ORLANDO, FL -- Moments after Congress voted to approve President Obama's health care legislation, Florida's Attorney General announced he will file a lawsuit to declare the bill unconstitutional.
Bill McCollum will join Attorneys General from South Carolina, Nebraska, Texas, Utah, Pennsylvania, Washington, North Dakota and South Dakota to file a lawsuit against the federal government.
"The health care reform legislation passed by the U. S. House of Representatives this evening clearly violates the U.S. Constitution and infringes on each state's sovereignty," McCollum said in a statement distributed late Sunday night.
"If the President signs this bill into law, we will file a lawsuit to protect the rights and the interests of American citizens."
McCollum will hold a press conference at his Orlando office Monday morning to discuss his plans.

Nothing is going to happen. The courts will simply dismiss it saying federal law trumps state law.

Just as in 1776 and 1860 the real resistant to tyrannical government come from the several states.
The only way this will have any teeth, is if the states refuse to abide by it when the courts throw out the lawsuit.
This SC has done big things in regards to the 2nd amendment and campain finance. I suspect they will address at least some of this bill. They actually seem to be using the Constitution in their recent decisons.
The federal unemployment law, is a lot lower than a host of states, but the states higher unemployment prevails..why does not the federal law trump this I wonder..

After the U.S. House’s historic vote Sunday night passing the health care reform bill, South Carolina Attorney General Henry McMaster issued the following statement:
“The health care legislation Congress passed tonight is an assault against the Constitution of the United States. It contains various provisions and federal mandates that are clearly unconstitutional and must not be allowed to stand.
A legal challenge by the States appears to be the only hope of protecting the American people from this unprecedented attack on our system of government. The key question involved is whether personal freedom, state sovereignty and constitutional law will survive in America for future generations.
As attorney general for the State of South Carolina, I have sworn an oath to uphold and defend both our state and federal constitutions. I therefore intend to join with Florida Attorney General Bill McCollum in challenging the constitutionality of this profoundly unwise legislation. We will take our case to the United States Supreme Court if necessary.
After an extensive conference call tonight, I am optimistic that the attorneys general of Texas, Nebraska, Utah, North Dakota, South Dakota, Washington, Pennsylvania, Oklahoma and Alabama will be joining this effort as well.”
I know it's been a day of bad news but I beg to differ. If enough states band together, the Federal government can't just ignore them. The real test hasn't even begun yet.
On the positive side, the Democrats have outed themselves as the new Communist party, and will be crushed at the polls accordingly. There are enough people out there who recognize this healthcare bill is unconstitutional, and won't just accept it as a done deal.

If the courts say no them convince 3/4 of the states to amend the Constitution. If liberal states wanted this they would have done what mass did.

I know how you feel. Our only hope is for an uprising. Maybe it will start with the state AG’s. If it’s thrown out by the courts or they lose because of liberal judges, maybe then secession will be seriously considered. I’d love to see that and see all the insurance companies leave Connecticut and move to Texas! Let the states that stay have obamacare. We’ll stick with what we got.

As Attorney General, Bills other priorities have included consumer protection; combating Medicaid fraud; improving the states security against terrorist threats; and fighting crimes against the elderly, especially identity theft.
Bill McCollum is a native Floridian, born in Brooksville. He graduated from Hernando High School and earned his bachelors and law degrees from the University of Florida.
After graduating from law school, Bill served on active duty in the U.S. Navy from 1969-1972. In 1992 he retired from the Naval Reserve as a Commander having served 23 years as an officer in the Judge Advocate Generals Corps (JAG).
From 1981 to 2001 Bill represented the people of Central Florida in the United States Congress. Federal law does NOT trump state law if the federal law is fatally unconstitutional, which the personal mandate IS IMO. One way or another the SCOTUS will rule whether the personal mandate is Consitutional, and it’s not.
