Senator: BP criminal case is essentially proven
the hill ^ | 6/8/10 | Jordan Fabian

Posted on 06/08/2010 9:35:38 AM PDT by Nachum

The criminal case against oil giant BP has essentially been proven and investigators should be determining how harshly it will be penalized, Sen. Sheldon Whitehouse said Tuesday.

Whitehouse (D-R.I.) — a former U.S. Attorney who successfully prosecuted the North Cape oil spill in 1997 — said that BP "absolutely" broke the law for the Deepwater Horizon oil spill in the Gulf of Mexico.

"It's pretty much agreed they did that. It's only a misdemeanor statute, but it provides for at least the avenue of criminal prosecution and that leads to potential criminal fines, potential criminal restitution to individual parties who are harmed," he said on CNBC. "So I think it's almost a lay-down hand as a criminal case at this point and the issue really is going to be about penalties and damages."

Guilty, now lets have a trial. A very public one where the good Senator can get some green face time.

The criminal case against oil giant BP has essentially been proven...

Unless they want to limit the penalty to under $25, BP's operators have the right to a jury trial.

`Let the jury consider their verdict,’ the King said, for about the twentieth time that day.

`No, no!’ said the Queen. `Sentence first—verdict afterwards.’

`Stuff and nonsense!’ said Alice loudly. `The idea of having the sentence first!’

`Hold your tongue!’ said the Queen, turning purple.

`I won’t!’ said Alice.

`Off with her head!’ the Queen shouted at the top of her voice. Nobody moved.

`Who cares for you?’ said Alice, (she had grown to her full size by this time.) `You’re nothing but a pack of cards!’

No need for a trial. No need for a defense. Constitution? What Constitution! Let's simply move directly to the execution and let's make sure it is done by November 2.

It’s only criminal if a Democrat says so?

Obama’s a criminal and Holder does nothing because Republicans say so.

Therefore, we can safely conclude that this is all for show, to get Obama’s approval ratings out of the tank.

Actually it was his low approval ratings that killed the catfish that rolled up on the Gulf Beaches last week.

WOW, another Senator gushing forth ... and how about this Senator? U.S. exempted BP's Gulf of Mexico drilling from environmental impact study April 2009 was the date for the exemption ... A failure to regulate, why is that never found to be government's fault.

Looks like the MMS was more mindful of political contributions than they were for the environment.

And Senator, how about those gushers over at Fannie and Freddie, spewing out loans to people who cannot repay them. Isn't that criminal?

If I had my way, I would march all these Senators and Congressmen off to the hoosegow and sort it out over the next years who was actually guilty of malfeasance.

The biggest oil slick of all, while we talk about criminals.

It was a sweet deal, MMS waivers for campaign cash, while it lasted.

I have feeling this is one case the government is going to regret moving forward to trial. BP will present evidence that they were in compliance and even received a safety award. What crime has been broken??

I assume this means Barry will be returning the $1M in BP campaign contributions, pronto...(crickets).

I also assume that the Obama administration officials who signed off on the safety inspections of the rig will be prosecuted also...(crickets).

I further assume that the counter-productive ban on shallow water and land-based drilling in Alaska etc will be lifted immediately, as it benefits no one but the Saudis...(crickets).

I finally assume that Barry will now do everything to assist the Republican governors, especially Jindal in LA, to contain the shoreline effects of the spill...(crickets).

I used to work for an oil company in the supply and distribution department. The rules and laws they operate under are so complex that it will not be difficult to find many points of non-compliance. The bureaucratic controls put in place by the EPA and OSHA alone are enough to guarantee that a Chicago style inspection will result in violations.

“I think it’s almost a lay-down hand as a criminal case at this point and the issue really is going to be about penalties and damages.”

Wow! Would that Congress would move so swiftly to declare a legal violation in the Sestak and Romanoff cases. These 2 would appear to be “lay-down hands” regarding the criminal behavior involved.

I’m not arguing to bypass proper legal procedures. But if it’s so “obvious” that laws have been broken in BP’s case, then surely it is equally evident that laws were broken when positions were offered (and unlike the BP case, the parties involved essentially have admitted the very actions that everyone can see violate the law).
