Skip to comments.Senator: BP criminal case is essentially proven
Posted on 06/08/2010 9:35:38 AM PDT by Nachum
The criminal case against oil giant BP has essentially been proven and investigators should be determining how harshly it will be penalized, Sen. Sheldon Whitehouse said Tuesday.
Whitehouse (D-R.I.) a former U.S. Attorney who successfully prosecuted the North Cape oil spill in 1997 said that BP "absolutely" broke the law for the Deepwater Horizon oil spill in the Gulf of Mexico.
"It's pretty much agreed they did that. It's only a misdemeanor statute, but it provides for at least the avenue of criminal prosecution and that leads to potential criminal fines, potential criminal restitution to individual parties who are harmed," he said on CNBC. "So I think it's almost a lay-down hand as a criminal case at this point and the issue really is going to be about penalties and damages."

So, the Justice Dept. is gonna spend millions and millions to get a misdemeanor charge proven ?
Guilty, now lets have a trial. A very public one where the good Senator can get some green face time.
Unless they want to limit the penalty to under $25, BP's operators have the right to a jury trial.
Oh yeah, like I’m going to believe a dim-bulb-crat “public servant”.
Wonder which marshallow education he bought and from which cereal box he saw it on.
And when will we go after the government employees who decided that all the required paperwork didn’t need to be done prior to sinking the well? I’m not holding my breath.
`Let the jury consider their verdict,’ the King said, for about the twentieth time that day.
`No, no!’ said the Queen. `Sentence first—verdict afterwards.’
`Stuff and nonsense!’ said Alice loudly. `The idea of having the sentence first!’
`Hold your tongue!’ said the Queen, turning purple.
`I won’t!’ said Alice.
`Off with her head!’ the Queen shouted at the top of her voice. Nobody moved.
`Who cares for you?’ said Alice, (she had grown to her full size by this time.) `You’re nothing but a pack of cards!’
WOW - Guilty before charges are even set forth.
Welcome to SOVIET-America
let’s just do away with jury trials and let members of Congress determine guilt/innocence via Press Conference...
Phase 1 of the Obamarrhoid’s and ‘Rats plan to nationalize the petroleum industry.
As the Men’s Warehouse guy says: “I guarantee it.”
Makes me wonder though what sort of discoveries BP’s defense lawyers can make and how public the trial will be.
The only criminals in this case are environmentalists and their communist sypathizers in government, forcing us to drill not on land, not even in shallow water, but in highly risky, deep water.
Never let a crisis go to waste, and the more crises, the better.
The headline should read:

If Americans held Congress monetarily liable for their own criminal malfeasance, everyone would be rich.
Makes me wonder if Senator Sheldon Whitehouse will be told to shut up.
I wish a lot of senators would shut up and go away, but wishing does not make it so.
Well, it looks like someone found someone’s ass to kick.
Sounds like Alice in Wonderland. Sentence first, trial later.
Very good compilation. Hope you don’t mind if I spread it around a little...
First, we know Sheldon is a total douche. However, if this BP case is proven then why haven’t they moved on the White House with impeachment? It seems there are far more credible cases there.
No need for a trial. No need for a defense. Constitution? What Constitution! Let's simply move directly to the execution and let's make sure it is done by November 2.
Do these liberals know how truly stupid and vapid they sound?
Can’t wait til these guys start rolling over on obama and his thugs...
It’s only criminal if a Democrat says so?
Obama’s a criminal and Holder does nothing because Republicans say so.
Therefore, we can safely conclude that this is all for show, to get Obama’s approval ratings out of the tank.
Actually it was his low approval ratings that killed the catfish that rolled up on the Gulf Beaches last week.
Is this like Settled Science?
Sue them now... that ought to fix the leak. ;-)
Looks like the MMS was more mindful of political contributions than they were for the environment.
And Senator, how about those gushers over at Fannie and Freddie, spewing out loans to people who cannot repay them. Isn't that criminal?
If I had my way, I would march all these Senators and Congressmen off to the hoosegow and sort it out over the next years who was actually guilty of malfeasance.
The biggest oil slick of all, while we talk about criminals.
It was a sweet deal, MMS waivers for campaign cash, while it lasted.
Rahm, the ballet dancer, lives in a BP Advisor’s APARTMENT???? WHO is it??? OMG!!
Why bother with a trial, this guy already has investigated, charged, and convicted BP.
Ha! I may borrow that. :)
I have feeling this is one case the government is going to regret moving forward to trial. BP will present evidence that they were in compliance and even received a safety award. What crime has been broken??
I also assume that the Obama administration officials who signed off on the safety inspections of the rig will be prosecuted also...(crickets).
I further assume that the counter-productive ban on shallow water and land-based drilling in Alaska etc will be lifted immediately, as it benefits no one but the Saudis...(crickets).
I finally assume that Barry will now do everything to assist the Republican governors, especially Jindal in LA, to contain the shoreline effects of the spill...(crickets).
I used to work for an oil company in the supply and distribution department. The rules and laws they operate under are so complex that it will not be difficult to find many points of non-compliance. The bureaucratic controls put in place by the EPA and OSHA alone are enough to guarantee that a Chicago style inspection will result in violations.
Every dime spent on lawyers is money that cant be used to help the real victims. But what does Sheldon Whitehouse care. Helping real victims doesnt get his mug on the tube like demanding criminal prosecution does.
“I think it’s almost a lay-down hand as a criminal case at this point and the issue really is going to be about penalties and damages.”
Wow! Would that Congress would move so swiftly to declare a legal violation in the Sestak and Romanoff cases. These 2 would appear to be “lay-down hands” regarding the criminal behavior involved.
I’m not arguing to bypass proper legal procedures. But if it’s so “obvious” that laws have been broken in BP’s case, then surely it is equally evident that laws were broken when positions were offered (and unlike the BP case, the parties involved essentially have admitted the very actions that everyone can see violate the law).
White House is famous for his blanket denials of applications for a Rhode Island concealed carry license, saying, “no one should have a gun except the police.” He makes Pelosi look like a conservative.
Amazing post...bookmarking for future reference....Thanks!
Ha! Love that second cartoon!
regulations matter little when bribes overide what should be done ...
“When buying and selling are controlled by legislation, the first things to be bought and sold are legislators.” — P.J. O’ROURKE
Oil companies giving campaign contributions for MMS waivers. Boy is that going to be a big story.
But by and large, even the NY Times says massive regulations failure.
