White House bristles at mention of Elena Kagan’s sexuality

Top White House officials bristled Monday when asked whether they think Supreme Court nominee Elena Kagan’s sexuality will become an issue in her confirmation hearings.

“It’s not anything I’m going to get into,” said White House press secretary Robert Gibbs, speaking to reporters in his West Wing office.

Gibbs was asked a handful of times about rumors that Kagan is gay, and gave terse responses each time.

Asked why the White House pushed back so aggressively when CBS News published a piece on its website (CBS appears to have pulled the piece) that said Kagan, if confirmed, would be the country’s “first openly gay justice,” Gibbs said it was not an issue to the president.

“We are going to defend the nominee that the president has chosen,” Gibbs said when asked if he thinks the rumors will be brought up during the confirmation process.

When asked what the White House was defending Kagan from, Gibbs said: “That’s just a broad answer.”

“I’m just not going to get into somebody who is doing what that person was doing on CBS’s website. This is about who she is going to be as a justice,” Gibbs said.

Ron Klain, chief counsel to the vice president and a key figure in the White House legal team, said: “Elena went through the same vet that everyone else goes through for the Supreme Court is all I’ll say.”

On a separate issue, Klain said that the administration will not immediately release memos written by Kagan when she worked at the White House under President Bill Clinton.

“I’m sure the committee will request those papers and we’ll reach an accommodation with the Clinton Library on that,” Klain said. “We’ve got to see what the committee wants to see and we’ll go from there.”

Obama should pick a SCOTUS nominee who is a transgender Muslim who can’t speak English. That would be perfect.

I figured he’s either secret coding SEIU or the gay community with that lovely lavender tie—since there’s RUMORS about Kagan (just RUMORS, dadgumit, there’s absolutely NO proof she’s ‘playing for the other team’!!! Despite all those facts about her ‘significant other’!) I’m guessing the latter? ;-)

Yeah, I'd be happy with a Conservative landslide in 2010 and BO as a virtual lame duck (and a presidential loser) in 2012.

But, I gotta say, that won't happen. BO's legacy *must* be protected, at all costs. Can't have "The First Black One-Term Presidential Failure". So - IMHO - if it starts to look like he's going to fall flat on his face, I'd give it about a 1 in 3 chance for him to "decline to run for re-election" based on "Health Problems", or somesuch.

If Hillary! gets out of her SoS job before November of this year (so that she doesn't get splattered by the epic failure of the Dems) ... I'd up the chances of my scenario to 60-40 or better.

A lot depends on whether his ego will let him step aside, or not. I think that I'd rather retire a beloved leader (ok, he's not on FR, but in some places...) than stick around 2 or 3 years longer than necessary and get savaged like Bush did.

And Bush, for all of his faults, still did a fair amount of things right.... the press would have a field day with BO, especially if he gets elected to a 2nd term and they don't need to cover for him anymore.

Just my opinion.

Bush 41 gave us Souter, Obama gives us Kagan (and the wise latina appears to swing the same way as well). Focus on Kagan’s radicalism and lack of preparedness for the job. The lesbianism issue will backfire - all the left needs to do is remind everyone of Souter. They have no problem outing him now that he is of no use to them except for propaganda purposes. She is a radical of the first order and that is enough to reject her. This other stuff only justifies what the left says about all conservatives and it is not effective.
