A single mother from Oakland has been discharged from the Army for refusing to leave her infant son behind to go to Afghanistan, but she will not be court-martialed, her attorney said Thursday.
Alexis Hutchinson, 21, had faced criminal charges at a court-martial for refusing to accompany her unit when it deployed in November. Although that is no longer a prospect, Hutchinson has been demoted from specialist to private and will lose all military and veteran benefits, said her attorney, Rae Sue Sussman of San Francisco.
She said Hutchinson had been given an other-than-honorable discharge.
In a statement, Hutchinson said she was "excited to know what will happen to me, and that I am not facing jail. This means I can still be with my son, which is the most important thing."
Hutchinson enlisted in the Army in 2007 straight out of Fremont High School in East Oakland. She was supposed to deploy overseas as a cook with her unit, the 3rd Infantry Division, on Nov. 5. She skipped the flight, she contended, because she had nobody to take care of her then-10-month-old son, Kamani.
Hutchinson told her commanding officers she had arranged for her mother to watch Kamani while she was away for her one-year tour of duty, but when that fell through at the last minute, she could find no alternative.
In January, the Army charged her with four court-martial counts. She could have spent up to two years behind bars had she been convicted of being absent without leave, missing a movement, dereliction of duty and insubordinate conduct toward a noncommissioned officer.

Single moms should not be in the military in the first place.
Finally, some good news for the single mother cook that wouldn’t deploy.
The Army has plenty of cooks. Raise your boy well.
I hope he survives growing up in Oakland.
Didn’t John Kerry get an “other than honorable” discharge?
This strikes me as a fair result in a very difficult case both for the Army and her. I also think, however, she will find that she has not exactly enhanced her resume by her behavior and she could have a very difficult time finding work in this recession.
Amen to that! I dunno if there’s any truth to the rumors that the military is being turned into a jobs/welfare program for unwed mothers but I’d like to know if anyone is out there tracking the stats and expenses.
I hate to sound un-PC but in most employment instances I’ve seen single mothers are not worth the trouble of hiring for most jobs. We could use an administration with the guts to discharge single women for that offense which was called in the ancient WAC-era “PWOP” (pregnant-without-permission).
Somehow I don’t think it will matter in Oakland.
“”...but she will not be court-martialed, her attorney said Thursday.
Alexis Hutchinson, 21, had faced criminal charges at a court-martial for ....””
did the same person write the first and second sentences?
What we need is an Army of women who will all come up pregnant when TSHTF
I would reserve judgment until I tasted her cooking.
The Army may have done our troops a big favor. ;-)
How did she come to be a single mom, not just a single?
Ladies in the service (and God bless the good ones) pose their own set of problems.
Can you imagine a division full of these folks in the Argonne as the Panzers come crashing through.
I guess some one “hit it”
She’s probably already interviewed with ACORN to be a supervisor. I am not on the same page as many on it “working out for her”. She made a commitment and reneiged and now wants “life without blame”. It is why this country has gone to the dogs.
ramen noodles w/ raw liver are her specialty
She’s missing the war to have her mother raise the bastard
Women, regardless of marital status, with young children should not be on active duty. Place them into the inactive reserves until all young’uns are 18.
This is a bunch of horsecrap. The Army needs to send a message and put her ass in jail. She’s lucky they didnt charge her with desertion. She knew she was deployable when she enlisted, and it aint the Army’s job to worry about childcare for her. How about all the single fathers out there, any of them refuse to deploy? Bet if they did, they would be in jail right now....
Well, yeah, obviously. Stune mah beeber.
Goofing around with enlisted men, already expecting when she signed on, something else? Could put a fillip on the story.
I’m bowled over. The comments for this story in SFChronic are indistinguishable in tone from the ones here. Things are a-changing.
Females were always a mistake in the armed forces and homos will be even a bigger one.
You mean they don't care about a bad service record - or there are no jobs anyway. :-))
She almost certainly thought having the kid would buy her immunity from deployment. It’s long been a given that women servicemembers have been routinely getting knocked up to get out of an overseas tour.
This is going to send out shockwaves. I only hope Obammy doesn’t put his oar in.
She may not, probably doesn't, understand, but there will be consequences to her.
Ugly ugly. Leave the baby out of it.
The kid is a bastard.....no nice language can remove the stain
Too much money wasted keeping her so long
You mean invite her and the Chief of Staff over to the White House for a beer, or would that be a malt liquor. (Oh, I shouldn't have said that.)
Not everyone in a particular unit is deployed. Why not have her be one of the ones that stays behind?
