Diane Feinstein: The Constitution does not limit government's power to regulate citizens like cattle
Dec 24, 2009 | Jim Robinson

Posted on 12/24/2009 1:49:48 PM PST by Jim Robinson

According to CNSNews, Senator Diane Feinstein (D-Calif.) said that Congress has the authority to mandate that people buy health insurance and that there is no constitutional limit on Congress’ power to enact such mandates, adding that this unlimited authority stemmed from the Commerce clause of the Constitution.

If this were true, then the congress has no constitutional limits whatsoever. On anything. If they can regulate private citizens as interstate commerce, then they can "regulate" anything and anyone. This makes the entire idea of constitutional limits null and void.

The federal government can require and mandate that all citizens purchase:

Health insurance. Home owners insurance. Renters insurance. Auto insurance. Life insurance. Retirement insurance. Mortgage insurance. Credit insurance. Liability insurance. Legal insurance. Towing insurance. Auto repair insurance. Product insurance. Airport life insurance. Rental car insurance. Pet health insurance. Pet liability insurance. Pet burial insurance. Marriage insurance. Fire insurance. Earthquake insurance. Flood insurance. Burial insurance. Etc, etc, etc, and any other product or service it chooses.

And French food on Tuesdays.

Earmark:

Guns are hereby banned by the congress per the interstate commerce clause.

The individual mandate is not authorized by the Commerce Clause. Most of those advocating the Democrats’ bill say that Congress can pass this legislation pursuant to its power to regulate interstate commerce. That argument is incorrect, because there is no interstate commerce when private citizens do not purchase health insurance.

The left has prostituted the so-called commerce clause for decades, claiming it gives them absolute authority to do ANYTHING to ANYBODY. And republicans are not much better when it comes to screwing the American people. Time to take up arms and head to DC, people. In fact, it’s PAST time.

* The Commerce Clause only covers matters where citizens engage in economic activity. The last time the Supreme Court struck down a law for violating the Commerce Clause, in United States v. Morrison (2000), the Court did so on the grounds that the activity in question was not an economic activity.

* The Commerce Clause only extends to persons or organizations voluntarily engaging in commercial activity. Government can only regulate economic action; it cannot coerce action on the part of private citizens who do not wish to participate in commerce. In the most expansive case for Congress’ power to regulate interstate commerce, Wickard v. Filburn (1942), the Court upheld the agricultural regulation in question against a wheat farmer who earned his entire living from growing and selling wheat, making him a willing participant in interstate commerce.

* The Commerce Clause requires an actual economic effect, not merely a congressional finding of an economic effect. When the Court struck down the Violence Against Women Act in United States v. Morrison (2000), the Court noted that although the statute made numerous findings regarding the link between such violence and interstate commerce, it held that those findings did not actually establish an economic effect. Therefore the various interstate-commerce findings in the Senate version of the “Obamacare” legislation do not make the bill constitutional.

They may be able to cart me off to jail if they can convince the Great State of Texas to arrest it's own citizens at the behest of the Fed Gov, doubtful, but they still wont get me to pay for my own shackles.

Not all states have recall laws...but CA does, that is how liberal Arnie got elected. The states that have the laws need to start recalling their elected officials and kick them the hell out. And the states that don’t have the laws need to hurry up and pass one. This is the easy way of ridding this country of these pests.

If ObamaCare is upheld, we’re already there.

It regulates us (we the people) as if we were interstate commerce, ie, wheat, corn, cotton, cattle, sheep, potatoes, horse manure, chicknchit.

I guess that is how she got away with her own personal legislation to give billions to FDIC, who then gave a huge contract to her husband.

Feinstein can mandate money to her family member because of commerce clause.

Of course that is what the commerce clause is for.

In my mind, I hope that another 1994 landslide occurs, and the way out of all the communist takeover/wealth-redistribution would be to then have Congress create an investigation of the LEGITIMACY of The Messiah to serve as POTUS, un-covering his lack of "natural born citizen" status.

Then, the SCOTUS can declare any legislation/executive orders that were put in place to be FRAUDULENT and VOID, as he was not LEGALLY able to sign them into law, and then Congress can un-wind the mess, hopefully, and get back to a Constitutional-based government.

However, I doubt we can get ENOUGH Conservative Republicans elected in 2010 to get that done.

She's right actually. I mean, really, do you think the Statists of whatever political strip will just abandon their plans because of some piece of paper?

“WE ALL DECLARE FOR LIBERTY; but in using the same word we do not all mean the same thing. With some the word liberty may mean for each man to do as he pleases with himself, and the product of his labor; while with others, the same word may mean for some men to do as they please with other men, and the product of other men’s labor. Here are two, not only different, but incompatible things, called by the same name——liberty. And it follows that each of the things is, by the respective parties, called by two different and incompatible names——liberty and tyranny.”
