ObamaCare Faces First Big Test Friday

Tomorrow is the deadline for state governments to decide if they will participate in the national high-risk pool set up under ObamaCare.

But as the head of the conservative Galen Institute, Grace-Marie Turner, explains, there is a problem:

The high-risk program is essentially insurance for individuals who have pre-existing conditions and are expensive to insure. The new health law allocates $5 billion for insuring them until 2014 when enrollees would be transferred to new health-insurance exchanges. But Richard Foster, chief actuary of the Centers for Medicare and Medicaid Services, reported last week that the high-risk program will run out of money

I’m starting to see everything that this administration does as a manufactured “crisis.” Obama opens his mouth and the wheels set in motion to transform things without a finger being lifted.

The content is irrelevant. Any federal version of Obamacare is unconstitutional since Article 1 Section 8 does not specifically grant Congress the power to regulate health care. The people are not bound by an unconstitutional act.

People can join a class action lawsuit against the unconstitutional, socialist Obamacare at www.obamacareclassaction.com

Pennsylvania has said that it is in. Georgia, Nebraska, Nevada, and Louisiana have said they are out. Texas wants more time.

That isn’t the only hitch in the national high-risk pool. About 35 states already have some form of high-risk pool, but people who are in those pools are not eligible for the national high-risk pool because to qualify for the national one a person must have been uninsured for at least the last six months.

Uh oh! Catch 22. (The first of many more to come, I'm sure.)

Sadly, no Representative or Senator would have the sack to bring up these charges lest they be immediately targeted for a one car accident a la Vince Foster.

He CAN say that as far as he is concerned, he wants no part of it and will encourage the legislature to reject it. Instead, I suspect he is just lying low.

Governor Gibbons here in Nevada has opted this state out of this mess. Says the funds from Washington don’t come close to paying for HELLth care in Nevada.

There are those things called special sessions. Perry can call a special session for a single topic, but won't and shouldn't do so if it's not a time-critical issue. He's called special sessions in the past.
