Proposed Missouri constitutional amendment would prevent federal health insurance mandate

Missourians who oppose the current health care legislation proposed by democrats may want to keep an eye on an interesting piece of legislation in their own state, a bill called HJR48, or House Joint Resolution 48. Also called the “Missouri Health Care Freedom Act,” HJR48 intends to make it part of state policy that every individual in Missouri has the right to choose or decline any form of health care services without penalty or the threat of penalty from the U.S. federal government. This would prevent Missouri citizens from being subject to fines or other penalties if they choose not to participate in a particular type of health care or insurance.

Yes!

I believe there are over 30 States that are passing such Bills.

I think there is like 37 or so states which have pending nullification bills. Wonder how many of these state governors have been meeting on the sly to discuss options.

If they can force $15,000 out of your pocket for their preferred product, what's to stop them from forcing every single dollar of yours to their pet preference?

Yes, this individual mandate asserts federal ownership of the individual citizen. No one can force you to purchase anything, UNLESS they have a right of ownership over your person. This is clearly an assertion of a relationship of servitude under the federal government.

This is worthless, unless the people of the State of Missouri are willing to stand up to the Federal government when it retaliates. This type of legislation is all hat, no cowboy, unless the state will push back.

The federal government will threaten to cut off money in the form of appropriations. Unless the state is willing to withhold ALL tax receipts that would normally go to Washington socialism is inevitable.

Personally, our state would be better off if we did it anyway. Keep Missourian’s money in Missouri.

While I suppose that the states taking action is better than them doing nothing, I have my doubts about how effective it will be. The IRS will be enforcing this, they are not going to give a rats a@@ what state laws are when they issure their fines and use all their power to collect them. Can the states prevent them from garnishing wages, putting liens on property or seizing bank account? I doubt it, since all these things are done through federal courts.

I hope so, too, but I don’t know if our Democratic Governor (Jay Nixon) will support this.

The Supreme Court of the United States stomps on state laws and constitutions as if they were dog cr@p. At least a couple of Scotus judges have stated that foreign laws, say from Nigeria, should be considered in their deliberations.

Why should the Scotus be respected or obeyed?

Thanks dynachrome! The best site I've been able to locate for tracking and assimilating information on the "Healthcare Freedom Act" is the TENTH AMENDMENT CENTER. Site owner Michael Boldin, amongst others, is doing yeoman's work in keeping up with State initiatives against our out of control feral government.

On threads that are duplicates or cover essentially tilled ground, I still try to tag them with "10thamendment" and "statesrights" keywords for future reference.

It’s just the beginning - and the warning shot. If an amendment comes out of this and/or the SCOTUS declares it is indeed unconstitutional, it won’t matter what “power” the IRS thinks it has: no law = no right to levy fines or taxes for that law.
