Senator Jim DeMint (R-S.C.) pointed out some rather astounding language in the Senate health care bill during floor remarks tonight. First, he noted that there are a number of changes to Senate rules in the bill--and it's supposed to take a 2/3 vote to change the rules. And then he pointed out that the Reid bill declares on page 1020 that the Independent Medical Advisory Board cannot be repealed by future Congresses:

Well, then I guess this is one law that I won’t heed.
I’d like to see Palin make a Facebook post about this!
Actually, Reid is wrong.
Any Congress can overturn the actions of a previous Congress.
This only shows that Reid is stupid.
ANYTHING can be repealed.
Yes, I was wondering how a statute passed by Congress could require a super-majority to repeal it. That would seem to me to be obviously unconstitutional. But then again are we even operating under a constitution any more?
Could they be deliberately sabotaging the bill?
The whole thing is bizarre.
While they’re at it, maybe they can extend their terms of office. They’ve ignored other parts of the Constitution.
as I’m watching the video, seems like the parlimentarian is confused. DeMint continues to press him.
Nope. The Dems don't care about the Constitution and the GOP enables them.
The whole lot of them should be tarred and feathered on the Capital steps.
A wedgie and a royal flush would bring Reid into line. Televised of course.
Like we needed any more proof...
Even if Harry thinks it can’t be repealed, it can always be defunded. I’m not sure how many people will volunteer, then have to pay for their own office and not have anyone to speak to.
What a bunch of BS!
Reid needs to retire in Searchlite! Now!
All righty then, we’ll just have to elect 67 conservative senators. Like eating an elephant, “one bite at a time”.
Better yet, the Senate should simply abolish the House of Representatives, the Executive and the Judiciary and be done with it. 100 Kings for Life.
Sure it can, Harry. That’s what the Bill of Rights was for. Particularly Number Two.
PI$$ on Reid. WE THE PEOPLE can do anything we want. IT’S OUR GOVERNMENT. Turdboy Reid is one of OUR employees.
To which Obama will respond: "We Won"
Hmmmm....calling for the REVOLUTION, eh, Reid?
I have yet to see any document labeled as “irrevocable”
that wasn’t, in fact, “revocable.”
or if they pass it and contravene the constitution like other issues, they continue to set precedence in the new “this Aint America no more” constitution. Continuing to foist crappola on America.
Then the next step is outlawing republicans as a right wing aryan nation hate group so there is no opposition.
You have to remember, they are a bunch of arrogant liars protecting their arrogant liar chief. Here they are demonstrating it and if the people are sttopid enough to buy it, they will slide it and spin it.
He worked for the mob. He thinks YOU are his employee and don’t you ever forget it or he will have someone kneecap you.
Update II: My friend, the smartest lawyer I know, writes: "And yes. It is unconstitutional."
I hope so.
That may end some of it, but will not terminate the tax collections and regulations. Enforcement can be defunded, but the IRS would still have the teeth and legal regulations to go after those who didn't pay their health insurance taxes.
If they get away with this, they will add that stipulation to every left wing bill that is passed from now on.
Actually, the more unconstitutional goobers this contains, the better. Our only hope now is unending litigation.
Anything can be repealed if it isn’t funded!! LOL
What say you, Congressman Billybob?
“Update II: My friend, the smartest lawyer I know, writes: “And yes. It is unconstitutional.”
Yes, it is. Was doing some research and there are some cases concerning this issue.
Fletcher v. Peck - “The principle asserted is, that one legislature is competent to repeal any act which a former legislature was competent to pass; and that one legislature cannot abridge the powers of a succeeding legislature.
The correctness of this principle, so far as respects general legislation, can never be controverted.
United States v. Winstar - “Hence, although we have recognized that “a general law . . . may be repealed, amended or disregarded by the legislature which enacted it,” and “is not binding upon any subsequent legislature,” Manigault v. Springs, 199 U.S. 473, 487 (1905), [n.19] on this side of the Atlantic the principle has always lived in some tension with the constitutionally created potential for a legislature, under certain circumstances, to place effective limits on its successors, or to authorize executive action resulting in such a limitation.”
