As the former legal director for the pro-abortion group NARAL, Johnsen argued in a brief to the U.S. Supreme Court that denying a pregnant woman the right to demand unrestricted abortion is to subject her to slavery, which was outlawed by the Thirteenth Amendment after the Civil War.

This siren of Hell needs to read the Fourteenth Amendment, esp. this part: "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Correct, the next Congress was seated in January, 2007 after the 2006 elections. If Obama makes a recess appointment now, the next Congress begins in January, 2011.

So the solution seems to be win the Senate (and the House), and then not ONE fothamucking recess appointment.

I understand this.The point I was trying to make was that if Hussein replaces one of the four Communists already on the court with a Communist that unborn baby will be no worse off than before.The *big* problem begins when he replaces one of the decent Justices currently serving with a Communist.

Obama is in a quandary regarding SCOTUS retirements. If Ginsburg and Stevens retire this year Obama will have to either nominate moderates or else watch the Senate go GOP in November. If they wait until 2011 to retire Obama will have to nominate moderates because there will be 48 GOP Senators and Obama won’t have the votes to confirm judges as liberal as Ginsburg or Stevens. And if they wait until after the 2012 elections to retire there may well be a Republican president and a Republican Senate, and their replacements would be of the Roberts or Alito types.

Obama could have gotten three liberals confirmed in 2009, but only Souter retired. It is entirely possible that SCOTUS will lean a bit more to the right overall after Obama’s first (and likely only) term. Nobody thought that possible back in November 2008.
