Jim DeMint to Force a Vote on Constitutionality of the Individual Mandate

..Jim DeMint and John Ensign are going to force a vote on the issue. Democrats will be forced to take a position on whether or not the federal government can force individuals to buy products on pain of criminal penalty.

“I am incredibly concerned that the Democrats’ proposed individual mandate provision takes away too much freedom and choice from Americans across the country,” said Senator Ensign. “As an American, I felt the obligation to stand up for the individual freedom of every citizen to make their own decision on this issue. I don’t believe Congress has the legal authority to force this mandate on its citizens.”

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Hunter is a great man, but he is nowhere near as electable as DeMint, in my opinion.

While you're at at, force a vote on the constitutionality of the provision that prohibits repeal of the core of ObamaCare.

Or at least go on record, up front, that you will not consider any future Senate to be bound by that provision.

How does congress get to vote on whether their legislation is constitutional ?

Have a suit ready to go before SCOTUS the minute it becomes law.

I guess I need some explanation. Just because 60 people vote to say it is constitutional, how does that make it so ?

I don’t have much faith in a civil war in the courts.

I have the same question. I’m not up on parliamentary procedure and suspect the communists can merely not allow it to come up to a vote, so they would not be on the record of where they actually stand.

One vote at a time. String it out. I don't know if they can legally NOT recess, but it doesn't seem like that would be practical even if they could.

Without the “public option” and being able to force people into the “exchange”,

this bill is toothless and people will defy it at every turn.

The three biggies that the left (and their “father”) wants, and has wanted for decades:

Single (gov’t) payer.
No other choice for people, under threat of jail or violence.
“Free” abortion on demand.

And earlier Congress’, too... The pubbies pretty much abused their turn at bat, under Bush, don’t forget.

What we need is principled, conservative representation that is focused on doing what is right for the country, within the constraints of the Constitution, and isn’t drafted with an eye toward the next election cycle.

It’s time to take back the country.

Heard this on the radio. Gave me a good laugh. Notice the only part that is being questioned on Constitutional grounds is the part mandating purchase of insurance. And the Senate that passed it is going to vote on the question? Absurd. It’s like having the wolves vote on whether or not the sheep are lunch or not.

There seems to be an exception written into the more obscure provisions of this proposed Senate bill, that would allow individuals to opt out on religious grounds. Christian Scientists, who believe in spiritual healing rather than traditional medicine, might be able to file for exemptions to the taxes and to the health insurance mandate. The Old Amish and Old Mennonites already have such an exemption on Medicare and Social Security.

The one thing we may count upon with this regime in power, is they won’t enforce the rules (not laws in the conventional sense) they themselves have written.

There will be NO CONSEQUENCE for infractions of their regulations. When called to account, just ignore it, or do not respond to “official” pronouncements.

But keep a plentiful supply of ammunition, and sufficient means to deliver that firepower.

It may be closer to happening than you realize. I can envision a scenario where someone high up in the military chain of command (perhaps General Petrais) will initiate a public refusal to obey orders as a pretext to bringing up charges against the unlegitimate CIC. There is going to be a Yeltsin type event where you see the military commanders on top of a tank telling the DC police to stand down, especially if the Obama troops start shooting tea party protesters. When it finnaly hits, I will enjoy watching Chris Mathews and Olberdork being sent to the guilatine.

Yes, we need our country back, but it will take a gargantuan effort to "reset" this country, and a civil war may be the only mechanism to effect this. Half measures will not do.

The leftist haters of America must go. And they will have to be made to go by force.

I agree completely. As much as I do not want a war in this country, I'm afraid there is no other way to perform a hard reset of the bureaucratic machine that has become entrenched in DC.

I just don't see any way to vote our way out of this, even if it IS what a majority of the population wants. As we are seeing now, the ruling plutocracy has no compunction about shredding the Constitution in broad daylight, and they simply will NOT give up power peacefully.

Understood,(both parties are guilty) but it has reached a whole new level. It’s as if the Constitution doesn’t even exist.

next time we need to add a provision stating that ANYONE who ignores the constitution will be shot. Maybe then they honor their promise to uphold it.

Does anyone on FR honestly believe that SCOTUS is going to knock down the man-child messiah's signature legislation piece? Come on people, they would not even address his right to run for President, they sure as he$$ are not going to look into this. Man-child is depending on this signature piece for all the follow-on legislation that he will jam down our throats. He must have this in place by Jan 20 so he can have bragging rights for destroying the country. There is no urgency since 90%+ of the benefits do not kick in for 4 years - Harry Reid just told us that thousands are dying every week because they lack health insurance, but yet he jams through a bill that continues to kill thousands of Americans while they wait for 1-1-2014 to kick in.

CIVIL DISOBEDIENCE IS THE ONLY ANSWER TO THIS TYRANNY.
