A Hate Crimes Approach to Illegal Immigration

During the healthcare reform debate, many Democrats, liberals and other supporters of the law compared the mandate to carry health insurance to similar mandates for having automobile insurance. The Arizona anti-illegal immigration law has a similar analogy to an automobile provision. In many states, including Indiana and Kentucky, police officers can cite drivers for seatbelt violations, but only after they have stopped those drivers for committing another driving offense first. Officers cannot pull drivers over simply for noticing that they and/or their passengers are not wearing seatbelts.

The seatbelt violation then becomes an additional charge on top of the initial offense. That is the same situation that occurs with the new Arizona law. There is an initial offense that must occur before the law enforcement officials can pursue whether or not the suspects are also in the country illegally. If that determination is made, then the suspects may face jail time, fines or deportation on top of the penalties for their initial offenses.

However, there is a big reason why the seatbelt analogy does not fully apply to the anti-illegal immigration issue. For the most part, failing to wear a seatbelt only causes potential additional harm to one’s self. But in focusing on the drivers, the additional harm is relegated only to themselves. When it comes to illegal immigrants though, their criminal acts cause harm and create burdens to others.

Therefore, to deal with illegal immigrants using a seatbelt rule is not enough. Instead, they should be dealt with by using more of a hate crimes approach to their criminal activities. As is well-known, law enforcement officials may pursue ‘enhanced penalties’ for persons convicted of creating a hate crime.

Therefore, to deal with illegal immigrants using a seatbelt rule is not enough. Anothe care of being above the law.