Manigault v. Springs - “As this is not a constitutional provision, but a general law enacted by the legislature, it may be repealed, amended, or disregarded by the legislature which enacted it. This law was doubtless intended as a guide to persons desiring to petition the legislature for special privileges, and it would be a good answer to any petition for the granting of such privileges that the required notice had not been given; but it is not binding upon any subsequent legislature, nor does a noncompliance with it impair or nullify the provisions of an act passed without the requirement of such notice.”
Office of Minority Health?
I will bet 1 million bucks that this health care fiasco results in racial tensions in future years. It is a godsend to trial lawyers.
I bet that the white guy will lose the kidney transplant to the black guy. The liberal will get the heart transplant over the conservative guy. Wanna bet this is what we will face?
On the other hand, how much you want to bet that monorities sue for discrimination in health care when they get denied coverage?
Any arguments here to the contrary?
Seems like DeMint is speaking in an ancient tomb with the skeletal Dems barely paying attention. And the Dem in this case looks like a buffoon.
Reid has got to be the most ignorant, treacherous, most arrogant leech in U.S. history.
They’re wiping their ass with the rest of the Constitution, why not this part?
[[Nope. The Dems don’t care about the Constitution and the GOP enables them.

you know, I just watched a short film about Teddy Roosevelt- and what a STARK STARK contrast he was to htis present ‘administration’. There he was- an honest politician who VALUED WE THE PEOPLE’S opinion MORE THAN he anythign else- he would NOT let special interests drive his administraiton- and that pissed a LOT of politicians off- but the people loved it-
Contrast with what Harry Reid said about Nelson and Landriuew when he basically called other senators and godertnoros ‘stupid’ for ‘not playing the game and gettign everythign they could’ out of health care ‘perks’ built into the bill.
This present administration disgusts me to no end. Whenever I’ve suggested that the GOP be wiped out and HONEST folks replce them, I’m told ‘You just don’t understand politics- honest peopel would get eaten alive’ Yeah? Ted didn’t- and he rooted out all the corruption within politics that he could- he didn’t compromise- he let the BUMS know in no uncertain terms that he was goign to go to the people IF they tried playing hardball
Our president himself today said “Stop Carping about hte health bill” to hte American people- apparently he ‘cares so much about us’ that he feels it’s his duty to tell us to shut hte hell up and stop opposing HIM and HIS policies IF we think there might be problems with it- apparently Americans aren’t supposed to questio nthe dear leader any longer- and apparently, Harry Reid thinks that whenever a democrat opens his mouth these days, what is said needs to be made a golden rule that can never be quesitoned or changed
Our freakin governmenthtese days is disgusting beyond beleif- - they are a bunch of LIARS CROOKS AND FRAUDSTERS who are throwing their criminal activity straight in our faces and daring anyone to stop them- This administration and his little cronies are spitting in our faces and kicking us i nthe teeth these days, and anyone that vioces an opinion exposing htese facts gets the SEIU sicked o nthem
Teddy also said somethign like ‘ANYONE who advocates foreignism in this country is NO American’ (Hint about who he as refering to- begins with BO)
[[The principle asserted is, that one legislature is competent to repeal any act which a former legislature was competent to pass;]]
You see htough- that’s the dems ‘loophole’- you see, they weren’t competent- but they passed it anyways-
I’m on board with that.
I’m on board with that.Oh and Merry Christmas to ya Pissant.
It doesn’t matter what Reid says. In Congress, each body makes it’s own rules per the Constitution. Members may vote to change their rules on their own terms. Every succeeding body of Congress is equally as powerful as each that have preceded it. Nothing Harry Reid says can deny this fact. The only trouble is that any legislation repealing the democrat damage will have to be signed by a president. Obviously the current president - the least capable man to serve in ten generations - will never sign such a repeal.
looking forward to the Palin presidency
“I bet that the white guy will lose the kidney transplant to the black guy. The liberal will get the heart transplant over the conservative guy. Wanna bet this is what we will face?”
But will they be covered for accute lead poisoning??
Harry Reid is a rodent.
