Illegal deer hunt proves costly (knife jack light hunter)

A 35-year-old Ocean Shores man must serve a year in jail for a misdemeanor hunting charge after allegations he helped chase down a deer with a car and kill it with a knife.

Deputy prosecutor Gordon Wright said James J. Breslin Jr. was sentenced to the maximum sentence of 365 days in county jail and about $3,200 in fines for unlawful hunting of big game.

“I’m satisfied with the outcome,” Wright said.

Judge Gordon Godfrey handed down the sentence Monday after Breslin pleaded guilty to the hunting charge, reduced from three felony hunting charges.

Wright said lost records alleging Breslin had a previous hunting conviction in King County prevented him from following through on the felony charges.

Wright said he had planned to pursue a six-month sentence on the felony charges, but recommended just 15 days in jail in the misdemeanor plea agreement.

“It’s more than I expected,” he said of the year-long sentence.

Court records say Breslin, with the help of other men, illegally killed several deer in late 2007 near Ocean Shores without a license. They allegedly left a knife near an elementary school and Breslin’s boss told authorities he later heard the men talking about the illegal hunt.

“The defendant was mad at one of the other individuals for leaving a knife behind the day after they chased the deer down, killed it with the knife and drug it from the lawn area to the parking lot for transportation home,” court records stated.

Wright said Breslin told the court the knife allegations were the result of workplace issues with his boss.

Court records stated investigators with the state Department of Fish & Wildlife analyzed animal DNA samples collected from the Ocean Shores school parking lot, Breslin’s van and his home.

“The results from the DNA testing is that all the DNA evidence from three locations were from the same deer,” court records stated.

Additional DNA testing identified the remains of seven separate deer in Breslin’s home, court records stated. Investigators found several recent photos of Breslin with deer, including one he sent to Washington Fishing & Hunting News magazine.

How much freaking time, money and energy went into prosecuting this guy? For an animal? That was probably butchered and eaten? With deer populations spiraling out of control almost everywhere in the Country? These people are idiots. I don’t like what he did too much, but a year in jail? Come on!

I sure am glad they spent all that money on DNA test and the money for keeping this guy in jail for a year for puting food on the table, and with a knife yet.Jees what is this country coming to and according to the DA, the charges and punishment was beacause he didn’t have a license, Patooey!

Just think in Washington if it had been a neighbor rather than a deer, he could have gotten probation.

A year for hitting a dear with your car on purpose? Do you realize how hard it is to make that happen under normal conditions?

The guy is an idiot, but this is not worth a year in jail.

Heck, I aim for squirrels and rabbits on the street in my own neighborhood.

Yeah. Can’t hunt deer at night. Can’t use lights to hunt deer. Can’t hunt deer with a knife. Can’t hunt deer with a motor vehicle. If you hit a deer with your car, unless you tag it you aren’t allowed to take it. Limit is usually one deer a year, sometimes you can get a doe tag, also. It sure ain’t seven, no make that a total of eight, deer in one year.
Have to have a license to hunt and a deer tag to hunt deer. Have to immediately tag your deer after you kill it. Story doesn’t say anything about that, though. Sounds like the guy is a market poacher. They frequently supply restaurants.

That is what our leftist governments do best. Spend our money with impunity and try to make everyone a criminal. That way they can make all of us fear them.

I know we need some hunting laws but did you notice that they reduced his charges from FELONY charges? Our worthless politicians are making everything a felony so they can automatically charge us with them then get us to cop to some trumped up misdemeanor charges. That way we get convicted and are criminals they can control. If we do not cop a plea then they go at us full force and we get some ""class" of felony and lose our right to own and carry arms. Soon most felons will get to vote because they mostly vote Dimocrat but they still can't have firearms.

No, I have NEVER been in trouble in any way except for a speeding ticket in the 1980s but I expect the Dims to create some more laws shortly to make me a criminal.

Not related to the above case and just a guess on my part, there will be several illegal deer kills by normally law abiding citizens who are hungry due to 0bama Economics.

Damn, here in Mississippi the spotlighters are revered as heroes, championship caliber hunters, and consummate sportsmen. We have local judges here that regularly spotlight deer and the LE just turn a blind eye to them. Politicians are also some of the prime spotlighters. There are workers at Caterpillar and major factories here that the entire workforce worship them for their spotlighting prowess.

Yup. I’ll bet that there are a hell of a lot more than an extra 115,000. Shoot, my neighbor had that many in his fields.
Venison, properly harvested and prepared, is pretty good. I prefer beef, but venison’d do.

I dunno. Even on FR from time to time we see stories of ex-flames being run down.

Deer, on the other hand, are a problem spring and fall in some places. Such as where I live. You watch the road carefully at dusk.
