If the House uses the Slaughter Rule to advance the Senate bill, Landmark Legal Foundation and Mark will, in fact, bring a federal lawsuit in the District of Columbia challenging its constitutionality.

I wonder if they could get an injunction halting the implementation of the law pending litigation of the Constitutionality of passage.

It's a shame that a Conservative Radio Talk Show host has to do what the GOP Members of Congress can't or won't do. If this goes to the Supreme Court, I hope the Justices are still pissed for being dissed by Obama at the State of the Union speech. They are human you know....they are NOT supreme.

The Court will take the case. It has to. It’s what the Court does with the case that matters.
The real fight on this case is up front, when Levin seeks a preliminary injunction barring the government from implementing any part of this bill. If the government wins the injunction, it then goes into a stall tactic to delay a Court ruling. Say, three or four years. By then, there has been so much bureaucracy built up around the legislation there is no way a court would overturn it. No matter how blatantly unconstitutional it is.

I would think if a bill is passed in the House without a vote, the challenge is that we have a Congress that ignores one person - one vote. In other words, why bother to send representatives to Congress when only the Speaker gets to decide what becomes a law and what doesn’t?

Levin is the one talk show host I listen to because he understands how Congress works or should work.
