Vt. Judge: Birth Mom Must Give Child To Ex-Partner

MONTPELIER, Vt. -- The birth mother of a 7-year-old Virginia girl must transfer custody of the child to the woman's former lesbian partner, a Vermont judge has ruled.
Vermont Family Court Judge William Cohen ordered Lisa Miller of Winchester, Va., to turn over daughter Isabella to Janet Jenkins of Fair Haven at 1 p.m. Friday at the Virginia home of Jenkins' parents.
Miller and Jenkins were joined in a Vermont civil union in 2000. Isabella was born to Miller through artificial insemination in 2002. The couple broke up in 2003, and Miller moved to Virginia, renounced homosexuality and became an evangelical Christian.
In the Dec. 22 order denying Miller's request to delay the transfer of Isabella, Cohen wrote: "It appears that Ms. Miller has ceased contact with her attorneys and disappeared with the minor child."
Liberty Counsel attorneys who have represented Miller in the past did not immediately respond to telephone messages left Tuesday by The Associated Press.
A listing for Lisa Miller in Winchester, Va., says the phone line has been temporarily disconnected at the customer's request.

So the birth mother (former lesbian) has to give up HER child to a lesbian and the Vermont and Virginia supreme courts both issued the same ruling? They say it’s like hetero where the husband gets custody. What a stretch. Does the fact that the birth mother carried this child have any effect on the ruling. Common sense????

The problem here is that Miller screwed up royally.
She entered into the Lesbian marriage.
She left the relationship.
She refused to abide by the court order allowing Jenkins visitation.
She fled with the child.
Miller was awarded custody. All she had to do was abide by the visitation ordered by the court.
Look, the judge didn’t set up this mess. The child is being removed from Miller, because Miller refused to follow the guidelines set down by the court and fled with the child.
No custodial parent gets away with that, if visitation has been granted to the non-custodial parent.
I don’t like Jenkins getting the child, but Miller is the one responsible for the outcome.
I thought that Virginia was exploring whether they had to make her honor an order from Vermont since she’s a non-resident.

The very short story leaves out some very relevant facts. For instance, does VT law allow for same-sex adoption? It probably does, which begs the question, did this "spousal partner" legally adopt her non-biological child? If she did, she's in a VERY strong legal position, a position that would likely be upheld on appeal. If she didn't, she still may have a strong position giving the VT homosexual marriage laws. I'm not familiar with VT, and I don't even know if such laws exist in VT.
But, to answer your specific question, even child protective services can't "transfer custody". That can only be done with a judge, utilizing the principles of due process. In all the states that I'm familiar, CPS may only temporarily remove a child from a parent's custody, FWIW.
Forget that its a lesbian couple. They took a child from a biological parent and awarded custody to a non-biological person. From what I’ve read there was no abuse by the mother.

Why would you laugh at a child being given to a person that it’s not related to and never bothered with the child until a “gay” organization told her to fight for custody. How is that funny? The child was in counseling because of court ordered/forced visits. Where’s the humor?
There is always room for forgiveness. Now, that the birth Mom is Christian and has irrevocably renounced the perverted homosexual lifestyle, why isn’t she being rewarded with the full and complete custody of her own child? This is a world gone mad. Why aren’t these judges simply sacked off the bench?

She takes the baby to deny the lesbian parent custody of the baby. That would of course get the FBI involved and then Ms. Miller would be looking at a kidnapping change and will be out of prison just in time for her child’s 25th birthday.
I don’t understand how the courts consider Jenkins a parent at all, since she has neither a biological nor an adoptive relationship with the child.
It happens every day in America in cases of children who are either born to a legally married couple, but that couple uses a surrogate or a sperm donor - in which case, either only one or even none of the legal parents are the biological parents.
Because the Virginia Supreme Court, ruled incredibly that the Vermont Court decision held sway & takes precedence over the Virginia court.
Our country is truly gone beserk, with the liberal dumb ass courts & dumb ass liberal politicians doing everything they can to destroy our country and our foundations of Christian, patriotic values & principles. I hope the mother realizes that the politically beserk courts will do all they can to promote the homosexual/lesbian agenda, and that she along with her daughter need to disappear & go into hiding.

The last article that I read stated the birth Mom did abide by the ordered visitation and that the child started having problems so Mom stopped the visitation. The lesbian filed for custody on the advice of a gay group. She’d not maintained any contact previous to that, no cards, no visits, no phone calls. The last I heard, it was being explored as to whether Virginia had to abide by a Vermonts court order.
Well, there is one option for this....we cannot speak such evil on this forum due to the VT. judge, so I won’t.

Typically, the way these couples arrange this is the birth mother is NOT the biological mother. They have the fertilized egg of one partner implanted in the other partner.

That makes it more complicated. Of course, this story - like so many legal stories - irritates me because it doesn't link to the relevant opinion by the judge. I'm curious what the relevant facts are, beyond the limited reporting, and the case and statutory law upon which the judge constructed his opinion.

Agreed. A relative of mine refused to show up for her court date to settle visitation issue. The abusive ex-hubby got custody, thought there was never any doubt had she shown up she would have gotten full custody. The courts frown on no-shows. One might as well slap the judge in the face
If that is indeed the case, there are a whole lot of Freepers on this thread who are making a good argument that the child should be with her "Biological" Mother, Ms. Miller.
