take the cake. Doesn’t look to be “in order” since the current Senate rules require a 2/3 vote to change the rules mid session.
Tt the beginning of each Congress the Senate agrees on the rules for the current congress. In any disagreement over the rules at that time I believe it only takes 51 votes to settle it. So for example at the beginning of the last Republican senate they could have voted to change the filibuster rule for judicial nominations.
The chair can make a ruling about a rule though and if 51 uphold it they can essentially ignore the rule (nuclear option).
A conservative senate could later abolish this rule in the future (or ignore it using the nuclear option).
Complicated stuff.
But we need this legislation not to pass cause I doubt it would ever be repealed.
Or perhaps go to the SCOTUS with it...

I mean really .. can we not just have the military storm the Senate and just arrest these traitors Honduras style? I will not speak openly of the things I would love to do and love seen done to these people but by god it is not thoughts i thought I would ever have about any human being.
An Illinois Republican rep said on the radio this morning that if there were more conservatives in Congress in 2010 or 2012, all they would have to do is attach an amendment to any bill, defunding the present bill. Is that true?

The defunding tactic is used at times. The Vietnam War was defunded after all Americans had left (support for SVN). The Dims tried to defund the Iraq War more than once the last two years of W's administration. And, attempts were made to defund anything involved with moving the Gitmo prisoners to the US.
It is done, but there are probably technicalities about when and how it can be done. Maybe someone who knows will address the possibility soon.

Sounds like they are trying to enact legislation with the power of an Amendment.
They wouldn’t take it. Internal Senat4e rules, they stay out of it.
We have to replace them. There are few good men, but most of them have been there too long and have grown to like the power they have. They need to be humbled, humiliated and voted out. This mess is all their fault.
It's called Pandora's box. Medicare, Medicaid, and mandates on hospitals to treat for free.
Short a complete economic disaster dont expect an end to this government takeover. And don't trust republicans to fix anything