My bet is that she was not a single mom when she enlisted. This is a major, major problem with having women in the armed forces. There is a need to have people who can deploy and having a kid makes that a tough proposition.
I dunno.....I thought that when you serve in the military, you go where they tell you to go, you serve where you’re needed....you mean, they can say no, I’d rather stay home, send someone else?
Umm, how about no. This is the military, not some mickey mouse club. Giving some soldiers, marines, airman, or sailors preferential treatment doesn’t help morale so much.
1 rule that should be enforced without excpetion:
Each military dependent child must have one custodial parent who is not in any branch or component of the armed services.
Ensuring each child has at least one parent present MUST take priority and MUST NOT interfere with military operations. This can never be the case when both parents are subject to activation or deployment.
If you get a divorce or are widowed, you need to find a new career. The military is a war fighting machine, not a social services agency.
If this was the rule, then it would be very easy to accomodate the true exceptions when a soldier should not deploy because his spouse is in the hospital with cancer or some other unexpected catastrophy.
Not so much that she’s a single mom; she’s just an irresponsible person. Even if she wanted to have a child and be in the military too, she should have thought through the pros and cons and make the appropriate decisions. She should have been prepared for the possibility that she would be deployed (it wasn’t like it was a surprise) and should have made better arrangements for her child. Depending on her mother was kinda stupid.
And what about the baby’s father? Where is he in all of this?
21 years old...probably a product of our state run education system. Sure, the kiddies are indoctrinated about global warming, but they know nothing about the practical matters in life. More and more of our young are graduating from school with the intelligence of a turnip.
>”Ive seen single mothers are not worth the trouble of hiring for most jobs.”
As a retired First Sergeant, I can attest to that.
* Women who become pregnant to avoid undesirable service.
* Women who call RAPE after consensual sex (3 out of 4 rape investigations in 5 years resulted in this)
* Women who REFUSE to make arrangements concerning their deployments.
I have no sympathy for them.
Women will never be warriors.
You obviously don't know what the team concept is.
Agreed. OTH is a good solution here. She gets out, the Army avoids the headache and bad press of a court martial, the unit deploys minus one deadbeat that would have been nothing but a problem.
would a male be coddled so?
Having a bad service record would probably be regarded as a “badge of honor” in leftist Oakland.
A good chance she doesn’t know either.
No not for me. I don’t really feel the anger.
Sounds to me that she planned to go, but the bottom fell out at the last minute.
Her problem was taking matters into her own hands and missing movement. That is bad juju.
Had she gone to family services or even TDS, she may have learned other options. You can request a hardship discharge for example. There is more to this than we know, methinks.
The OTH is bad. They pack you up, put you outside the base, and say see-ya. And there is no unemployment or severance. But, most civilian employers don’t care about a DD214, so hopefully, that won’t affect her much.
BTW the Military is currently over manned and has a huge waiting list. If you are in and even sneeze the wrong way, they will put you out. They have nothing to lose. They have plenty of people.
Will she now become an Army of One?
Intentionally getting pregnant sounds like a self-injury to me.
But Top, You don’t understand.
She joined because of all the nice pictures and the promises of going to college, medical coverage and someone neglected -in 2007- to tell her there was a war going on and soldiers fight wars.
And since it was 2007, we can BLAME BUSH....
This madness is really getting ridiculous...can’t wait till the openly gay and females enter the Submarine Community.
That should make for some interesting times...
As a former JAG prosecutor, I agree wholeheartedly.
To put a fine point on it, in today’s politically correct Army, a woman who is engaged in consensual sex with a man can demand that he stop mid-thrust, and if he finishes that one thrust before pulling out, she will be taen seriously if she claims she was raped by virtue of that final half thrust.
I had to give sexual harassment briefings to the entire post twice a year. Much of the breifings were discussion of reducing the risk of being a victim. When I presented the data indicating that the most common factors among sexual assault victims were sexually suggestive behavior, sexually suggestive clothing, and intoxication, one butchy soldier complained that she had a right to act, dress and drink how and when she wanted.
I nodded in agreement as I explained that just as a soldier increases his risk of dying in a fatal accident caused by someone else by exercising his legal right to drive as fast as he wishes on the autobahn in Germany (where we were), so too does a woman increase her risk of being raped by someone else by exercising her legal right to dress and act like a drunken slut (I was a bit more diplomatic). Because the command cares about you, it will never stop presenting information for those who wish to take steps to reduce their risk of being a victim of fatal car accident or a rape.
Intentionally getting pregnant sounds like a self-injury to me.
Yes, I'm sure many women feel that way when they are giving birth. They're saying, "Why did I do this!?" ... LOL...
