Obama administration poised to challenge Arizona immigration law

The White House is expected to file a lawsuit next week.

A White House showdown with the state of Arizona over its tough new immigration law is likely to unfold next week, when the Obama administration is expected to file a lawsuit aimed at blocking the state's bid to curb illegal immigration on its own, according to people familiar with the administration's plans.

Arizona officials are girding for the legal challenge. The state has raised $123,000 in private donations to defend the law, according to Gov. Jan Brewer's office. Money has come in from all 50 states, in donations as little as $1.

Obama administration officials declined to reveal the basis for the suit. But legal experts say the challenge is likely to include the argument that in passing the law, Arizona violated the Constitution by intruding on the federal government's authority to regulate immigration.

If Arizona loses then I think all the border states should sue the federal government for all the costs associated with illegal aliens since the feds have failed to do the job required of them.

he’ll lose and if folks can’t see his motives are puerly selfish, political and just plain lame, they should after this; even when the millions of gallons of oild POUR into the gulf for purely selfish reason on political gains( cap and trade etc) just as McCrystal was tossed under the bus by someone NOT EVEN a corporal in the army like his pal Hitler was...he’ll lose and be known for ever what a damned fraud he always has been. I just hope some of his madness is reversible...imagine a pesident declaring war ion his own citizens; well imagine no more, he it the one, the empty suit one.

The Arizona law does not change immigration regulations. Just enforces them.

The way other states are wanting the same legislation as Arizona, it might be California boycotting 49 other states. Or is that 56?

I think the obamanoids better tread softly. The blowback from this could be powerful. Arizona's efforts at doing something have been very popular throughout the land.

This could be just what is needed to generate a round of tea parties all summer long, leading up to the elections. Bad timing for the rats. They must be getting unholy pressure from somewhere.

And, Arizona could very well prevail if it actually comes to a court case. If that happens, obama will have a gusher on his hands to rival the one in the Gulf.

Not a problem. More than half he citizens have challenged Obama’s citizenship and right to be POTUS.

If Arizona loses this suit, Arizona will no longer control its borders. But Arizona will control its state safety, and you can bet there won;t be one illegal safe from arrest.And the drug gangs now occupying tracts of Arizona wilderness?They will be eradicated, away from the border.

This is a no win situation for illegal aliens in Arizona, no matter what the feds do.

Arizona should refuse to enforce any Federal laws, like bank robbery's, kidnappings, drug laws, tax laws etc.

The standing of 0bambi’s case is that Arizona has no authority to enforce or replicate and enforce Federal immigration statutes. All they’re allowed to do is remand captured illegals to the Feds. If the Feds just let them go, which is what they do, then they should have sued the Feds.

It would be a lot easier to get a court to agree that the FedGov MUST enforce its laws than it will be to get a court to agree that a state can enforce Federal Law if the FedGov won’t.

Another thing Arizona could have done, which is within their Constitutional purview, is to have formed a State Militia to vigorously patrol the border, turning back illegals as they try to enter, and confiscating drugs for a daily burn pile.
