Wyoming Firearms Freedom Act-2 Passes Senate

Wyoming – -(AmmoLand.com)- HB-95 Wyoming Firearms Freedom Act-2 passes Senate second reading.

Although it has been attacked by anti-gun Senators pandering to the Anti-Gun Police Union, it still has “Teeth”.

HB-95 needs to endure a third reading and then it will require the Governor’s approval. This legislation must move forward without any more attacks on the language or it will become a mere “Resolution” with “Pulled Teeth”.

To encourage the Senators to move the bill forward call (307) 777-8683

Also call the Governor’s Office at (307) 777-7434

Tell them to pass HB-95 without any further adulteration of the legislation.

This is working it’s way through the state senate here in Arizona. With MT and UT having already passed this, if both AZ and WY do as well, the mountain states would form a contiguous fence against tyranny from Canada to Mexico!

For those of you not up on HB-95, the 'Wyoming Firearms Freedom Act', it's legislation asserting that firearms made, sold and kept only in Wyoming are exempt from all federal gun laws. Patterned after Montana's laws, unsurprisingly.

I’m cautiously optimistic. The real test will be the first Supreme Court challenge. This could be a huge precedent for a large number of federal laws that congress passed under the interstate commerce limitations.

I’m betting that the proposed legislation specifically does NOT include full autos or anything else regulated by the NFA - true or not?

I suppose that this is good, but only in the sense that a federal challenge that only involved non-NFA items would be easier to withstand, and that later a logical extension of the prior legislation would be easier for the federal courts to swallow.

And the unique feature of the Wyoming law (and the New Hampshire version as well), as opposed to the other states where this has been passed, is that it makes it a crime for an employee or agent of the federal government to attempt to enforce Federal laws or regulations this law says are invalid in the state. That’s important, otherwise the state is saying to its citizens “Look, we think the feds are overstepping with these laws, and you’re not in any trouble with us if you break them. But...if the same people who’ve always been charged with enforcing those federal laws keep doing the stuff we’ve just said they shouldn’t do, we’re not going to do anything to them or try to stop them.”

Well, yes and no. SCOTUS is part of the federal government. If they find for the federal government and against someone else, their ruling might be considered suspect for conflict of interest. Normally a judge in a case must not be connected with one of the parties.

Good question. I googled up "Wyoming Firearms Freedom Act-2" and found the text of the bill in PDF:

Reading it, it doesn't say one way or another. Not that I saw, anyway.
