Special counsel is now unlikely in Sestak's White House job investigation

Don’t expect the flap over an alleged job offer the White House made to U.S. Rep. Joseph Sestak, D-7, of Edgmont to let up any time soon.

Sestak, the Democratic candidate for U.S. Sen. Arlen Specter’s seat in the November mid-term election, told veteran reporter Larry Kane in February that the offer came last July — with the caveat that Sestak bow out of the Senate primary.

At the time of the alleged offer, Specter was a newly minted Democrat and was running for a sixth term with the full backing of President Barack Obama. After Sestak won the primary election, that support has now swung his way.

But Sestak’s disclosure of the alleged job offer caused an immediate stir from the other side of the aisle, which hasn’t abated.

U.S. Rep. Darrell Issa, R-Calif., fired off a series of letters in March and April to White House Counsel Gary Bauer seeking answers, and to Attorney General Eric Holder asking that a special counsel be appointed to investigate the claim.

Issa pointed to a federal statute that bars federal employees from using “official authority for the purpose of interfering with, or affecting, the nomination or the election of any candidate” to the U.S. Senate and other seats. Such a violation could carry a fine or imprisonment of up to a year, according to the statute.

A response letter from the U.S. Department of Justice Tuesday indicated it is unlikely that counsel will be appointed.

“The Department of Justice … has a long history of handling investigations of high-level officials professionally and independently, without the need to appoint special counsel,” the letter reads.

Judge Andrew Napolitano just mentioned how this deal goes down. If Sestak was in Pennsylvania during the bribe, that violates Pennsylvania law and the Attorney General can investigate. The same thing if the perp was in Virginia.

Also, this all depends on what happens in November. If the Republicans win a majority, they also win subpoena power!

Rumor in Washington is that the president is truly frightened over this likelihood (and he should be)!

Do not put much faith in Napalitano... he has been wrong with his critique more than once... he is more of a celebrity hack that was once a NJ justice. Outside of the confusion of NJ law... he is below average. Not much there IMHO.
