O’s INTERPOL Executive Order: immunity for Obama?

It's Chrismas Eve, and instead of sugar plums dancing in my head, I can't get Wordsmith's post about Obama's latest Executive Order out of my mind. It is like a kid getting his first jigzaw puzzle... my mind twists and turns with the repercussions.

I've been pondering the implications... since pondering and speculation is all we can do at the moment. I've also been searching codification docs, old EOs, wondering if this is business as "usual" or what. I am also seeing many blogs are misinformed, thinking INTERPOL is a newly added organization to the immunity list of IOIA. Not true. So let me fill you in on a few basics.

Granting immunities under the International Organizations Immunities Act of 1945 since EO 9698 in 1946, plus various subsequent EOs adding designated organizations to that list isn't unusual. It lies within POTUS power to alter any varying degree of that immunity under that Act. We are not talking about an infringement on the Constitutional powers by the Executive Office here. That argument should fly right out of the window.

The IOIA, from what I understand, differs from the blanket immunities granted to sovereign nations under the FSIA (Foreign Sovereignty Immunities Act) by granting immunities to the designated int'l organizations in two distinct classes: international organizations as one class, and their property and assets as the other.

Does this mean that INTERPOL can now arrest peole in the US and take them back to court in Europe? Bush and Cheney to Den Haag?

The author posits in the article exactly what I suspected when I read about this executive order. It gives Obama the excuse to turn over Bush administration officials, maybe Cheney or Bush themselves, to the ICC. He can calim he’s powerless, you know, that pesky treaty thingy.

My limited legal understanding tells me that this doesn’t give interpol any direct power but it does restrict domestic law enforcement from interfering. (Backdoor power to interpol)

Just thinking out loud here but Interpol isn’t an organization with it’s own police force. It consists of cooperating police forces in each country. Suppose US police agencies in part were detailed to gather information of war crimes for the ICC. We, as a nation, would be unable to know what they were doing or what information they had gathered. Even the FBI wouldn’t have access to the “evidence”. What do you think? Am I wrong?

Absolutely....and more....Any American citizen can disappear and nothing can be done about it...

IMHO it's not too far fetched to think that by this time in 2011, lots of Freepers will be gone suddenly, ACORN members will be carrying credentials deputizing them as Interpol agents, and obamao's stated intention for forming a National Security Force will actually turn out to be a really clever Saul Alynski type UN rope-a-dope...

I think it is to prosecute Bush officials in International court system.. Andrew McCarthy wrote and article a while back on that subject.

You are correct, it is more are less reciprocity, sort of like diplomatic immunity. An executive order has no force our side of the federal government. States can still arrest and try these people if they break the law. But it sure gives the conspiracy nuts something to wear their tin foil hats over.

I never thought of that. Since Obama never explained this action I guess we will find out.

Obama is not stupid. Each action he has taken was well planned by those who have been around for awhile.

An executive order has no force our side of the federal government.

A law is only as powerful as the prosecutors want to make it. No matter how many laws on on the books, we now rule our selves by selective enforcement. Not the Obama's announcement that they would not pursue federal prosecution of illegal Pot growing in California.

England kept China under control for years with Opium, now I guess our considerable electoral votes will go to pot.
