McDonald’s vs. mac and cheese
ajc.com ^ | 6-10-10 | by John Kessler

Posted on 06/10/2010 10:01:57 AM PDT by rawhide

A pair of San Francisco Bay Area restaurateurs were all set to open their macaroni and cheese specialty restaurant with the name Little Mac when a phone conversation with legal counsel for McDonald’s derailed their plans. It seems the burger giant doesn’t take kindly to restaurants that use “Mac” or “Mc” in their names, citing brand infringement.

Rather than fight, the mac and cheese entrepreneurs, Erin Wade and Alison Arevalo, have put a call out for help in finding a new name.

Mac and chesse was one of Ronald Reagan’s favorite food. It is also one of mine. Particularly when the Mrs. is away for a few days. I use lots of variations like Tabasco, cloves, chopped onions and even sardines in chili sauce to spice it up.

I thought this was going to be a comparison of fat/calories in a kids meal at McDonalds vs. a meal with mac and cheese at home. I was wrong

I see Big Mac, Mac, Lil Mac (women's lingerie), Mac Daddy, Mac Rack, and so on. But I sure don't see where McDonald's Corporation has a trademark on the term "Mac"

I am reminded of McDonald's vain attempt to defend the name "McDonald" as a trademark in Scotland. The Laird McDonald threatened to forbid them from using his name in Scotland if they continued harassing businesses owned by other members of the Clan McDonald for using the family name. I think it was a stand selling sausages that was at issue.

McDowell’s? I know that place!

“Cleo McDowell: Look... me and the McDonald’s people got this little misunderstanding. See, they’re McDonald’s... I’m McDowell’s. They got the Golden Arches, mine is the Golden Arcs. They got the Big Mac, I got the Big Mick. We both got two all-beef patties, special sauce, lettuce, cheese, pickles and onions, but their buns have sesame seeds. My buns have no seeds.”

The word MACARONI is a generic product name, like GASOLINE or OIL, and cannot be copyrighted.
I submitted “MACARONI PLUS”.
I’m not a lawyer, but I think that while you couldn’t copyright the “WORD” you could copyright the PHRASE.
Who knows? Also, this little company couldn’t in a million years afford this much publicity. They’ve already won.

BK ribs are overpriced and terrible;if I wanted to chew on a burnt bone I'd be a dog.

Some of their other products are fine, and quality does vary from store to store.I've discovered one locally tends to serve lukewarm and tasteless food while another 5 miles away is much better.

There's probably no infringement. These guys just decided the legal fees fighting McDonalds would bankrupt them, even if they won.

I've stuck up for McDonald's as a successful American business model on other threads, but this smacks of the dark side of that monster corporation. They probably employ more lawyers than people who are concerned with the quality and nutritional value of food.
