No it's not. I'm sure the test with criminals is more like "Will this lie get me something I want and will I get caught?" than it is "Does the person asking this question have the right to the information?"
The brush is looking at the RKBA and the history of cases on the RKBA and the 2nd amendment. In that sphere, Thomas signed on to the same "Miller was convicted" rhetoric (and following legal consequences) in the Heller case. That's how.
If I were the Ninth Circuit, for once having a CORRECT decision overturned by SCOTUS, I would have responded:
"The court ordered us to reconsider Stewart and in doing so, to be guided by Raich. We have done so, with Raich invaluable as an example warning us of the tortured logic we might fall prey to should we try to misapply the Commerce Clause. Consideration of Raich was extremely helpful in reaching our decision; we sincerely thank you for recommending it. Our original decision in Stewart is therefore affirmed."
I know he stumbles once in a while, but he’s so vastly better than the others, I hardly seems fair to include him that that kind of list.
But the shall issue statute contains the actual permit application questions, and whether one uses marijuana (for any reason) is not among them.
It is important to know it is our state's more "conservative" County Sheriffs who have taken it upon themselves to add that question, and I don't believe for a minute that it spontaneously popped out of a vacuum.
Evidence enough that when these democratically elected officials come up for renewal we must give those races more scrutiny than maybe we have in the past. Their duty is to enforce laws (and more specifically state and local as opposed to federal), not make them.
Winning a war for illegal drugs is hardly something noble. In fact, it’s childish and stupid. But hey, if you want to fight it go ahead.
