Court: Anna Nicole Smith gets none of oil fortune

SAN FRANCISCO – A federal appeals court says Anna Nicole Smith's estate will receive none of the more than $300 million that she claimed her late billionaire husband had promised her.

The 9th U.S. Circuit Court of Appeals is the latest stop in the 15-year legal battle over the $1.6 billion estate that oil magnate J. Howard Marshall left after his 1995 death at age 90.

Smith had married Marshall the previous year and argued that he meant to leave her more than $300 million.

A Texas state court ruled against Smith and in favor of Marshall's son, who argued the model should receive nothing.

Okay so he was fifty or so years older than her, she marries him, and we’re supposed to believe that he didn’t intend to leave her big dollars? Judge Judy could have knocked this case out in 10 minutes.

In a lot of States you can’t disinherit your spouse. If one leaves a will and cuts their spouse out, the spouse can still take a heafty chunk. (50% here in Indiana). Guess Texas doesn’t have that rule.

HAHAHA. I’m listening to The Testament by John Grisham right now. It is fascinating how, when a lot of money is at stake, what is clear and plain, once scrutinized by attorneys, suddenly becomes blurry. But reason seems to have prevailed in this case.

Texas is a community property state. The property accumulated (except by gift, or inheritance) during the marriage is jointly owned, and the surviving spouse is entitle to their cut. Property held since before the marriage, on the other hand, is separate, and the surviving spouse need not get a share.

Weren't they married three years? I'd guess that three years interest, profits and capital gains on a billion dollar portfolio is still a pretty good chunk of change.

Not but one other stop and that’s SCOTUS should the appeal be made and SCOTUS decides to hear it, correct?

Drugs, deaths by drugs, doctors facing charges now, and who knows what else.

He had another son, Howard, who was left out of his will. Like he and Anna’s daughter couldn’t be given a tiny bit of his estate, which is repordedly worth $1.6 billion. E.Pierce Marshall’s widow has fought for it all.

That little girl is a doll. Her father even moved from Hollywood to Kentucky to give her a “normal” life. I think that’s where he grew up and where his family is.
