Becker Goes Down (Scott Brown Voted NO! Alert)

The nomination of Craig Becker to the National Labor Relations Board was just defeated on a cloture vote 52-33. Sen. Ben Nelson (D., Neb.), Sen. Blanche Lincoln (D., Ark.), and Sen. Scott Brown (R., Mass.) all voted against cloture.

That only adds up to 85 votes.

Probably did a head count and when they lost Nelson, Blanche and the new kid on the block; cut the vote short to save embarrassment and pull the covers up over their exposed buttocks.

Mr. Becker has other ideas. In a 1993 Minnesota Law Review article, written when he was a UCLA professor, he explained that traditional notions of democracy should not apply in union elections. He wrote that employers should be barred from attending NLRB hearings about elections, and from challenging election results even amid evidence of union misconduct.

He believes elections should be removed from work sites and held on "neutral grounds," or via mail ballots. Employers should also be barred from "placing observers at the polls to challenge ballots."

More extraordinary, Mr. Becker advocated a new "body of campaign rules" that would severely limit the ability of employers to argue against unionization.

He argued that any meeting a company holds that involves a "captive audience" ought to be grounds for overturning an election. If a company wants to distribute leaflets that oppose the union, for example, Mr. Becker said it must allow union access to its private property to do the same.

Mr. Becker isn't clear about which of these rules can be implemented by NLRB fiat, and which would require an act of Congress, but his mindset is clear enough. He's willing to push NLRB discretion as far as possible to tilt today's labor rules in favor of easier unionization.

Nope, they moved the vote up to earlier in the day so the Senators who could make it in due to the weather could vote. Those remaining numbers likely reflect those who couldn't make it in.

Great news; save for mention of other option per recess appointment; which he may well do. . .That said; it will not be on our 'vote'.

(Dream scenario is that Obama is found 'illegitimate' - if only by 2012; whereby EVERY thing this man has done; signed. . .is undone; made null and void; and every appointment and signing that he invited/approved undone as well.

In a word; everything this man has done while empowered is ERASED. Oh well, best case scenario; but the stuff of dreams.)

That's what the Miami Herald article stated: "That procedural vote had been scheduled for Monday, but was postponed until Tuesday because of the mid-Atlantic snowstorm over the weekend.

Late Tuesday, as another snowstorm loomed, Senate officials moved the vote earlier in the day so the few senators who had been able to get to the Capitol could cast their votes and leave.

Storms movin' out, storms movin' in. That ought to tell them something about GW, doncha think? But, nah, Obummer has to appoint a new council to look into that...
