Skip to comments.World’s biggest coal company brings U.S. government to court in climate fraud

The worlds largest private sector coal business, the Peabody Energy Company (PEC) has filed a mammoth 240-page Petition for Reconsideration, a full-blown legal challenge against the U.S. Environmental Protection Agency.
The petition must be answered and covers the entire body of leaked emails from Climategate as well as those other gate revelations including the frauds allegedly perpetrated under such sub-headings as Himalayan Glaciers, African Agricultural Production, Amazon Rain Forests, Melting Mountain Ice, Netherlands Below Sea Level as well as those much-publicized abuses of the peer-review literature and so called gray literature. These powerful litigants also draw attention to the proven criminal conduct by climate scientists in refusing to honor Freedom of Information law (FOIA) requests.
Peabody is, in effect, challenging the right of the current U.S. federal government to introduce cap and trade regulations by the back door. In this article we summarize Peabodys legal writ.
PEC has pulled out all the stops to overturn the EPA findings Endangerment and Cause or Contribute Findings for Greenhouse Gases under Section 202(a) of the Clean Air Act made on December 7, 2009.

This company may be doing this for it’s survival...but bravo to them anyway!
Bring on the popcorn....this is going to be interesting. Glad to hear someone is going to attempt to bring the truth to light.
Good luck.......the whole thing is a sham. Obama doesnt care at all.....more distractions for him to help hide his other agenda.
Wow, can’t wait to watch this unfold!
Awesome....Next up take Al Gore to court and sue him for every penny of his il gotten Climate Fraud gains....
The Gov’t fix is in for a “green judge”.
Good for them! Go Peabody Coal!
Pray for America’s Freedom from Gore
"but bravo to them anyway!" ???
If the company goes under, thousands of Americans lose their jobs.
This should be one “H” of an interesting event to keep tabs on, as I am certain it won’t be followed by the MSM.
Let the games begin!!!!!!!!!
First of many I hope.
This century is only nine years old, but this is the trial of the century.
Hey hey, Ho Ho
The F’ing EPA has got to go.
Hey f’n ho,
those idiots they really blow!!!!
Okay, sue me, my rhyme sucks but I hate the EPA.
Every time I pay my electric bill or buy a tank of
F’n gas it reminds me of those basterds.
A RICO suit against Gore would seem proper:
The is great, and every state should join Texas and Virginia in challenging the EPA BS in court.
Live long & prosper Peabody!
Confronting the climate bullies. Good stuff.
Bravo to them for fighting back. I'm not cheering for their failure...if that was your interpretation.
Eventually BO’s/BS’s regime will be slapped with more legal motinos than they can handle between lawsuits over the EPA usurping it’s Constitutional authority, BO’s/BS’s ineligibility and the grand jury presentments etc...
Put the wacky “carbon” scientists on the stand. Call out all those nuts in the IPCC finding and grill the hell out of them. They will crumble.
Way to jam it up there, Mr. Peabody!
I hope your are right. I wonder how many humongous lawsuits are in preparation even now. There should be thousands, and all with merit.
We have truth on our side. The CO2 rebellion has begun. Big energy corporations are talking to each other. This is how our side will nullify all attempted EPA rulings on CO2 and attempted Executive order end-runs on CO2 emissions the Obama people will take. They are going to court for years and will never be implemented
If they had truth on their side they would be implemented
I hope they run political ads on every station in every congressional district throughout the entire 2010 election.
What took em soo long?
I am glad to see them doing this.
PRAISE THE LORD AND PASS THE AMMUNITION! Keep this up mining companies. I might get my coal mined yet. Happy happy happy!
But what about the polar bears daddy?
“This company may be doing this for its survival...but bravo to them anyway!” This isn’t a good reason?
Wow. This is good news.
Algore’s carbon credits traded as high as $7 a year or so ago.
They now trade at 10 cents.
His company is in the tank.
Just rewards for a snake-oil salesman.
I might just have to get a coal stove for my house now.
I don't know who leaked those emails, but, may God bless them richly on all levels of there life.
Hummm,I wonder if a private citizen could join this suit because of financial damages? The EPA owes me big time for 45 years of poverty instead of wealth.
Finally - somebody challenging this tyrannical administration in the courts - hope they include in their presentation that tape of the tyrant-in-chief Obama gloating that he will get his way and “bankrupt the coal companies” in the process.......
It's a fine reason, but doing it because it's right is even better.
I sure as heck someone goes after him. He has played a huge roll in just about ruining our country. And he had shares in that scam of a company that people paid to cover up there pollution foot print or whatever they call that.
YeeeHaw!!!!!!!!!!!!!!! I’ve been waiting. The oil industry needs to follow.
So, you are telling us, that they having a loosing case?
What makes you an expert in this case?! Care to elaborate?
And daddy won’t you take me back to Muhlenberg County
Down by the Green River where Paradise lay
Well, I’m sorry my son, but you’re too late in asking
Mister Peabody’s coal train has hauled it away
- John Prine’s “Paradise”
As people like to say these days, this is taking it to a whole new level. Bravo!
Sue The Bastards!
It’s not that bad!
So what does McLame, Grahmnesty, Gore and every freakin’ Democrat have to say for themselves? Each of these treasonous pricks were finding a way to steal money.
A better question. Will the Republicans go on attack?
I DIDN’T THINK SO!!!!!!!
